STATEMENT OF WORK

Geographic Information Systems in support of environmental and social performance due diligence – indonesia II compact A. Introduction The Millennium Challenge Corporation (MCC) is a U.S. Government corporation whose mission is to provide assistance that will support economic growth and poverty reduction in carefully selected countries that demonstrate a commitment to just and democratic governance, economic freedom, and investments in their citizenry. For more information on the MCC, please visit www.mcc.gov.

MCC has been working in Indonesia since 2006, helping to improve governance, fight corruption and enhance public health through the MCC Threshold program. This program, which concluded in December 2010, was designed to strengthen key anti-corruption institutions and to create a more efficient and sustainable immunization surveillance system.

MCC’s first, $600 million compact with Indonesia was signed in November 2011. The compact was designed to reduce poverty through economic growth by supporting three of the Government’s growth and development priorities: better health and nutrition, procurement modernization, and sustainable energy and resource management. The compact included three projects in these priority areas, and was designed and implemented with a focus on community ownership and innovative, scalable models that would allow for emerging opportunities. The 2011 Indonesia Compact successfully concluded on April 2, 2018. Against this backdrop, on December 11, 2018, MCC’s Board of Directors selected Indonesia as eligible to develop a second compact program.

Despite challenges, MCC and the Government have achieved many successful outcomes through our partnership and will incorporate key lessons learned from the 2011 Indonesia Compact into the design of the new compact program. For example, learning from the first compact program – which was both geographically and sectorally diverse – MCC and the Government plan to develop a more focused second compact in order to streamline implementation and ensure greatest impact.

Beginning with the preliminary analysis phase of compact development, MCC and the Government will work together to consider geographic and sectoral areas of focus that can then facilitate a more efficient set of stakeholder engagements and a more effective project design and due diligence phase.

B. Country Indonesia and any MCC eligible country.

C. Scope and Objectives MCC requires professional geographic information systems (GIS) consulting services to support the development of the Indonesia II Compact. The Consultant will provide geospatial support and ongoing technical assistance to MCC’s Environmental and Social Performance Practice regarding the local government, political, institutional, cultural and ecological context of individual provinces and districts within Indonesia, while closely coordinating with MCC staff in Washington to support adherence to MCC compact development requirements and policies.

At this stage of compact development neither geographic focus nor sectors have been identified. Accordingly, the expertise needed will be with the application of GIS to the general Indonesian development setting, particularly with respect to the use of natural resources and other sectors that relate to economic development. The Consultant will support collection of data that complement MCC’s effort to undertake rapid and ongoing assessment of local and provincial government’s abilities to meet MCC’s Environmental Guidelines and other requirements (e.g. tax exemption, relevant permitting, local regulatory provisions) as well as support a general understanding of other factors and/or actors affecting policymaking at the local and provincial level during the selection phase. The Consultant will also be required to provide GIS support after local governments have been recruited for participation in a possible MCC investment. Experience working with municipal and local governments in Indonesia on development projects, including those associated with MCC’s first Indonesia Compact, will be particularly valuable.

D. Tasks and Deliverables Tasks:

The consultant’s assignments may include, but will not be limited to, the following:

1) Identification of key opportunities, risks and impacts that are anticipated to arise from potential Compact interventions, with specific attention to natural resources, cultural resources, ecosystem services, and involuntary resettlement.

2) Analysis and recommendations on appropriate spatial data management programs that are tailored to Compact needs and the Indonesian context, especially in light of any updates in GOI legal and regulatory frameworks;

3) Analysis and recommendations on organizational capacity and competency that is required to implement geospatially oriented and GIS technology-related work within the Indonesia II Compact Development team, and among various stakeholders, including community members, government officials, contractors, and any other potential implementing partners;

4) Advice regarding potential land use and spatial planning constraints related to potential Compact interventions in order to ensure adherence to MCC’s Environmental Guidelines;

The consultant would be precluded from bidding on work and services (design, assessment, construction and supervision) to be procured by the local MCA accountable entity or using funds advanced under a Compact in the relevant country. The designated Consultant would be expected to coordinate with local authorities responsible for MCC Compact implementation (MCC Indonesia II Implementation Support Team and Indonesia Compact Development Team), as well as other consultants, Government of Indonesia agencies and donors, where relevant. However, designated Consultant would report directly to the designated COR/PM.

Deliverables

The Consultant will provide services to MCC on an as needed basis, as required. To support MCC in the flexible and timely manner needed to meet the evolving needs of the technical directives under this statement of work will be issued and the Consultant deployed each time the Consultant’s services are needed over the course of this contract. No additional tasks shall imply any additional costs to the Government beyond the amount allowed for in the initial call order; however, this call order may be amended to reflect additional costs associated with implementation planning and oversight requirements in additional countries.

Deliverable 1: Trip reports, ad hoc reports or information as may be requested by the COR/PM.

Deliverable 2: Final report, including comments by MCC, due as per agreement.

E. Place and Period and Place of Performance

All work under this contract will be completed between effective dates of the contract award for a two year period. The estimated level of effort is 600 hours per year with an estimated 2 trips per year. MCC anticipates this level of effort but does not guarantee this level of effort as it may increase or decrease.

The consultant will work from its home office and/or Indonesia Compact Development Team headquarters with domestic travel to potential Compact intervention sites, as required. Travel to USA may be required.

F. Conflict of Interest

The Consultant will be precluded from bidding on work and services (design, assessment, construction and supervision) to be procured by the local MCAs accountable entity or using funds advanced under a Compact in the relevant country.

G. Subcontracting Consultants, registered as vendors are authorized to subcontract data collection, data preparation, economic analysis, and related services as needed. The overall costs for subcontracting shall not exceed 25% of the consultant’s total negotiated unloaded direct labor cost.

H. Timing and Reporting All formal communication with MCC, including reports, will be submitted to the Contracting Officer Technical Representative (COR), Program Monitor (PM), and other designated MCC personnel. The COR/PM for this requirement will be identified via separate correspondence.

The COR/PM will have technical responsibility for monitoring the contractor’s performance. The COR/PM will review and evaluate the contractor’s performance, and also will coordinate any communications with relevant counterparts and other donor agencies and organizations.

Any changes in the terms of the SoW will be made in writing and approved by the Contracting Officer. No representation of the COR/PM shall serve as a basis for an alteration in the general scope of this SoW or of the terms and conditions of the SoW unless confirmed in writing by the Contracting Officer. The contractor must communicate with the Contracting Officer on all matters that pertain to the Contract terms. Proceeding with the work without proper contractual coverage could result in nonpayment for that work.
