About this file

This is a Determination to Solicit from a Single Source document issued by the U.S. Department of the Interior, California Great Basin Acquisition Services in Sacramento, California for solicitation number 140R2026Q0055.

The procurement is a firm-fixed-price, sole-source action to acquire confined-space rescue equipment and associated training services for the Northern California Area Office (NCAO) personnel. The single source contractor is American Emergency Response Training (AERT), Inc., located in Rockford, Tennessee. The required items include personal protective gear sets in multiple sizes (S, M, L), rescue technician kits, stretcher packs, safety equipment (litters, ropes, carabiners, harnesses), specialized rescue apparatus (TerrAdaptor tripod systems, battle boards), and Petzl belay/rappel gloves in various sizes, with a 60-day delivery lead time after receipt of order. The justification for sole-source procurement centers on AERT's exclusive proprietary licenses and methodologies for training on confined-space rescue equipment, unique technical expertise, and the critical need to standardize equipment across the rescue team to ensure operational safety, reduce response times, and maintain compliance with Bureau of Reclamation safety requirements. Market research included GSA Schedule review and SBA Dynamic Small Business Search using NAICS 339999, which identified 55 vendors but only 10 capable of supplying required items; however, only AERT can provide the specialized training services. Fair and reasonable pricing will be determined by the Contracting Officer using market research comparisons, previous purchase comparisons, and industry-related pricing analysis per FAR 13.106-3(a)(2).

4. Description of Circumstances, including why only one source is reasonably available.

Contracting Officer (CO) may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available. NCAO requires specialized training services to ensure personnel are fully qualified to safely utilize confined space rescue equipment at NCAO facilities.

AERT, Inc. is the only known source capable of providing this training at the level of technical expertise required, as they possess unique, proprietary knowledge of the equipment and have established experience delivering instruction aligned with the Bureau of Reclamation’s operational and safety requirements.

The contractor, AERT, holds the proprietary licenses necessary to provide training on these required items. Due to the proprietary nature of AERT’s licensed materials, methodologies, and training platforms, no other vendor is authorized to deliver the required instruction or access the controlled training content.

AERT’s exclusive licensing rights limit the availability of qualified sources capable of meeting the Government’s technical and instructional requirements. As a result, training for these items cannot be obtained through alternative providers without compromising compliance, technical accuracy, or the integrity of the proprietary systems involved.

Moreover, NCAO rescuers will be trained specifically in the AERT supplied equipment models currently in use. Standardizing equipment across the rescue team eliminates variability that could compromise established rescue protocols or introduce operational risk.

Familiarity with the equipment enhances safety, minimizes the likelihood of user error, and allows procedures to be executed correctly and with confidence. Using identical gear enables the rescue team to deploy without the need for additional training or equipment adjustments, which reduces response time and improves outcomes during emergencies.

Additionally, aligning operational equipment with existing training supports agency safety standards and procurement guidelines, ensuring compliance with internal policies and federal requirements. Therefore, procuring the same equipment used for training is a critical safety measure that enhances readiness, reduces risk, and supports best practices for NCAO rescue operations.

5. Determination of Fair and Reasonable Price.

The results of the restricted competition, comparison of proposed prices will be determined fair and reasonable by the Contracting Officer based on techniques set forth in FAR13.106- 3(a)(2)(i), market research, (ii), comparison of the proposed price with prices found reasonable on previous purchase, and (iv), comparison with similar items in a related industry.

6. Description of Market Research.

Reviewed the GSA Schedule Category 339113SPA and confirmed that American Emergency Response Training does not have a GSA contract.

Search was conducted on the Small Business Administration’s (SBA) Dynamic Small Business Search website using NAICS 339999 and a keyword “rescue” as search criteria.

The search resulted in 55 vendors matching the criteria. Upon reviewing the vendors’ capabilities, only 10 vendors capable of fulfilling this requirement. Based on the findings, the

Although there may be vendors capable of supplying the required items, the associated training services cannot be provided by other vendors, as the equipment and training are
