About this file
The document is a Declaration of Non-Collusion form issued by the Toledo Area Regional Transit Authority (TARTA) for a potential contract opportunity. The form is a mandatory submission requirement for bidders, designed to ensure fair competition and prevent collusive practices in the bidding process. Each bidder must certify that their bid prices have been developed independently, without consultation or communication with competitors, and that no attempts have been made to restrict competitive bidding.
The declaration requires bidders to affirm that they have not disclosed bid prices to other competitors prior to the public bid opening, have not attempted to induce other parties to submit or withhold bids, and have not entered into any agreements that would restrain the free submission of competitive bids. The document explicitly states that a bid may be disqualified if these conditions are not met, and provides some exceptions for standard business practices like publishing price lists or selling items to multiple customers at consistent prices. TARTA reserves the right to determine whether any deviations from these requirements are intended to restrict competition.

DECLARATION OF NON-COLLUSION
By submission of this bid, each person signing on behalf of any bidder declares and certifies, and in the case of joint bid, each party thereto declares and certifies as to its own organization, that the following are true and correct statements:
1) The prices in this bid have been arrived at independently without collusion, consultation, communication, or agreement of any kind undertaken for the purpose of restricting competition as to any mater relating to such prices with any other bidder or competitor or any representative of either any other bidder or competitor;
2) Unless otherwise required by law, the prices which have been quoted in this bid have not been knowingly disclosed by the bidder and will not be knowingly disclosed by the bidder prior to the publicized opening of the bids, directly or indirectly, to any other bidder or to any other competitor; and
3) No attempt has been made or will be made by the bidder to induce any other person, partnership or corporation to submit or not to submit a bid for the purpose of restricting competition.
4) No agreement has been entered into with any other bidder or potential bidder, or other action taken, in restraint of the free submission of competitive bids.
Name of Bidding Company and Title of Declarant
Signature and Printed Name of Declarant Date
Note:
A bid shall not be considered for award, nor shall any award be made where paragraphs 1, 2 and
3 above have not been complied with and this Declaration signed to certify same: provided, however, that if in any case the bidder cannot make the foregoing declaration, the bidder shall so state and shall furnish with the bid a signed statement which sets forth in detail the reason therefore. Where any one or more of Paragraphs 1, 2 and 3 above have not been complied with, the bid shall not be considered for award, nor shall any award be made to the bidder, unless and until the head of the purchasing unit of TARTA, or his or her designee, determines that such disclosure was not made for the purpose of restricting competition.
The fact that a bidder (a) has published price lists, rates or tariffs covering items being procured or provided, (b) has informed prospective customers of proposed or pending publication of new or revised price lists for such items, or (c) has sold the same items to other customers at the same prices being bid, does not constitute, without more, collusion, consultation, communication, or agreement within the meaning of paragraph 1, disclosure within the meaning of Paragraph 2, or agreement within the meaning of paragraph 4.
Each bidders MUST submit this original sheet with proposal
