This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. This acquisition is set aside 100% for Small Businesses. The applicable NAICS code is 561210 – Facilities Support Services with a size standard of $47M. This Request for Quotation (RFQ) and subsequent order are set-aside exclusively for only those authorized Small Businesses. Quotes from other than these vendors will not be considered. See FAR 52.212-1 and 52.212-2 Addendums of this solicitation for detailed information regarding submission of quotes.
52.212-1 ADDENDUM: INSTRUCTION TO QUOTERS
GENERAL INTENTION. Marine Corps Installations – National Capital Region (MCI-NCR) has a requirement to procure Full System Dryer Duct Cleaning and Indoor Air Quality Testing. This requirement is in accordance with FAR Part 12 and 13. Required specifications are listed in the Schedule of Supplies/Services within this solicitation.

PROCUREMENT APPROACH: The Contractor’s quoted item descriptions shall reflect the characteristics and level of quality that will satisfy the Government’s need as described in the Schedule of Supplies/Services. A single firm-fixed price contract/purchase order will be issued, and it is the Government’s intent to award on an “all-or-none” basis to satisfy this requirement.
NOTICE OF SCHEDULED SITE VISIT: Offerors are encouraged to attend a site visit, which is scheduled for Monday, 10 July 2023, starting at 10:00 AM EST. Parties desiring to participate in the site visit must contact Kevin Guertin via e-mail at kevin.guertin@usmc.mil indicating the company name, point of contact, telephone number, and number of persons attending by 11:00 AM EST, 8 July 2023. PAYMENT TERMS: NET 30. Invoices must be submitted via the Wide Area Workflow (WAWF) in accordance with DFARS 252.232-7006 which is included in this solicitation.
REQUIRED DELIVERY/PERIOD OF PERFORMANCE: The Government requires a base period, with provisions for four (4) option periods. The base period of performance shall start on 1 August 2023 or date of award, whichever is later, and run through 10 September 2023. If all Options are exercised (at the discretion of the Government), the period of performance will be broken down as follows:

The Government intends to make a single award Firm Fixed Price (FFP) award with FFP CLINs for one (1) base period, plus four (4), option periods, to be exercised at the discretion of the Government (see FAR 52.217-9, Option to Extend the Term of the Contract). The Government makes no guarantee that the option periods will be exercised.
It will be the Government’s unilateral right to exercise any option periods providing that the Notice of Intent is provided to the contractor within the time specified in FAR 52.217-7 of the contract and, once option periods are exercised; the Contractor is required to perform the work when ordered during the scheduled period of performance of the award. The initial base period shall begin on 1 August 2023 or date of award, whichever is later, and run through 10 September 2023
Note: Vendor will not be paid in advance for the four (4) Option Periods. Due to fiscal law, the Government is prohibited from paying in advance and obligating for more than 12 months. As a result, the Option periods are not guaranteed, and the Government may choose not to exercise the Options for any reason. Additionally, the established prices at award cannot be changed post-award. The successful quoter will not be able to request an increase to price after award has been made. If quoters have identified that the manufacturer will not allow resellers to quote Options, quoters shall notify the contract specialist immediately during the solicitation phase, so that an Amendment may be issued removing the Option Periods.
TECHNICAL COMPLIANCE: To ensure technical compliance:
a. The quoter must clearly demonstrate that they can meet the solicitation requirements (quoters must provide product literature demonstrating it meets all of the required specifications listed in the solicitation). A mere statement that the quoter will meet the Government’s requirement is NOT sufficient.
b. Clearly state whether the quoter can meet the required Delivery Date. Vendors who cannot meet the required Period of Performance will not be considered technically acceptable.
c. Quoter shall provide other than certified pricing data to assist the Government on determination of prices to be fair and reasonable such as a public price list. Quoter may also provide historical contracts to use to assist Government on price analysis
d. Quoters shall provide certificates showing their firm can meet or exceed the following standards:
1. NADCA ACR 2021 “Assessment Cleaning and Restoration of HVAC Systems, 2021 edition”.
2. ANSI IICRC S520 “Standard for Professional Mold Remediation”
3. Contractor shall always have a NADCA certified Air Systems Cleaning Specialists (ASCS) at the job site.
SUBMISSION OF QUOTES. Quotes shall be submitted electronically via electronic mail (e-mail) to Kevin Guertin at kevin.guertin@usmc.mil no later than 10:00 AM EST, 18 July 2023. Vendors are responsible for ensuring their quotes have been received via email by the date and time specified above. Delivery delays that cause a quote to be late are not the responsibility of the Government agency.
Quoters shall provide their full vendor’s name and any doing business as names as certified in the mandatory System for Awards Management at www.sam.gov. Quotes shall also include a vendor point of contact information (name, phone, and email), Cage Code, and Tax ID (TIN/EIN) number.
CONFIDENTIAL INFORMATION: The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contract qualifications and quotes/proposals submitted to federal agencies. If a Quoter’s submissions contain information that he/she believes should be withheld from such requestors under FOIA on the grounds that they contain “trade secrets and commercial or financial information” (5 USC 552(b)(4)), the Quoter should mark its submissions in the following manner:

52.212-2 ADDENDUM: EVALUATION – COMMERCIAL ITEMS
EVALUATION. Award will be made on the basis of price and other factors per FAR 13.106-1(a)(2). The Government intends to make a single Firm Fixed Price order to satisfy this requirement. The Government reserves the right to award no contract at all, depending on the quality of offers submitted. The Government intends to evaluate quotes and award a contract without discussions with vendors. Vendors should not expect requests for clarification or additional information from the Government. Award will be based on the initial evaluation of quotes received in response to the solicitation. Therefore, quoters are cautioned that their initial quotes should contain their best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions with vendors if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; and may waive informalities and minor irregularities in quotes received.
The following ratings/definitions will be utilized:
RATING DEFINITION
Acceptable Quote meets the requirements of the solicitation.
Unacceptable Quote does not meet the requirements of the solicitation.
In accordance with DFARS Subpart 204.76, the Contracting Officer will consider the risk assessments generated by the Supplier Performance Risk System (SPRS), if available, as part of the award decision. The apparent successful, prospective contractor shall have satisfactory past performance. The Government may use information such as Contractor Performance Assessment Reporting System (CPARS) and the FAPIIS data available from Government sources to evaluate a Quoter's past performance.
PRICING. Quoters shall provide pricing for the required specifications, material, hardware, and connections for the procurement of required Full System Dryer Duct Cleaning and Indoor Air Quality Testing to include all equipment and supplies necessary to complete all services as listed and described in the Schedule of Supplies/Services within this solicitation and Performance Work Statement. The Government intends to make a single award Firm Fixed Price (FFP) purchase order with FFP CLINs.
The price quote should avoid ambiguities of inclusion, exclusion, or content.
The Government will evaluate Quoter’s quoted prices, but this factor will not be given an adjectival rating. Quotes will be evaluated on completeness, accuracy, and reasonableness. Evaluation of the quoted prices for the services will be based on a comparison of quoted prices received in response to the solicitation and may also be based on a comparison to the Independent Government Cost Estimate (IGCE) along with any other relevant price analysis techniques as appropriate.
Reasonableness. For the price to be reasonable in its nature and amount, it should not exceed that which would be incurred by a prudent person in the conduct of a competitive business. Reasonableness takes into account the context of a given source selection, including current market conditions, general economic conditions, and other factors that affect the ability of a Quoter to perform the contract requirements. Normally, adequate price competition establishes a fair and reasonable price.
Completeness and Accuracy. The Government will review the pricing tables for completeness and accuracy. A determination will be made as to whether the Quoter properly completed the pricing tables. The Quoter’s quote will be checked for mathematical correctness to include the following:
1) Checking arithmetic in all computations; and
2) Ensuring all prices are summarized correctly
3) Pricing shall not exceed two decimal places for cents.

PERFORMANCE WORK STATEMENT (PWS)
for Officer Candidates School
Full System Dryer Duct Cleaning and Indoor Air Quality Testing (Buildings 5001 and 5002)
Marine Corps Base, Quantico, Virginia
1.0 Background: Officer Candidates School is a premier training institution to train, screen, and evaluate potential future officers in the United States Marine Corps. Candidates are housed in two three-story barracks (buildings 5001 and 5002) each comprised of 12 squad bays. Each Squad Bay is equipped with a shower room, restroom, mudroom, and laundry room consisting of three residential style washers and three dryers. These 12-squad vent dryer exhaust through internal dryer ducts to one of two main exhaust fan blowers located in the attic and out of the building through louvers in the attic. Additionally, each floor has a center quarterdeck consisting of a main passageway, seven offices, and a bathroom/shower room. Due to the constant use of these buildings and limited facilities support, these facilities frequently suffer from high humidity, internal plumbing leaks, and excessive HVAC condensation resulting in the potential for substandard air quality.
1.1 Scope: Office Candidate School requires a Full System Dryer Duct Cleaning and Indoor Air Quality Testing for bio and chemical contaminants of buildings. The service shall be conducted between 1 August 2023 to 10 September 2023. These buildings are Officer Candidate barracks that support 3,600 officer candidates annually.
Service is critical to sustain functional airflow, promote sustainable hygiene, reduce fire hazard risks, and identify harmful airborne pollutants so that remediations can be planned and executed. Air samples need to be taken throughout each building and compared to controlled air sample taken outside on the same day. Testing of air samples are required to be performed by a board-certified Indoor Environmentalist or a certified Industrial Hygienist.
2.0 Contractor Tasks (per building)
2.1. The Contractor shall provide all labor, material, equipment, transportation, and supervision necessary to perform a full dryer vent duct cleaning and air quality testing in each building during the specified service windows.
2.2. The Contractor shall perform all work as necessary to complete in a satisfactory and acceptable manner and adhere to all applicable federal, state, and local regulations and laws.
2.3. Before commencing work, the Contractor shall inspect the dryer exhaust system for preexisting damage and provide a pre-inspection report identifying all existing damage to the Technical Point of Contact (TPOC).
2.4. After each building has been completed, the Contractor shall provide a detailed Contractors report of services performed consisting of a post service inspection (with pictures) of system components requiring additional/specialized service, outdated PM tags, applicable technician notes, indicators of habitual PM/CM concerns/negligence identified, and recommendations for remediation.
2.5 Service Schedule: Due to the repetitive use and high occupancy of these facilities, the Contractor shall provide the specified services during the service windows specified in Table 1 below.

a. A schedule for each specified service shall be developed by the Contractor and submitted to the TPOC
No Later Than (NLT) 30 days before each specified service window.
b. Any Contractor deviation from the approved schedule shall be requested in writing to the TPOC.
c. Final service schedule will be approved by the TPOC to ensure service does not interfere with active training. The Government reserves the right to shift services as necessary to meet operational demands so long as the Contractor can meet the new service window approved by the Contracting Officer.
3.0 Specific Tasks:
3.1. Clean Dryer Exhaust Conveyance Systems
3.1.1. The Contractor shall complete the following actions (Per Building):
a. Cleaning of (36) 4” dryer exhaust vent ports.
b. Clean of all horizontal dryer exhaust ducting.
c. Clean of all vertical dryer exhaust ducting.
d. Cleaning, inspection, and preventative maintenance of (2) dryer exhaust manifolds to include (2) industrial exhaust blower motors in each attic, and exhaust louvers.
e. Cleaning of all dust, lint, and debris in (12) laundry rooms following exhaust vent port cleaning.
f. Replace all damaged and/or missing wall mounted exhaust ports.
g. Ensure all wall mounted galvanized exhaust ports are secured to the wall inlet.
h. Ensure all wall mounted galvanized exhaust ports are secured to mating ducting and sealed to prevent air leaks.
i. Seal all minor dryer exhaust duct leaks.
j. Clean interior and exterior of each exit louver and damper that connect to outside air to include leaves, debris, lint, and material caught on the exterior mesh screen.
3.2. Indoor Air Quality and Contamination Sample Testing
3.2.1. The Contractor shall complete the following actions (Per Bldg.):
a. Conduct air sample tests to cover (12) squad bays, (12) squad bay offices, (12) laundry rooms, (15) bathrooms, (3) hallways, (12) center offices, and (3) samples of the attic space.
b. Conduct Test. Test shall be performed by a Board-Certified Indoor Environmentalist or a certified Industrial Hygienist.
c. Test Sample. Samples shall be tested in a certified Laboratory for the following compounds:
1. Air Particulate Matter
2. Carbon Dioxide
3. Carbon Monoxide
4. Ozone
5. Mold
6. Total Volatile Organic Compounds (TVOCs) -, TVOC is a standard test that measures the overall total volume of VOCs off gassing in a given area vice testing for each specific VOC.
"Volatile organic compounds (VOCs) are emitted as gases from certain solids or liquids and include a variety of chemicals, such as acetone and ethanol, some of which may have short and long-term adverse health effects and are strongly linked with thousands of products used indoors. These include paints, varnishes, cleaners, disinfectants, cosmetics, degreasers, and hobby products. Currently, there are no federally enforceable standards set for VOCs in non-industrial settings. However, the latest Leadership in Energy and Environmental Design (LEED) guidance specifies that the maximum allowed concentration of TVOCs measured in a building (post construction, pre-occupancy) is 500 µg/m3. For any indoor environment, TVOC levels below 500 µg/m3 are characterized as “Good” or “Ideal” and levels above 3000 µg/m3 are characterized as “High,” “Elevated,” or “Hazardous.” Values between 500 and 3000 µg/m3 are not well characterized but can be deemed “marginally elevated” or “above ideal” according to the LEED standard interpretation."
d. Submit a Report. Provide a report of findings containing the following information: scanned results from a certified laboratory, laboratory result commentary, inspector notes, quality control measures taken, a Health Risk Assessment Code (HRAC) for each sampling area, a HRAC for the totality of the building, and recommendations to further improve the indoor air quality of the building.
3.2.2. General Information for each Building (Bldg. 5001 and Bldg. 5002):
a. Each building has three (3) floors, each floor is approximately 19,832 square feet.
b. Each floor has four (4) squad bays, each bay is approximately 3,478 square feet.
c. Each floor has one (1) center wing, each center wing is approximately 5,920 square feet.
3.3 Mandatory Performance Standards.
3.3.1. The Contractor shall perform all services meeting or exceeding the following standards:
a. NADCA ACR 2021 “Assessment Cleaning and Restoration of HVAC Systems, 2021 edition”.
b. ANSI IICRC S520 “Standard for Professional Mold Remediation”
c. Contractor shall always have a NADCA certified Air Systems Cleaning Specialists (ASCS) at the job site.
3.4 Mandatory Contractor Qualifications.
3.4.1. The Contractor shall maintain up-to-date certification for the following qualifications:
a. Board Certified Indoor Environmentalist or certified Industrial Hygienist by the Commonwealth of VA.
b. NADCA certified Air Systems Cleaning Specialist.
c. Contractor shall be a NADCA certified Company.
3.5 Base Access:
3.5.1. Base/Facility access: All Contractor personnel entering OCS must have pre-registered in DBIDs prior to arriving to Base at the following website: http://dbids-global.dmdc.mil/enroll#!/. Print out the registration confirmation or write down the alpha numeric (QR) code and bring it to the Visitor Control Center on the day work starts and the kickoff meeting. The Government is not responsible for any delays due to issues with base access at the Visitor Control Center.
3.5.2. Pre-Service Survey. Before start of each specified service, the Contractor shall perform a site survey with an authorized government representative and the TPOC to document existing deficiencies prior to the start of work.
3.5.3. The contractor will provide a written work plan including work scheduling, activity hazardous analysis (AHA) for the project and an accident prevention plan (APP) as per the current version of the safety and health requirements manual (EM 385-1-1)
3.6 Prosecution:
3.6.1. Service Windows. The Contractor shall be required to commence work during each buildings required service window; ONLY the Contracting Officer has authority to approve requests for deviations.
3.6.2. The Contractor shall be complete no later than the last day of each specified service window. No later than 30 days before commencing each specified service, the Contractor shall supply a schedule that entails all phases of this task order to include start dates and completion dates.
NOTE: Safety shall be a high priority as normal government operations in and around this facility may continue during each service window.
3.6.3. During the prosecution phase, The Contractor shall coordinate directly with the TPOC for all matters, concerns, and updates.
3.7 Completion:
3.7.1. The Contractor shall provide five (5) calendar days to arrange final inspection following completion of each specified service.
3.7.2. After each specified service, the contractor shall remove all debris and materials daily and prior to the final walk-through inspection with the TPOC.
4.0 Kick-Off Meeting
4.1 A kickoff meeting will be held no earlier than 1 August 2023. The meeting will be held at 2189 Elrod Road, Quantico, VA 22134. The meeting will be with key client agency representatives from all parties to ensure a common understanding of the requirements, what the expectations are, and ultimate end products/desired outcome.
4.2 The Contractor shall discuss the overall understanding of the project and review the background information and materials provided by the client (hereafter the Government). Discussions will also include the scope of work, deliverables to be produced, how the efforts will be organized, and project conducted assumptions made/expected and results. A concerted effort shall be made to gain a thorough understanding of the client agency expectations.
However, nothing discussed in this or discussions between the client and the Contractor shall be construed as adding, deleting, or modifying any task order requirements, including deliverable specifications and due dates.
5.0 Contract Management.
5.1 The Contractor shall perform all stated requirements and tasks contained in this PWS. If any of the requirements or tasks cannot be completed in the time specified, the Government must be notified in writing.
5.2 The Contractor shall provide an onsite supervisor for oversight of all requirements.
6.0 Acceptance Criteria and Testing.
6.1 Upon project completion notification from the Contractor, a Government Quality Assurance (QA) person will test all equipment installations for operation and compliance with the design package.
6.2 All deliverables identified in this PWS must be provided to and accepted by the Government prior to final acceptance. The work area will be inspected for workmanship, completeness, and cleanliness. All work must meet identified performance standards.
6.3 Test and Acceptance. The Contractor shall test each machine’s ability to exhaust through the vents and demonstrate to the Government the complete functionality of all components/capabilities. Delivery and installation must be coordinated with the below TPOC.

7.0 Contractor Furnished Items and Responsibilities
7.1 Material. The Contractor shall provide all transportation, materials, tools, workforce, and all other needed supplies for successfully completion of the requirements/tasks and identified performance criteria within this PWS.
All products and materials developed, prepared and/or purchased by the Contractor for the use or ownership of the Government becomes the property of the Government.
7.2 Equipment. The Contractor shall ensure all components are compatible with Government provided infrastructure. The equipment shall have all the characteristics and functionality described in this PWS. The Contractor shall provide all necessary equipment and tools required to support this requirement to include non-marking, rubber-wheeled hand trucks, dollies, and carts. The Contractor shall be responsible for securing all their equipment, materials and supplies, and tools. The Government will not be liable for any stolen or damaged property that is left unsecured by the Contractor.
7.3 Removal and Disposal of Parts and Material. The Contractor shall clean-up and dispose of all refuse materials and trash in accordance with this PWS and applicable federal, state, and local regulations, standards, codes, and laws. The Contractor shall keep the job site clean, including the staging and storage areas, and free from an accumulation of debris, packing materials and scraps. All project related trash must be removed daily to deter and eliminate potential fire or safety hazards. The Contractor shall pay any fees or charges incurred for disposal of materials.
8.0 Contractor Personnel.
8.1 The Contractor shall identify an onsite supervisor who shall be responsible for the performance of the work for each task. The name of the onsite supervisor and alternate(s), who shall act on behalf of the Contractor when the onsite supervisor is absent, shall be designated in writing and submitted to the Contracting Officer prior to actual work performance start date.
8.2 The Contractor shall utilize precautionary measures (runners, pads, etc.) to protect the building ceilings, walls, floors, doorjambs, equipment, etc. from damage during all phases of the project. The Contractor shall be responsible for any damage to the building and equipment, which occurs because of contractor employee workmanship, material delivery, handling, and workstation disassembly/assembly. The Contractor shall identify any existing damage to the building during any pre-work visit and initial walk-through inspection. The Government Technical Representative will conduct a post vent cleaning and air quality testing inspection to ensure any incidental damages are documented for Contractor resolution.
8.2 The Contractor shall ensure all personnel who are assigned to this PWS meet the minimum requirements as specified in this PWS.
9.0 Government Personnel.
9.1 Contracting Officer (CO).
The Contracting Officer is the only person who has authority to enter, administer, modify and/or terminate a contract.
9.2 Technical Point of Contact (TPOC).
The Technical Point of Contact is responsible for all technical aspects of the requirement. The TPOC will provide guidance to the Contractor to ensure their performance in accordance with the PWS.
10. Deliverables
10.1 The Contractor shall provide the following deliverables to the TPOC for review using best commercial practices for quality by the requested due dates.
11. Place of Performance.
11.1. This work will be performed onboard Marine Corps Base (MCB) Quantico, Virginia, 22134.
12. Working Hours.
All work will be performed between 0700 and 1700, Monday thru Friday. No work may occur on the following Federal holidays.

13. Security.
13.1 Only U.S. Citizens may perform on this PWS. The work will be performed in secure area(s) and only U.S.
citizens are allowed to work within these spaces.
14. Engineering Drawings.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision- Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--
It [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known).
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (DEC 2022) ALTERNATE I (OCT 2014)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision -- "Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest-level owner.

"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
"Inverted domestic corporation" means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
"Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
"Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor.
"Reasonable inquiry" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
"Sensitive technology"--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C.
1702(b)(3)).
"Service-disabled veteran-owned small business concern"--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
