JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

NATIONAL NUCLEAR SECURITY ADMINISTRATION

OFFICE OF INFORMATION MANAGEMENT AND CHIEF INFORMATION OFFICER

CONTRACT DE-DT0001389

October 15, 2015

I. AGENCY AND CONTRACTING ACTIVITY

The Office of Information Management and Chief Information Officer (NA-IM) of the U.S.

Department of Energy (DOE), National Nuclear Security Administration (NNSA) plans to contract for additional Information Assurance Response Center Cyber Security Support Services by using an exception to fair opportunity. The contracting activity is the NNSA Non- M&O Contracting Operations Division, Services Acquisition Branch, Headquarters Program Section (NA-APM-124.1).

II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED

This acquisition action is to modify OnPoint Consulting, Inc. Task Order GS-06F-0648Z/DE- DT0001389 to extend the period of performance for six months to include a one-month base period, one two-month option period, and three one-month option periods. Task Order DE- DT0001389 was awarded to OnPoint Consulting, Inc. (OnPoint), 2107 Wilson Boulevard, Suite 510, Arlington, VA 22201, for NA-IM, on April 21, 2010, pursuant to a fair opportunity competition under the General Services Administration’s (GSA) Alliant Small Business (ASB) Government-Wide Acquisition Contract (GWAC), which was open to all awardees under the ASB GWAC. Task Order DE-DT0001389 was awarded for a five year period of performance from April 21, 2010 – April 20, 2015 inclusive of one two-year base period, one one-year option period, and one two-year option period. The firm fixed price task order has a current ceiling price of $96,701,007.84.

On April 14, 2015, the contract was extended for six months to October 31, 2015. This six-month extension was required in order for the agency to resolve a protest that an unsuccessful vendor filed in response to the award of the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreement (BPA). The protest pushed back the timeline for the award of the follow-on Task Orders under the BPA. The government anticipates that an award for the follow-on Task Order to DE-DT0001389 will be made no later than December 1, 2015, but is seeking the option to extend the contract until April 30, 2016 to allow time to resolve any protests that may arise following the Task Order awards.

DE-DT0001389 Modification 0058 will extend the period of performance for an additional six months (inclusive of a one-month base period, one two-month option period, and three one-month option periods) to allow time to finalize the follow-on contract. This action will extend the contract performance period from October 31, 2015 to April 30, 2016. Services for each period will be added as separate firm fixed price Contract Line Item Numbers (CLINs) under Task Order DE-DT0001389 as follows: CLIN 00014 Services Extension Base Period (November 1, 2015 – November 30, 2015), CLIN 00015 Services Extension Option Period 1 (December 1, 2015 – January 31, 2016), CLIN 00016 Services Extension Option Period 2 (February 1, 2016 – February 29, 2016), CLIN 00017 Services Extension Option Period 3 (March 1, 2016 – March 31, 2016), and CLIN 00018 Services Extension Option Period 4 (April 1, 2016 – April 30, 2016).

Option Periods will only be exercised if the follow-on task order requires additional time to award. All additional Travel, Other Direct Costs (ODCs), and Project Support for the extension periods will utilize existing CLINs: 000011 Travel, 00012 ODCs, and 00013 Project Support.

The modification is valued at $9,267,009.90 and will increase the ceiling price of the contract from $96,701,007.84 to $105,968,017.74.

In accordance with Acquisition Letter 2010-05 when seeking a period of performance in excess of five years, the following considerations have been addressed:

1. The work scope (including the ability of the requirements initiator to define with certainty the desired requirements and outcomes and identify clear measures for Government acceptance of work);

The work scope is addressed in Section III below. Through a Performance Work Statement, the OCIO has defined their desired requirements and outcomes, and identified clear measures for Government acceptance of work.

2. Contract type;

The Task Order is FFP.

3. NNSA resources to administer the contract;

The OCIO and Office of Acquisition Management have dedicated the resources required to administer the Task Order.

4. Length of term in excess of 5 years;

The total overall length of the Task Order will be a maximum of six years.

5. Severability of the work requirements;

The services provided are severable and can be incrementally funded.

6. Evidence that the requirement can be priced with reasonable certainty;

The OCIO has prepared an Independent Government Cost Estimate (IGCE) for the proposed six-month extension.

7. Ability to provide a funding profile consistent with and adequate for contract performance;

competition impacts both on the instant action and future requirements.

The OCIO has the funding resources required to allow for full Task Order performance.

The extension allows for the completion of

8. Impact on DOE's socio-economic goals and objectives.

The extension will promote NNSA’s small business objective by allowing for the award of the follow-on Task Order to a small business entity. All holders of the IICS BPA are small businesses.

III. DESCRIPTION OF SERVICES

Under Task Order DE-DT0001389, OnPoint provides Cyber Security support services to operate and manage the NNSA Information Assurance Response Center (NIARC) located in Las Vegas, Nevada. The NIARC consists of a technical operating environment with: Linux workstations, Storage Area Networks (SANs), Security Information Event Management (SIEM) technology, Oracle databases, Windows, Solaris, and Linux servers, Cisco and Juniper infrastructure devices, and Intrusion Detection Systems (IDS).

This technology is implemented at the NIARC as well as throughout the NNSA complex where the NIARC has the responsibility of monitoring. The NIARC provides: 24 hours a day, 7 days per week, 365 days a year (24x7x365) security monitoring for NNSA classified networks;

24x7x365 security monitoring for unclassified networks approved for the service; Enterprise Secure Network (ESN) Operational Services; enterprise security systems to the NNSA complex;

and classified incident management.

OnPoint currently travels to sites being monitored to respond to incidents and travels to new sites being added to set up monitoring services and install equipment. Regarding ODCs, OnPoint is responsible for recommending, deploying, configuring, and managing all equipment required for the NIARC operation under Task Order DE-DT0001389. ODCs purchases include license renewals, training, projects, and facility costs.

There are currently two active Work Assignments under CLIN 00013 Project Support—Work Assignment 003 for NIARC Cost Recovery Services and Work Assignment 004 to Establish and Operate the Common Service Provider Registration Authority for the Department of Energy Secret Fabric.

OnPoint will continue its prior work in supporting the above services and work assignments, as well as all associated travel and ODCs.

The estimated value of this Task Order modification is $9,267,009.90.

IV. EXCEPTION TO FAIR OPPORTUNITY

The statutory authority permitting other than full and open competition is Federal Acquisition Regulation (FAR) Subpart FAR 16.505(b)(2)(i)(C), which states: “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”

V. JUSTIFICATION FOR USING THE EXCEPTION

OnPoint currently provides expertise and support for the operation and maintenance of the NIARC located in Las Vegas, Nevada under Task Order DE-DT0001389 and is the only contractor that can continue to provide the required services within the time frame required.

OnPoint’s contract expires on October 31, 2015, and the OCIO requires continued support for up to an additional six months until the follow-on Task Order is awarded no later than April 2016. This modification is a logical follow-on in that the proposed increase is an extension of the current work scope. OnPoint will continue to perform all current tasks within the Task Order’s Performance Work Statement (PWS) at the same unit price for Services and Project Support.

Travel and ODCs are cost reimbursable and shall be approved by the Contracting Officer’s Representative in advanced.

VI. DETERMINATION OF REASONABLENESS OF COST OR PRICE

The Contracting Officer has determined that the anticipated price is fair and reasonable based on price analysis techniques utilized under FAR 15.404-1(b)(2). In accordance with FAR 15.404-1(b)(2)(C)(v) and FAR 15.404-1(b)(2)(C)(vi), the Government compared OnPoint’s proposed price to the Independent Government Cost Estimate (IGCE) and prices obtained through market research for the same or similar items. Based on this analysis, the Contracting Officer determined that OnPoint’s proposed price of $9,267,010.00 for this modification is fair and reasonable.

VII. OTHER FACTS

There are no other facts relevant to this Justification for an Exception to Fair Opportunity.

VIII. STEPS TO FOSTER COMPETITION

The NNSA released a solicitation for the follow-on contract to DE-DT0001389 on August 31, 2015, and anticipates an award by approximately December 1, 2015. The follow-on contract was released under the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreement (BPA), which means that the award will be made to a small business because the BPA is a small business set-aside.
