About this file

This document is a Determination to Solicit from a Single Source for the purchase of contractor services to facilitate collaboration and information sharing with hydropower industry peers for the U.S. Department of the Interior, Bureau of Reclamation.

The Bureau of Reclamation intends to award a sole source purchase order to the National Hydropower Association (NHA) under NAICS code 813910 Business Associations. NHA is the only industry group dedicated exclusively to the hydropower industry and can provide Reclamation with unique membership services, including access to member-only conferences, workshops, committees, analysis, and products not available from other sources. The determination was made pursuant to FAR 13.106-1(b)(1)(ii) that only NHA can fulfill the agency's requirements. Reclamation will continue an existing partnership with NHA to more effectively meet its hydropower mission. The Government anticipates awarding the order by December 2024, and will consider capability statements from any responsible sources that can meet the requirements detailed in the notice by the December 10, 2024 deadline.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-l(b)(l)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-l(b)(l)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Acquisitions Denver Office.

2. Name and Address of Single Source.

National Hydro-power Association

01 New Jersey Ave NW Ste 660

Washington, DC, 20001-2045

3. Description of Supplies/Services. Reclamation's objective is to acquire contractor services to facilitate collaboration and information sharing with hydropower industry peers - including federal water resource and energy management agencies (e.g., US Army Corps of Engineers, Department of Energy), regulatory agencies (e.g., Federal Energy Regulatory Commission), as well as non-federal stakeholder groupsincluding public and investor-owned utilities, independent power producers, manufacturers, researchers, and academics. Reclamation intends to use these services to better manage our hydropower resources.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-l(b)(l)(ii), specific characteristics of the National Hydro-power Association membership limit the availability to a single source. National Hydropower Association (NHA) is a national nonprofit association dedicated to promoting the growth of domestic hydropower. Only NHA can furnish the requirements, to the exclusion of other sources, because NHA has a wide variety of members that include approximately 300 public and investor-owned utilities, independent power producers, manufacturers, consultants, State Governments and attorneys. NHA membership provides Reclamation with services, including access to member-only conferences, workshops, and committees facilitating the exchange of information, best practices, and lessons learned with hydropower industry peers. In addition, membership allows Reclamation to access NHA analysis and related products on regulatory and legislative actions that may impact Reclamation's hydropower program, our customers, and the industry. Procurement will continue an existing partnership between Reclamation and NHA to more effectively meet our hydropower mission area objective.
