About this file

This is a Darfur Contracting Act certification document issued by the California Department of General Services (DGS) Procurement Division for use with State of California contracts. The document applies to companies that have conducted business activities or operations outside the United States within the previous three years. Eligible bidders must complete one of two certification options: either certify that they are not a scrutinized company under Public Contract Code Section 10476, or provide written permission from the DGS Director authorizing a scrutinized company to submit a bid or proposal on a case-by-case basis when deemed in the best interest of the state. The certification requirement is mandatory for bidders with international business operations seeking to compete for state contracts, and the form must be completed with the company name, Federal ID Number, and authorized signature.

This certification form (DGS PD 1, Revised 12/19) is a compliance document rather than a standalone solicitation. It serves as an attachment requirement for state contract opportunities, as evidenced by its inclusion in the IFB S25-33165 for vending machine revenue services in Crescent City and Eureka. Bidders must determine their eligibility status under the Darfur Contracting Act and complete the appropriate certification option before submitting their bid. Failure to comply with this certification requirement will result in a non-responsive bid, regardless of other qualifications or pricing submitted.
