REGULATION (FAR) SUBPART 16.5 ACQUISITIONS
EXCEPTION TO FAIR OPPORTUNITY
Multiple Award Schedule (MAS) / Multiple Award Contract (MAC)
Orders under MAC/ Fair Opportunity – FAR 16.505, Department of Defense FAR Supplement (DFARS) 216.505-70, Procedures, Guidance and Information (PGI) 216.505-70
Purchase Request Number: TBD Contract Number: HC1047-13-D-4001 Task/Delivery Order Number: 0003 Procurement Title: DISA Command Center (DCC) Alternate Site and JFHQ DODIN Support Contracting Office: PL62 Estimated Value: $2,196,047.07 Authority: FAR 16.505(b)(2)(i)(C)
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Number: JA15-077
Upon the basis of the following justification, I, as the Procuring Activity Competition Advocate, hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.505(b)(2)(i)(C).
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Defense Information Systems Agency TOA1 Program Control Office P.O. Box 549 Fort Meade, MD 20755-0549
Defense Information Technology Contracting Organization National Capital Region (DITCO-NCR) P.O. Box 549 Fort Meade, MD 20755-0549
2. NATURE/DESCRIPTION OF ACTION(S): The purpose of this action is to modify task order HC1047-13-D-4001/0003 (HighAction, LLC) to extend 24x7 desk-side user support and Network Infrastructure maintenance support to the newly formed Joint Force Headquarters (JFHQ) which falls under DISA’s responsibility and is co-located with at the DISA Headquarters facility. The proposed modification will be Firm Fixed Price (FFP), and the estimated cost is $2,196,047.07. The modification impacts Option Years 1 – 4 of the task order, which have a period of performance of 18 Apr 15 – 17 Apr 19, if all options are exercised. The total cost of the task order will increase by $2,196,047.07 from $4,928,671.10 to $7,124,718.17. The task order is funded with Operations and Maintenance funds.
3. DESCRIPTION OF SUPPLIES/SERVICES: This task order provides contractor support personnel and technical competencies to assist with the operational maintenance of DISANet services for DISA. Specifically, the contractor provides dedicated 24x7 DISANet Tier I and II support which ensure immediate resolution of DISANet and other IT incidents impacting operations. The scope of the task order also includes network system administration, incident and problem troubleshooting and resolution, service desk end-user support services, hardware and software installation and support, and a variety of related technical network and customer support activities. Access to DISANet services and access from DISANet end-client systems and the DISANet infrastructure to DCC mission systems is a critical factor in the success of the DCC and JFHQ in carrying out their operational responsibilities. The support provided under this task order and the proposed modification will ensure that a high-level of access to the required information technology (IT) services is maintained for the DCC Watch Center, JFHQ working areas and other DCC personnel.
4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE
PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE
ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY:
(a) Exception to Fair Opportunity. FAR 16.505(b)(2)(i)(C) - The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract and all awardees were given a fair opportunity to be considered for the original order.
(b) Description of the Justification. In support DoD’s focus on cyber operations and mission assurance and in concert with USCYBERCOM, DISA has worked to develop the JFHQ – Department of Defense Information Network (DODIN). JFHQ is responsible for the command and control, planning, directing, coordination, integration, and synchronization of DODIN Operations and Defensive Cyber Operations-Intrusion Detection Management DCO-IDM in order to secure, operate, defend and protect the DODIN in support of DoD, Combatant Command, Service and Agency missions. Due to the mission critical nature of the DCC and JFHQ DODIN missions, there is a requirement for 24x7x365 IT Tier I and II TS-SCI cleared support personnel to provide IT incident response within five (5) minutes and resolution within twenty (20) minutes of notification. This response time is driven by the DISA Director's notification time limits for critical operational and organizational incidents. The DCC and JFHQ Watch Center are located at the DISA Headquarters installation at Fort Meade, MD. The proposed modification will provide additional support for the newly established JFHQ-DODIN mission.
(c) Justification.
(1) Minimum Government requirements. The purpose of this requirement is to provide quality management of major portions of the DISA Information System (DISA-IS) Infrastructure in support of the DISA enterprise. Other support includes:
• Providing 24x7 desk-side user support and operational support to DCC personnel and JFHQ DODIN working areas for the unclassified and Secret-High DISANet mission networks infrastructure, server, and end-user devices located in the DCC Watch Center.
• Providing maintenance of DISANet infrastructure at DISA’s Emergency Relocation
Sites (Classified) and providing system administration of the DISANet infrastructure at the place of performance.
(2) Proposed Sole Source Contractor. The proposed contractor is HighAction, LLC. The contractor's performance on the existing task order has been satisfactory or better in all areas. Deliverables have been provided on schedule. Contractor management has addressed and resolved the issues or potential issues in an expedient manner.
HighAction, LLC staff is already trained on DCC operations and they have the infrastructure in place to support mission critical operations of the DCC and JFHQ.
Awarding this additional work to another contractor would result in a duplication of costs of approximately $3,000,000.00 associated with the competition of the JFHQ requirement, which is essentially the same as the work currently performed under the existing task order supporting the DCC, additional training, obtaining clearances, and additional resources to get another contractor operational. These duplicative costs are not anticipated to be recouped via competition. Recompeting these services would take three (3) to six (6) months which will leave JFHQ without any Tier I and Tier II support during this time, thus resulting in mission failure.
(3) Discussion Regarding Cause of the Sole Source Situation. The newly formed JFHQ requires highly specialized contractor personnel to support their mission. The support required by JFHQ is essentially the same support currently provided to the DCC by HighAction, LLC under task order HC1047-13-D-4001-0003. The required support cannot be provided by the Government resources due to the level of expertise, scope of the work, and the 24x7x365 nature of the requirement. It is in the Government's best interest to maintain continuity across the DCC and JFHQ by retaining the current level of support provided by HighAction, LLC, for the term of the contract period of performance.
(4) Demonstration of Unique Source. As stated in paragraph 4(c)(2), the proposed contractor, HighAction LLC, is already performing Tier I and Tier II support for DISA DCC. HighAction, LLC possess all knowledge, skills, abilities and clearances required to complete all tasks in the existing PWS and are able to meet the requirements of the Government since they are already performing this task. This modification will extend Tier I and Tier II support to a new customer under DCC (i.e., JFHQ). In the interest of economy and efficiency, modifying the existing task order to include JFHQ will save the Government approximately $3,000,000.00 in duplicate costs and prevent a gap of three (3) to six (6) months in mission critical support to the JFHQ.
(5) Procurement Discussion. Considering the mission critical nature of the DCC and
JFHQ missions, a schedule delay of three (3) to six (6) months in providing the required support is not viable. Further, it is anticipated that a recompetition would result in substantial duplication of cost to the Government that would not be recovered through competition. The time required to bring another contractor up to full qualification would adversely impact the mission of both organizations.
(6) Impact. Failure to modify task order HC1047-13-D-4001/0003 to increase the current support will result in the JFHQ DODIN entity working without dedicated 24x7x365 support for Tier I and II with TS-SCI cleared personnel. This support is mission critical to the JFHQ DODIN operation as it provides support 24x7x365 in the event of any IT capabilities failure.
5. COST/PRICE FAIR AND REASONABLE DETERMINATION: The contracting officer will make a determination that prices are fair and reasonable. The contracting officer will determine whether the proposed price is fair and reasonable based upon the comparison of the Independent Government Cost Estimate (IGCE) and the DESS labor rates established in the basic contract. The DESS Labor Category Rates were established as a result of competition and are considered fair and reasonable. Certified Cost and Pricing data will also be used to determine fair and reasonable pricing. A determination will be made that the order presents the best value to the Government and results in the lowest cost alternative to meet the Government’s needs.
6. MARKET RESEARCH: Additional market research in support of the exercise of Option Year 1 on this task order was performed in April 2015 through an informal analysis of published prices. The informal analysis of market rates as compared to similar labor categories and rates under this task order revealed that the rates on the current task order were lower than comparable market rates.
7. ANY OTHER SUPPORTING FACTS: Not applicable.
8. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS
THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY:
The original Task order was competed using Fair Opportunity procedures under the DESS Multiple Award Contract vehicle. Future efforts for similar support will be competed once this task order expires.
(a) Procurement History:
Contract Number: HC1047-13-D-4001-0003 Contractor: High Action LLC Period of Performance: 18 April 2014 – 17 April 2015 with four (4) one-year options Status: Competitive 8(a) Type: Firm-Fixed-Price
(b) Alternative Solutions: Other Government contracts were explored to determine if they presented a viable solution. Currently no other DISA contract besides this task order could fulfill these new requirements in the time frame necessary. DISA fully intends to advertise future/follow-on requirements in a full and open environment.
