About this file
This is a certification form issued by the Department of General Services Procurement Division for the State of California regarding compliance with the Darfur Contracting Act under Public Contract Code Sections 10475-10481. The document applies to any company that has conducted business activities or operations outside the United States within the previous three years and seeks to bid on or submit proposals for State of California contracts. Companies without international business activities during this period are exempt from this requirement. The certification process offers two options for eligible bidders: companies may certify that they are not scrutinized companies as defined under Public Contract Code Section 10476, or they may demonstrate that they have received written permission from the Department of General Services to submit a proposal despite being classified as a scrutinized company.
The form requires authorized company representatives to complete relevant sections with the company name, Federal ID Number, and authorized signature under penalty of perjury. For Option 1, bidders must certify non-scrutinized status and confirm the signatory's authority to legally bind the company. For Option 2, scrutinized companies must provide a copy of written permission from the Department of General Services Director, which may be granted on a case-by-case basis if deemed in the best interests of the state. This certification form (DGS PD 1, Rev. 12/19) constitutes a mandatory compliance requirement for all applicable bidders on State of California contracts.
