About this file
This is a Darfur Contracting Act Certification form required by the State of California pursuant to Public Contract Code section 10478. The form applies to bidders or proposers with business activities or operations outside the United States within the previous three years. Bidders must certify their compliance status by selecting one of three options: confirming no international business operations, disclosing scrutinized company status with written permission from the Department of General Services, or certifying international operations while confirming non-scrutinized status. The form requires the company name, Federal ID Number, and authorization from an official empowered to legally bind the prospective bidder.
The certification must be completed and submitted with the bid or proposal to establish eligibility. For bidders selecting option three, an authorized representative must execute the certification under penalty of perjury, providing their printed name, title, signature, and the county and state where the certification is executed. This compliance requirement applies to all state and local contracts in California and serves to ensure bidders meet regulatory standards regarding international business operations and scrutinized company designations as defined in Public Contract Code section 10476.
