Darfur Contracting Act Certification Form - California
This is a compliance certification form issued by the California Department of General Services (DGS) Procurement Division, required for companies seeking to bid on State of California contracts under Public Contract Code Sections 10475-10481. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years. Companies without such international operations within the three-year period are exempt from filing this certification. The form relates to IFB # S26-33386 for Office Moving Services in Greater Los Angeles Districts, which seeks a contractor to provide comprehensive office relocation services including furniture installation, packing, transportation, unpacking, move management, disassembly and reassembly of modular furniture, equipment padding, secure storage, and debris removal. Work may be performed before 7:00 a.m., after 5:00 p.m., and on weekends as needed, with pricing structured on a not-to-exceed basis reflecting the contractor's standard rates.
The certification provides two compliance pathways for eligible bidders: Option 1 requires companies to certify under penalty of perjury that they are not scrutinized companies as defined in Public Contract Code Section 10476, while Option 2 applies to scrutinized companies that have received written permission from the DGS Director to submit proposals on a case-by-case basis when deemed in the state's best interest. All certifications must be executed by authorized company representatives and include the company name, Federal ID Number, authorized signature, and printed name and title of the signatory. The form does not address pricing, set-asides, incumbents, funding sources, or contract duration specifics, as it functions solely as a threshold eligibility document for international business activities compliance.
