Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. (U.S. Department of the Interior (DOI), Bureau of Reclamation, Dam Safety Office.

2. Name and Address of Single Source.

RS Tipton, Inc.

1041 W Dry Creek Rd Littleton CO. 80120-8012

The goal of this assessment will be to design a course of study to equip DOI dam safety professionals to succeed in their assigned roles. This will be accomplished by utilizing a logical follow-on contract to the original contractor (FAR 16.505(b)(2)(i)(C)).

4. Description of Circumstances, including why only one source is reasonably available.

This requirement was identified as a logical progression and follow-on of the efforts that resulted from the assessments conducted under order# 140R8121P0105. In the original Performance Work Statement only the Dam Safety Offices within Reclamations assessed. The new work is an adaptation of the contractor’s customized of surveys and focus groups processes relating to dam safety from a single bureau to other bureaus dam safety within the Department of the Interior (DOI).

The unique experience R S Tiptons brings with the successful development of their customized surveys and focus groups interviewing processes for Reclamations Dam Safety program has set a benchmark wherein it is intrinsic that consistency is maintained as this base portion of the process is incorporated within Department of Interior’s Dam Safety Program.

It is not in the Governments best interest to recompete the requirement. The risk in bringing a different contractor at this point presents an unacceptable risk in that a conflicting process that would be developed, undoing the efforts obtained from the original, and increasing the required cost investment unify the dam safety programs within the Department.

5. Determination of Fair and Reasonable Price. Pricing will be evaluated using the pricing established from the original award 140R8121P0105 and current market prices to ensure it is fair and reasonable.
