LIMITED SOURCE JUSTIFICATION
Revised 12/7/2017
1. Identification of the agency and the contracting activity, and specific identification of the document as a "Limited Source Justification."
Contracting Activity Processing the Requirement: Office of Acquisition and Relocation Management
Name of Organization Originating the Requirement: Drug Enforcement Administration
Identification Number (purchase request/solicitation number): TBD
2. The nature and/or description of the action being approved.
The Drug Enforcement Administration intends to establish a bridge contract vehicle to continue the Special Agent Promotion Program currently being fulfilled under contract DJD-12-HQ-G-0206 with PDRI.
3. A description of the supplies or services required to meet the agency's needs and estimated value.
The Drug Enforcement Administration, Office of Human Resources (HRN) requires continued services for the Special Agent Promotion Program.
In 1981, the United States District Court for the District of Columbia ordered DEA, in part, to implement valid, nondiscriminatory promotion systems for Special Agents. See Segar v. Civiletti, 508 F. Supp. 690 (D.D.C. 1981); aff’d in relevant part, sub nom Segar v. Smith, 738 F.2d 1249 (D.C. Cir. 1984). After conducting validity studies, DEA implemented a valid, non-discriminatory mechanism for distinguishing among candidates for promotion to positions at the GS-14 and GS-15 levels.
DEA utilizes a Special Agent Promotion Program (SAPP) to determine the eligibility of Special Agents (Criminal Investigators), GS-1811, for promotion to GS-14 and GS-15.
Total estimated value inclusive of all options: $211,237.00
Period of performance or final delivery date: 3/4/2018-8/3/2018
4. Identification of the justification rationale (see 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are uniquely or highly specialized. This requirement takes place in one year cycles. The current contract is extended until 3/3/2018, and awarding it to another vendor at this time would cause a break in service. A new 5 year contract will be competed through GSA HCATS with an anticipated award date of 8/4/2018.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).
The price quoted was based on current pricing under exisiting contract. The new requirement has already received a scope review from GSA HCATS and has been determined to meet the requirements.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
An RFI was posted via GSA HCATS and responses were received and reviewed.
7. Any other facts supporting the justification.
N/A
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
This bridge contract is being awarded to prevent a disruption to the Special Agent Promotion Program that is currently taking place. A new contract will be competed via GSA HCATS. Based on market research the government anticipates fair and reasonable pricing based on competition.
