About this file

This document is a determination for a single source solicitation. The U.S. Department of Interior Bureau of Reclamation Columbia-Pacific Northwest Region requires a historian system to be supplied and installed at its Snake River Area Office Southern Idaho Control Center. The estimated cost for the system from the incumbent contractor HSQ Technology is $56,695, with delivery within 160 days of award. As the original designer of the proprietary SCADA software currently used, HSQ is the only contractor capable of providing the required upgrades and changes to integrate the historian system due to intellectual property restrictions. Market research found no other vendors able to perform the work. The determination cites the 27-year relationship with HSQ and past single source justifications. Pricing will be determined fair and reasonable based on previous awards.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity.

U.S. Department of Interior, Bureau of Reclamation, Columbia-Pacific Northwest Region.

2. Name and Address of Single Source.

HSQ Technology, A Corporation (HSQ) 26227 Research Road Hayward, CA 94545-3725

3. Description of Supplies/Services and Estimated Cost.

Reclamation needs a historian system to be supplied and installed at the Columbia-Pacific Northwest Region’s, Snake River Area Office, Southern Idaho Control Center (SICC). The historian system will allow access to historic and future SCADA data and make data retrieval less labor intensive for SICC staff.

The delivery schedule is 160 after contract award.

The estimated cost is $56,695.00.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(ii), HSQ is the only contractor capable of providing this service.

SRAO currently owns and operates the existing SCADA software system designed and built by HSQ. At the time of initial installation in 1996 and for the last 27 years, Reclamation accepted a software system which HSQ maintains a primary intellectual/copyright which cannot be replicated. As a result, HSQ is the only firm able to make changes to its software system(s). As previously mentioned, BOR’s requirement is for a SCADA historian system supply and install. All services will require the contractor to have specific knowledge of the proprietary SCADA software system in order to make changes and/or updates to the SCADA historian system. Therefore, HSQ is the only firm capable of providing the services.

5. Determination of Fair and Reasonable Price.

Pricing will be determined to be fair and reasonable by utilizing past pricing received from HSQ for similar services. HSQ has a current award for software maintenance (140R1018C0019).

6. Description of Market Research.

Market research indicates no other vendor is currently available to provide these required SCADA software and system upgrades primarily as a result of the aforementioned intellectual/copyright limitations. Over the last 27 years Reclamation has maintained a contract for technical support with HSQ and during each renewal a notice of intent to award a single source contract has been published and each time there have been no alternate providers found. Reclamation research also indicates having the entire SCADA software and hardware system replaced is not a feasible solution as the current infrastructure satisfies our current needs until the system is fully replaced which is schedule to be completed before FY 2030.
