JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
NATIONAL NUCLEAR SECURITY ADMINISTRATION
OFFICE OF INFORMATION MANAGEMENT AND CHIEF INFORMATION OFFICER TASK
ORDER DE-DT0001389
December 2016
I. AGENCY AND CONTRACTING ACTIVITY
The Office of Information Management and Chief Information Officer (NA-IM) of the U.S.
Department of Energy (DOE), National Nuclear Security Administration (NNSA) plans to contract for additional Information Technology Services to support the NNSA Information Assurance Response Center by using an exception to fair opportunity. The contracting activity is the NNSA Non-M&O Contracting Operations Division, Services Acquisition Branch, Headquarters Program Section (NA-APM-124.1).
II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED
This acquisition action is to modify OnPoint Consulting, Inc. Task Order GS-06F-0648Z/DE- DT0001389 to extend the period of performance for up to five months to include a one-month base, three-month option, and a one-month option periods. The firm fixed price task order has a current ceiling price of $105,357,344.00. Task Order DE-DT0001389 was awarded to OnPoint Consulting, Inc. (OnPoint), 2107 Wilson Boulevard, Suite 510, Arlington, VA 22201, for NA-IM, on April 21, 2010, pursuant to a fair opportunity competition under the General Services Administration’s (GSA) Alliant Small Business (ASB) Government-Wide Acquisition Contract (GWAC), which was open to all awardees under the ASB GWAC. Task Order DE-DT0001389 was awarded for a five year period of performance from April 21, 2010 – April 20, 2015 inclusive of one two-year base period, one one-year option period, and one two-year option period.
On April 14, 2015, the task order was extended for six months to October 31, 2015. This six-month extension was required in order for the agency to resolve a protest that an unsuccessful vendor filed in response to the award of the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreement (BPA). The protest pushed back the timeline for the award of the follow-on Task Orders under the BPA. On October 29, 2015, DE-DT0001389 Modification 0058 extended the period of performance for an additional six months, to April 30, 2016, to allow time to finalize the follow-on task order.
NNSA awarded the follow-on Task Order (DE-BP0004824) for information technology support services on January 14, 2016. Subsequently, NNSA received a U.S. Government Accountability Office (GAO) protest related to the award of the follow-on task order; therefore, on April 29, 2016, NNSA issued Modification 0065 to extend the task order period of performance for an additional two months to June 30, 2016 to allow time to receive GAO’s decision.
On May 2, 2016, the GAO sustained a protest to the award of DE-BP0004824. The NNSA has implemented corrective action and complied with the GAO recommendation by determining that the Original RFQ does not reflect the Government’s current, actual requirements. All three small business vendors under the IICS BPA are being provided a fair opportunity to compete for the three Orders in accordance with the new RFQs and PWS requirements. A modification to DE-DT0001389 was necessary to serve as a bridge contract while the new requirements were finalized and for a competition to take place. The bridge contract was awarded on June 30, 2016 and will run until December 31, 2016.
On September 6, 2016 Request for Quotation (RFQ) DE-SOL-0010157 was issued under the IICS BPA to implement corrective action and comply with the GAO recommendation. RFQ DE- SOL-0010157 closed on September 21, 2016 and the evaluation process is ongoing. A modification to DE-DT0001389 is necessary to serve as a bridge contract while the evaluation and selection process continues. This action will extend the task order period of performance from December 31, 2016 to January 31, 2017, with options to extend performance until May 31, 2017. The evaluation and selection process is not anticipated to last for an additional five months, but extra time is being built in as option periods to account for unanticipated delays that may arise. Services for the new five-month bridge contract will be added as separate firm fixed price Contract Line Item Numbers (CLINs) as follows: CLIN 00024 Services Extension Option Period 10 (January 2017), CLIN 00025 Services Extension Option Period 11 (three-month option period for February 1, 2017 – April 30, 2017), and CLIN 00026 Services Extension Option Period 12 (option period for May 2017). All additional Travel, Other Direct Costs (ODCs), and Project Support for the extension periods will utilize existing CLINs: 000011 Travel, 00012 ODCs, and 00013 Project Support. The total price of the extension (inclusive of the base period and both option periods) is $1,919,365.50 and the ceiling will increase from $105,357,344.00 to $107,276,709.5 as a result of the modification.
III. DESCRIPTION OF SERVICES
Under the current version of Task Order DE-DT0001389, OnPoint provides information technology services to support the NNSA Information Assurance Response Center (NIARC) located in Las Vegas, Nevada and provide Enterprise Secure Network (ESN) and NNSA Secret Network (NSN) Operational Services. The NIARC consists of a technical operating environment with:

OnPoint will continue to have the following information technology responsibilities at the NIARC:
Provide ESN and NSN Operational Services:
o Support ESN centralized security logging and retention for all sites participating in the classified network o Participate in teams to determine scalable solutions, both within the NIARC and the ESN/NSN o Establish and maintain communications for ESN and NSN including classified and unclassified portals, VTC, and secure chat o Maintain the centralized ticketing system for ESN and NSN system components

OCIO
There is currently one active Work Assignment under CLIN 00013 Project Support—Work Assignment 004 to Establish and Operate the Common Service Provider Registration Authority for the Department of Energy Secret Fabric.
The price associated with the additional information technology services for the five-month extension is $1,919,365.50 (one-month base period for January 2017 is $383,873.10, three-month option for February 1, 2017 – April 30, 2017 is $1,151,619.30, and one-month option for May 2017 is $383,873.10).
IV. EXCEPTION TO FAIR OPPORTUNITY
The statutory authority permitting other than full and open competition is Federal Acquisition Regulation (FAR) Subpart FAR 16.505(b)(2)(i)(C), which states: “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”
V. JUSTIFICATION FOR USING THE EXCEPTION
OnPoint currently provides information technology support to the NIARC located in Las Vegas, Nevada under Task Order DE-DT0001389 and is the only contractor that can continue to provide the required services within the timeframe required. OnPoint’s task order expires on December 31, 2016, and the OCIO requires continued support for up to an additional five months until the re-compete for DE-BP0004824 for information technology support is awarded following a sustained protest against the original award. Extending OnPoint Task Order DE- DT0001389 is the most economic and efficient method to obtain the required information technology support services because OnPoint is currently in place at the NIARC facility and has been performing the work scope since April 2010.Transferring the required support to another contractor for up to five months would result in duplicative costs incurred by the NNSA for contract transition, and could potentially result in a gap in service. Extending the task order ensures continuity of the critical information technology support services. This modification is a logical follow-on in that it is a continuation of the current information technology work scope that OnPoint currently performs. Under this action, OnPoint will continue to perform the current information technology support tasks within the Task Order’s Performance Work Statement (PWS). Additionally, the original task order was competed under the GSA’s ASB GWAC in 2010, and all awardees were given a fair opportunity to be considered for the original order.
VI. DETERMINATION OF REASONABLENESS OF COST OR PRICE
The Contracting Officer has determined that the price is fair and reasonable based on proposal analysis techniques utilized under FAR 15.404-1. In accordance with FAR 15.404-1(c)(2)(i)(D), the Government relied on the GSA negotiated fully burdened labor rates that were determined fair and reasonable. Based on this analysis, the Contracting Officer determined that OnPoint’s proposed price of $1,919,365.50 ($383,873.10 for the one-month base and one-month option period, and $1,151,619.30 for the three-month option) for the additional service from January 1, 2017 until April 30, 2017 is fair and reasonable.
VII. OTHER FACTS
None.
VIII. STEPS TO FOSTER COMPETITION
The follow-on Order RFQ was released under the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreement (BPA), and the resulting order award will be made to a small business, as the BPA is a small business set-aside. The evaluation process is ongoing.
