DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of the Interior, Bureau of Reclamation, Acquisition Management Division (AMD), Salt Lake City, Utah.

2. Name and Address of Single Source.

Advenco LLC, (dba Rocky Mountain Recreation), 10815 W 153rd TER, Overland Park, KS 6622I-

3. Description of Supplies/Services and Estimated Cost.

This requirement is for services that is urgently needed for continuation of Aquatic Invasive Species (AIS) inspections and decontamination services.

Services is currently performed by Advenco LLC on contract number R16PC00054 with a period of performance ending on November 12, 2021. This sole source award will be a continuation of services with an anticipated period of performance from November 13, 2021 to January 12, 2022 to meet Government’s need. We attempted to do a new award but ran into competition issues and solicitation was cancelled. The sole source award with Advenco will allow the government some time to put a new requirement in place. The type of work to be performed are listed below:

Task 1—AIS Inspection Services Contractor will provide AIS inspection services for trailered, motorized watercraft entering Elephant Butte Reservoir and Navajo Reservoir located in New Mexico. Contractor staff will be trained and certified by NMDGF prior to performance of watercraft inspections and decontaminations.

Task 2—Training and Certification for Inspection and Decontamination Services

All contractor staff will be required to attend Pacific State Marine Fisheries Commission Level I and II, Watercraft Inspection and Decontamination Training (WIT) and receive certification for all Inspectors. Training will be provided by NMDGF at no cost to either the Contractor or Reclamation.

Inspectors and staff will be paid through the contract for their time to attend the training. Training will be conducted for two 8-hour days, either onsite at the Reservoir(s) or at NMDGF office.

Task 3—Public Outreach

Public outreach will primarily consist of Inspectors conversing with the watercraft owner during the inspection. Rackcards and other education materials will be distributed during this interaction.

NMDGF and/or Reclamation will provide educational materials for distribution. This will also be covered during training.

Task 4—Decontamination of Watercraft

WBR 1413.106-1 Template 1 (11/2020)

As needed, Inspectors certified in Level II will perform hot water decontamination using the mobile decontamination units provided by Reclamation (1 unit stationed at Navajo Reservoir and 2 units are stationed at Elephant Butte Reservoir). Proper decontamination procedures will be outlined during training.

Task 5—Coordination with Law Enforcement and Red Tag Issuance

Work with law enforcement (NMDGF or other) on the issuance of Red Tag for non-compliant watercraft owners.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(i), only one source will be solicited because of the urgency of this requirement. The service must be performed or continue operation by November 13, 2021. If the required performance date is not met, government operations on these ramps in Navajo and Elephant Butte will cease operation and this will result in the Dam being invaded with Quagga Mussels which have been difficult to eradicate from the Dams thereby causing damages to equipment and proper functioning of the Dams.

5. Determination of Fair and Reasonable Price.

The cost of the additional work is expected to be at the same rate as the cost for the original contract, which was awarded competitively, and determined fair and reasonable. Cost will also be compared to the Government’s estimate as well as available market data for similar services. Price analysis will be done per FAR 13.106-3(a)(2)(ii) - Comparison of the proposed price with prices found reasonable on previous purchases.

6. Description of Market Research.

Market research was conducted for modification 12 of this same contract in April 2020 and also for the new replacement requirement that was solicited in June 2021. A Sources Sought notification was published on September 3, 2021 and only one vendor showed interest and submitted response to the Sources Sought.
