About this file
This is a Darfur Contracting Act Certification form required by the State of California's Department of General Services for vendors bidding on state contracts. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years. Bidders on the Commercial Exhaust Hood Fire Suppression System, Preventative Maintenance Service and Repair contract for the Department of Rehabilitation's Business Enterprise Program must certify compliance with California Public Contract Code Sections 10475-10481. The contractor will provide semiannual inspections, testing, recharging, and preventative maintenance for commercial vent hood fire suppression systems, fire extinguishers, and related equipment located across multiple state, federal, county, and privately owned buildings. Services must comply with Fire Department safety codes and include system repairs, fusible link replacement, nozzle cleaning, cylinder hydrostatic testing, and parts replacement. Service delivery is required five days per week between 7:00 a.m. and 5:00 p.m., with coordination needed with the Business Enterprises Consultant and BEP vendors to minimize business interruption. Specific service locations are detailed in Exhibit G and subject to change via contract amendment.
Vendors with international business operations within the previous three years must complete one of two certification options: either certify under penalty of perjury that the company is not a scrutinized company, or submit written permission from the Department of General Services demonstrating that a scrutinized company has been approved on a case-by-case basis. Vendors without international operations during the three-year period are exempt from this requirement. Work requested outside normal hours incurs additional charges at one-and-one-half times the bid rate for before or after-hours work and twice the bid rate for Sunday or official state holiday work, with prior written authorization required from the Department of Rehabilitation's Contract Administrator for all non-standard hours.
