Justification and Approval (J&A) for Other Than Full and Open Competition

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The cost of this acquisition will be fair and reasonable. Actions anticipated to ensure reasonableness of the price will be accomplished with the procedures and criteria contained in Federal Acquisition Regulation under Parts 30 - Cost Accounting Standards, and 31 - Contract Cost Principles and Procedures, and Subpart 15.4 - Contract Pricing, as appropriate. Further actions will be under the guidance of the Contract Pricing Reference Guides jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. The AFMC Guide for Price Negotiation Memorandum/Price Competition Memorandum (PNM/PCM) will also be used, as appropriate. Detailed documentation and justification of price reasonableness will be disclosed in the official PNM/PCM, to be prepared upon completion of negotiations.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
A. As described in Section VI above; market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
B. The government posted a Sources Sought to FBO on 3 July, 2019 as DATS6894 to see if any other contractor could perform the requirement as established in the PWS. responded to the Sources Sought. The program team evaluated their response and determined they did not have the software and experience with automated test equipment used to test avionics systems necessary to perform the Government's requirement. No other contractors contacted the government to indicate that they were capable or requested information for the requirement. It was then determined that WesTest is the only company capable of performing this requirement.
WesTest is the only qualified approved source for this effort.
C. Market research conducted included the following: Google & Yahoo Internet research, GSA e-library and working with SME's (Subject Matter Experts) that have some knowledge of this type of service.
D. This effort cannot be accomplished organically, and no other government agency has the software, expertise, or rights to work on the propriety systems. WesTest has sole proprietary of the above mentioned in Section V.
IX. Any other facts supporting the use of Other Than Full and Open Competition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Government will take additional measures to confirm whether the Government has any data rights in the in the TDP and what avenues the Government has for requesting a copy, to include offering to purchase the TDP, if necessary, prior to the execution of each option on the contract. The Government will also update the Market Research annually to effectively identify new businesses that are available in the marketplace that can meet agency requirements.
