Department of Energy National Nuclear Security Administration

Service Center P. O. Box 5400

Albuquerque, NM 87185

SUBJECT: Notice of Intent to Sole Source

The U.S. Department of Energy, National Nuclear Security Administration (NNSA), Office of Business Services is contemplating negotiating a large business sole source contract under authority of 41 USC 253(c)(1) and FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements,” with Trane U.S. Inc., 4401 Ellison St. NE, Albuquerque, NM 87109. Trane is the only known source that can provide the required part that is compatible with the existing Trane equipment as well as provide preventative maintenance on its own products. This acquisition will be accomplished under FAR Part 12 – Acquisition of Commercial Items and FAR Part 13 – Simplified Acquisition Procedures. The applicable North American Industry Classification System (NAICS) code for the proposed acquisition is 238220.

The NNSA Service Centers’ decision to select Trane is based on the initial installation of the HVAC units during the construction of the Los Alamos Site Office in 2008. Trane has the unique capability of providing both product and expert service by trained personnel, provide factory-compatible equipment, and the only service provider to continue the factory warranty from original installation for this requirement.

This notice of intent is not a request for competitive proposals. A determination not to compete this proposed action is solely within the discretion of the Federal Government. Information received will normally be considered solely for the purposes of determining whether to conduct a competitive procurement. This notice in no way obligates the Government to award any contract.

NNSA will not be responsible for any costs incurred by responding to this “Notice of Intent to Sole Source.” Any questions or comments pertaining to this action shall be faxed to (505) 284- 7122, Attn: Krystal Maestas, NNSA Contract Specialist, no later than September 10, 2010.
