About this file

This is a Schedule B Insurance provision from a federal real property lease agreement (DACA095260083000) that specifies insurance requirements for the lessor.

The lessor must maintain public liability and property damage insurance with a combined liability limit of at least $1,000,000 and property damage limits of not less than $500,000. Coverage must protect against all liability arising from the leased premises or the real property containing it, with both the lessor and government named as additional insureds and cross-liability endorsements included. Additionally, the lessor must maintain fire and extended coverage insurance (including vandalism and malicious mischief endorsements) on the building and improvements at full replacement value, with all costs borne by the lessor. The provision clarifies that the Federal Government does not carry liability insurance and is self-insured under 28 U.S.C. Section 1346, which permits individuals injured or suffering property damage due to Government employee negligence to file claims. Claims are initially processed by the U.S. Army for administrative decision, with appellate rights to the U.S. Federal District Court or U.S. Claims Court available following final agency determination.

Government through the U.S. Army for an administrative decision. Once a final decision by our agency is made, you have the statutory right to appeal that administrative decision to the US Federal
