FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval
1. Contracting Activity: The contracting activity responsible for this action is the U.S.
Army Medical Research Acquisition Activity (USAMRAA), Service Branch 1, 820 Chandlers Street, Fort Detrick, MD.
2. Description of Action: WRAIR and the Armed Forces Institute of Medical Sciences (AFIRMS) requests a firm-fixed price contract with Royal Thai Army (RTA). The Government projects award for September 2020 and Fiscal Year 2020, Operations and Maintenance (O&M) funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The purpose of this effort is non-personal support services to conduct surveillance emerging infectious diseases. The disease surveillance include but not limited to diarrheal diseases, influenza, multi-drug resistant organisms and vector-borne diseases. Contractor surveillance project support includes field site support, study coordination, laboratory, sample collections, documentation, administration, reporting, budget management, travel, database management, and other information systems management support and technical support as required under the auspices of the USAMD AFRIMS.

4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:

5. Reason for Authority Cited: Surveillance work occurs in areas of Thailand where the RTA is the only entity with security clearance and access to military controlled areas including border areas. Additionally, RTA medical personnel provide the health care to military and civilians in these secured zones.
RAIR/AFRIMS does not have any in-house technical personnel with access and authority to access the surveillance area to execute the tasks required. The only known source to meet the requirement is Royal Thai Army.
6. Efforts to Obtain Competition: Contracting Officer shall publish the notices required by FAR 5.201. A Request for Information (RFI) was posted on “Contracting Opportunities” on www.beta.SAM.gov on 10 Jun 2020. Four responses were received to this RFI by the time it expired on 25 Jun 2020. A review of the capabilities statements found that three offer demonstrated capabilities and knowledge in managing research programs Outside the Continental United States (OCONUS), one didn’t demonstrate relevant capabilities. However each offeror that respond did not have authority or security clearance and access to military controlled areas and existing relationship with the NAF and MoPH. Therefore the RTA is the only source that can meet this requirement.
7. Actions to Increase Competition: Competition of the requirement is not possible since the propose contractor, RTA is the only source that security clearance and access to military controlled areas including border areas. In addition the RTA has an existing relationship with the NAF and MoPH for the surveillance work in Nepal.
8. Market Research: Market Research was conducted initially on 26 April 2020 and additional research on 16 July 2020 based on historical contract data and an internet search. The results of the market research indicates that the Royal Thai Army (RTA) is the only identified source that can meet the Government’s needs. USAMRAA did a RFI on beta.SAM for source sought in support of this requirement. The results of this RFI was four responses were received from industry. The Program Office analyzed each

Three offer demonstrated capabilities and knowledge in managing research programs Outside the Continental United States (OCONUS), one didn’t demonstrate relevant capabilities. However each offeror that respond did not have authority or security clearance and access to military controlled areas and existing relationship with the NAF and MoPH. A Notice of Intent was posted on beta.SAM.gov on 15 July 2020 and no responses were received. Based on the market research only one source can provide the services, RTA.
9. Interested Sources: See paragraph 6 for the synopsis information to date, no other sources have written to express an interest in this acquisition

Paragraph 7 of the previous justification reflected that no effort would be made to solicit offers from other sources because the RTA has access to the security controlled sites and provide the health care delivery. Additional the RTA has the existing relationship with both the NAF and the Nepalese MoPH.
(5) If any prior contract for this requirement was accomplished using full and open competition, include a detailed explanation of the changed circumstances causing this action to now limit the sources. Not Applicable

(7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the procurement and whether there have been any significant changes. The previous justification for the procurement was based on that the RTA is the only entity with security clearance and access to military controlled areas including border areas.
