About this file

This document is a Sole Source Documentation under FAR Part 13 for a purchase order over $10,000 but not exceeding $250,000. The Drug Enforcement Administration (DEA) intends to award a sole source purchase order to New Tech Solutions, Inc. for a renewal of Technology Business Management (TBM) services. The key justification is that the ServiceNow platform, which is a commercial item, has evolved through partnerships and enhancements to address specific DEA requirements related to IT portfolio management, budget and financial management, and alignment with DEA mission needs. The DEA has determined that only New Tech Solutions, Inc. can reasonably provide the required services. The estimated value of the purchase order is $132,000 for a period of performance from 09/01/2024 to 08/31/2025. A determination of fair and reasonable pricing will be made prior to award.

SOLE SOURCE DOCUMENTATION

FAR PART 13

Purchase Orders Over $10,000 but not Exceeding $250,000

Acquisitions that do not allow for competition to the maximum extent practicable must be documented in accordance with Federal Acquisition Regulations (FAR). A Limited Sources Justification is required when soliciting fewer than three sources per FAR 13.104, or when using brand name descriptions per FAR 13.106-1(b)(1). A Limited Sources Justification is not required for brand name or equal procurements. Follow procedures at FAR PART 11.104.

Type of action: sole source acquisition brand-name

DAC Number: D-24-TC-0199 Estimated total mount:

132000

Recurring Requirement: YES NO

Delivery Date: 08/31/2024 Period of Performance: 09/01/2024 – 08/31/2025

Brief description of supplies or services required and the intended use:

ServiceNow is a commerical item. It is a product that is available and licensed to the general public. The ServiceNow platform has evolved through advances in technology and performance under partnerships with other vendors and members of industry by offering enhancements to address specific needs and requirements. These enhancements now are available in the commercial marketplace in order to satisfy the delivery requirements under a government solicitation. These partnerships are based on the implementation of the Technology Business Management (TBM) framework developed by TBM Council in collaboration with U.S. Federal Government leaders. The implementation of the TBM framework and its linkage to budget and financial management is sought with the implementation of ServiceNow modules. This procurement will lead to the purchase of services necessary to analyze, architect, design, implement, integrate, test, and deploy the software into the DEA production environment that is operating the ServiceNow platform.

Summary of the facts and circumstances that support the determination that only one source is reasonably available to supply the required supplies or services, or only the specified brand-name items can satisfy the Government’s need:

The key area of Cost (Financial) and Acqusition Management is tied directly to the management of the DEA IT portfolio. The management of the IT portfolio is a Chief Information Officer (CIO) responsibility under the DEA Information Technology Investment Review Process. This responsibility triggered assurance by the agency for execution of the “Common Baseline for IT Management and CIO Assignment Plan” from M 15 14, as implemented by DEA, to meet the objectives of the Department of Justice (DOJ) Policy Memo 2019-01. This key area also integrates with data calls from the DEA parent agency, DOJ, and would drive efficiency improvements by as much as 85% in collecting, consolidating and analyzing, reviewing and approving, and finally submitting the requested information to the DOJ. Thus, this proposed procurement would automate processes to increase the accuracy and efficiency of duties and responsibilities for managing the DEA IT portfolio. The downstream impact of TBM for SN is ensuring alignment of IT investments with evolving DEA mission requirements.

Describe in detail any market research conducted. Include results and state whether any vendors expressed interest:

This is a follow on Sole Source requirement and therefore additional Market Research was not conducted.

The Contracting Officer hereby determines that, due to the circumstances of this procurement:

Only one source is deemed to be reasonably available.

Only the specified brand-name item will satisfy the Government’s need. For orders exceeding $25,000, this Limited Source Justification shall be made available together with the solicitation and posted on the Contract Opportunities page on the Governmentwide Point of Entry (SAM.gov) in accordance with FAR 5.101(a)(1).

The Contracting Officer certifies that an order for the supplies or services will not be placed unless the price is found to be fair and reasonable.
