About this file
This document is a Darfur Contracting Act Compliance form from the California Governor's Office of Business & Economic Development (GO-Biz). The form is designed to ensure that companies seeking to contract with the state do not have business activities in Sudan, specifically targeting companies doing business in the Darfur region. Companies must certify their compliance by selecting one of three options: (1) no business outside the United States in the past three years, (2) a scrutinized company with written permission from the Department of General Services, or (3) having business activities outside the US but certifying they are not a scrutinized company.
The form requires companies to complete a certification under penalty of perjury, providing their company name, federal ID number, an authorized signature, printed name and title of the signatory, date of execution, and the county and state of execution. The compliance requirement stems from Public Contract Code sections 10475-10481, which aim to preclude state agencies from contracting with companies that have specified types of business operations in Sudan. Companies found to be scrutinized are generally ineligible to contract with California state agencies unless they obtain specific permission from the Department of General Services.
