Navajo Area Indian Health Service Rev. 2/21/2023
DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity.
U.S. Department of Health and Human Services Indian Health Service Chinle Service Unit
2. Name and Address of Single Source.
Medtronic Brand
3. Description of Supplies/Services and Estimated Cost.
The Medtronic, Model 53401, Single Chamber Temporary Pacemaker The Medtronic, Model 5492VSL, Patient Cables
IGCE is valued at, $10,480.00
4. Description of Circumstances, including why only one source is reasonably available.
Single Chamber Temporary Pacemaker is a crucial piece of equipment for the Emergency Department to temporarily treat dangerous slow heart rates and arrhythmias the until the patient can have a Permanent Pacemaker placed by a Cardiologist at an outside hospital.
Medtronic is the only vendor that makes Temporary Transvenous Pacemakers. There are no alternative companies or devices on the market. We require a temporary External Pacemaker device that can be connected via the appropriate Patient Cable to an electrode that is placed into the Right Atrium of the heart via Central Venous Access to electronically pace the heart.
This is a safer and more effective and reliable method of pacing the heart as compared to external pacemakers which use electrodes placed on the skin. This can be a life saving measure, and is a standard piece of equipment for an Emergency Department to have.
No other brand meets these two criteria, and no other than 'Brand name" exists that would meet the needed criteria. Citing FAR 6.302-1(c)(1), (c) Application for brand-name descriptions. (1) An acquisition or portion of an acquisition that uses a brand-name

5. Determination of Fair and Reasonable Price.
The price is determined to be fair and reasonable based on market research, comparison of the proposed price with prices found on previous purchases, and the Independent Government Cost Estimate is fair.
6. Description of Market Research.
This brand name justification will be posted on SAM.gov giving fair opportunity to any vendors to come forward who may be able to meet the requirements.
Chinle Emergency Room Department performed an extensive world wide web to identify alternative vendors that make Temporary Transvenous Pacemakers, or potential alternative devices that could be used. No existing alternatives exist.
