Title: Low-Level Waste (LLW) & Mixed Low-Level Waste (MLLW)

Disposal Services (2018)

Sources Sought/Request for Information

THIS IS NOT A REQUEST FOR QUOTE OR PROPOSAL. THIS IS A REQUEST FOR

INFORMATION (RFI) ONLY. No solicitation is available. This RFI is released pursuant to

FAR Part 15.201(e), Exchanges with Industry, and is issued for the purpose of conducting market research.

The U.S. Department of Energy (DOE), Environmental Management Consolidated Business

Center (EMCBC) is seeking information regarding the ability and availability of qualified contractors to provide for permanent disposal of either one or more of the following waste types:

Class A, B, and C Low-Level Waste (LLW) and Mixed Low-Level Waste (MLLW); 11e.(2) byproduct material, technologically-enhanced, naturally-occurring radioactive material

(TENORM); and sealed sources, as defined by the Atomic Energy Act, the Resource

Conservation and Recovery Act, the Toxic Substances Control Act, and their implementing regulations. Disposal is to be performed in accordance with the referenced laws and regulations in a permitted and licensed facility.

DOE requests qualified, interested parties to demonstrate that they have, or can timely acquire, the capability and required authorizations, licenses, permits, facilities, personnel, and equipment to accomplish the acceptance, transportation, storage, repackaging, and treatment of DOE wastes. This includes development and maintenance of treatment plans, coordination and notification of regulators, and disposition of all residual, byproduct, and secondary wastes.

The anticipated number of contract(s), type of contract(s), period(s) of performance, amount of funding, and small business participation opportunities for the follow-on acquisitions are yet to be determined. LLW & MLLW Disposal Services are currently performed under two separate

IDIQ contracts (DE-EM0002405 and DE-EM0002406, which can be found here:

https://www.emcbc.doe.gov/About/PrimeContracts). Both contracts expire in April 2018.

DOE is also seeking to determine whether or not the full requirement can be set-aside for small businesses, 8(a) small businesses, small disadvantaged businesses, economically disadvantaged women-owned small businesses, women-owned small businesses, HUBZone small businesses, veteran-owned small businesses, or service-disabled veteran-owned small businesses. Small businesses believing that they have the capability to perform all or part of the requirements are welcome to demonstrate their capabilities. The North American Industry Classification System

(NAICS) code for this requirement is anticipated to be 562211, Hazardous Waste Treatment and

Disposal, and the small business size standard is $38.5 Million.

THIS ANNOUNCEMENT IS NOT A REQUEST FOR PROPOSALS (RFP) AND SHALL

NOT BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT TO AWARD A

CONTRACT.

All interested parties are hereby invited to submit a capability statement of no more than 5 pages, and no smaller than Times New Roman 12-point font. Also, electronic file submissions must be less than 20 Megabytes. Capability statements should include the following information:

1. Describe your firm’s ability (and any constraints) to execute and manage the unique aspects of permanent LLW/MLLW disposal to provide all personnel, facilities, equipment, material, supplies, and otherwise do all things necessary, for the permanent disposal of Class A, B, and C LLW/MLLW; 11e.(2) byproduct material; TENORM; and sealed sources, including acceptance of waste delivered by rail and/or truck. Additionally, each firm should provide its ability to perform environmental compliance, operations, operational support, safeguards and security, quality assurance, facility management, administration, and project management activities. The submission should include specific disposal permit and license information with regard to abilities and restrictions.

2. Interested parties are requested to provide name of the firm, point of contact, phone number, email, address of firm, and a CAGE Code or DUNS Number used over the past

5 years. Small business teams or joint ventures shall identify the socio-economic status of each member against the above-noted NAICS code and shall provide a description of the work that each member would perform under the contract structure (e.g., contract type, number of contracts) the entity believes is most advantageous to the Government.

DOE reserves the right to use any and all information submitted by, or obtained from, an interested firm in any manner DOE determines is appropriate including, but not limited to, the creation of a competitive solicitation. Interested parties must not submit any classified information in their responses and should avoid submitting business confidential and/or proprietary information. However, if an interested firm must submit business confidential and/or proprietary information, the information must be clearly marked. In addition, the interested firm must provide sufficient justification as to why such information is business confidential and/or proprietary. DOE will review the information and safeguard it appropriately.

The Government will not reimburse preparation costs or otherwise provide compensation for any information that is provided in response to this announcement. All capability statements shall be submitted electronically to Ian Rexroad, Contract Specialist, at
