About this file

This document is a Darfur Contracting Act Certification form issued by the State of California, specifically addressing Public Contract Code Sections 10475-10481. The certification is mandatory for companies that have conducted business activities outside of the United States within the previous three years and are seeking to bid on or submit a proposal for a state contract. The form provides two options for compliance: Option #1 requires companies to certify they are not a "scrutinized company" under penalty of perjury, while Option #2 allows scrutinized companies to submit a bid if they have obtained written permission from the Department of General Services (DGS) on a case-by-case basis.

The certification aims to ensure that companies bidding on California state contracts have not engaged in business activities that potentially support problematic regimes or actions, specifically in the context of the Darfur region. Companies must provide their company/vendor name, federal ID number, and an authorized signature or initials to complete the form. The document emphasizes that companies with no international business activities in the past three years are exempt from completing the certification. The form is designed to be a legally binding document executed under California state laws, with provisions for companies to demonstrate their compliance or seek special permission to bid on state contracts.
