PRE-MISSION BOMBING TARGET RANGE SWEEPS

MARINE CORPS INSTALLATIONS EAST (MCIEAST) - MARINE CORPS AIR STATION CHERRY

POINT

BACKGROUND AND INTRODUCTION:

MARINE CORPS INSTALLATIONS EAST (MCIEAST) implements policies, develops regional strategies and plans, prioritizes resources and provides services, direction, and oversight through assigned U.S. Marine Corps Installations in order to support the Operating Forces, tenant commands and activities. Marine Corps Air Station (MCAS) Cherry Point provides operational control over bombing target/strafing areas located within Pamlico Sound and requires aircraft services (fixed-wing or rotary) to meet regulatory guidelines.

MCAS Cherry Point Complex comprises nine widely dispersed properties located in Carven, Carteret, Jones and

Pamlico counties in eastern North Carolina, including several outlying airfields and bombing targets (BT-9 and BT- 11). These properties cover approximately 26,073 acres of land and 18,000 acres of water, and are strategically located to meet operational and training requirements of the United States Marine Corps. The bombing targets, BT- 9 located in Pamlico County and BT-11 Piney Island located in Carteret County are the subject of this statement of work. Each locations has a defined, Code of Federal Regulations (33 CFR 334.420) area controlled by the Commanding Officer, MCAS Cherry Point.

Per the Endangered Species Act (ESA) and the Marine Mammal Protection Act (MMPA), all Federal activities that have potential to impact federally protected species must adhere to specific conditions of Biological Opinions and Letters of Authorization/Concurrence rendered under section of the respective regulations. MCAS Cherry Point has consultations and coordination with the National Marine Fisheries Service specific to sea turtles, Atlantic sturgeon, and bottle-nose dolphin specific to BT-9 and BT-11. Pre-mission aerial surveys, along a specific identified route, are required to meet regulatory requirements.

REQUIREMENT:

A. Aircraft Services - Marine Corps Air Station Cherry Point

1. Orientation Flight

a. Contractor is required to complete an Orientation Flight, coordinated through Range Control and after receiving a Range Safety Brief, along a pre-defined flight-path (map provided upon award) for demilitarization with procedures and airspace protocols. Contractor’s airspace cooperators shall sign a Hold Harmless Agreement (provided by Government).

2. Compliance Flights -Marine Corps Air Station Cherry Point

a. Contractor is required to provide a morning range survey at the beginning of every weekday (Mon-Fri) along a pre-defined flight-path (map provided upon award). The total number of survey days will be 250.

b. To account for daylight savings time, each survey is to start no earlier than½ hour after astronomical sunrise. Nominally, the start of surveys would be no later than 0630 and to be complete by 0800 dependent upon the time of year.

c. The aircraft must maintain a height between 100-300 meters (328 to 984 ft.) above water surface level.

d. The aircraft must maintain a safe forward airspeed not to exceed 115 mph (100 knots).

e. The pilot is required to validate that no persons, marine mammals, turtles or watercraft (hunters, fisherman, moving or stationary watercraft of any description) are located on the government property of BT-11 (Piney Island or Raccoon Island) or within the CFR controlled boundaries of BT-9/11 as determined by visual survey along the flight path. If the person or watercraft is within the CFR prohibited area or on land which is identified at MCAS Cherry Point property, the aircraft shall "buzz" the vessel by completing an advisory circle around the identified person/vessel at a safe altitude. The flight path is approximately 35 nautical miles, however additional flight time may be required when executing an advisory “buzz” around non-participating vessels.

f. The pilot, if observing smoke or active wildfire on the government property of BT-11 (including Raccoon Island), is required to report the fire activity to Range Operations personnel. Upon check-in by the pilot to the BT-11 sub-area within R5306A, Range Operations personnel may request the pilot to look for smoke of fire activity.

3. Photographic Recordation

a. In addition to reporting and recording all visual observations, the contractor is required to acquire digital imagery of all persons or watercraft (hunters, fisherman, moving or stationary watercraft of any description) that are located on the government property boundary of BT-11 (Piney Island) or within the CFR controlled boundaries as determined by visual survey along the flight path. The contractor is required to acquire digital imagery of any observed smoke or active wildfire. Range Personnel may ask the contractor to capture imagery of the extent of a burned area for management purposes.

i. Deviation from the flight path noted in Section 2.a will be required to obtain a photograph.

ii. At a minimum, a single tip-wing (or rotor) circle shall be made on the camera side of the aircraft to ensure proper framing and image capture. It is anticipated that the "buzz" advisory circle in A. 2.e above shall be used to execute this paragraph.

b. The imagery shall be obtained with a digital SLR type camera with the following minimum specifications:

i. Photographic quality shall not be less than 24.0 Mega-pixels.

ii. Auto Focus and Vibration Reduction Zoom 80-400MM F/4.5-5.6D Camera Lens.

iii. Sun/Glare reduction shroud/filter as appropriate.

iv. Date/Time stamp.

c. Each image shall have GPS coordinates (Lat/Long in minutes, degrees, seconds or MGRS) noted for the location of observation. An annotation shall be made to the master Data Collection form indicating the number of images captured for a specific observation/record.

d. All images are considered the property of MCAS Cherry Point and shall not be distributed beyond that noted in this contract.

4. Photographic Transfer

a. Individual images or series of images of observed persons or watercraft on MCAS Cherry Point Properties shall be transmitted via electronic mail to the Technical Point of Contact the day of an observation. A complete record of all photographic images obtained shall be delivered to the Technical POC each month or as requested. The transfer shall be via the Department of Defense (DoD) Safe Access File Exchange (SAFE) transfer site. The website allows for secure file transfer to and from *.mil to non *.mil addresses. The URL is https://safe.apps.mil/.

5. Data Collection

a. All observation/visual contacts of persons, marine mammals or watercraft shall be immediately reported to Range Control as they occur.

(i) Sighting information for persons/watercraft shall include:

(l) Basic Description/Identification (person, boat, large vessel, small vessel)

(2) Location information shall be provided in Military Grid Reference System (MGRS), WGS-84, 18 South.

(3) Duration of the observation

(4) Response to "buzzing" (Y/N).

b. The pilot is required to record observations of marine mammals (bottlenose dolphins, whales, or manatee) or sea turtles along the designated flight path. All sightings shall be reported to range control with location and type (species) prior to checking off of the range. All sightings made in the immediate vicinity of the water based targets of BT-9 and BT-11 (Rattan Bay) are to be reported as they occur.

(i) Sighting information shall include:

(1) Species identification

(2) group size

(3) behavior (e.g. travelling, milling)

(4) location and relative distance from the water based bombing targets

(5) direction of travel relative to the water based bombing targets

(6) duration of the observation.

(7) date, time, and visual conditions (weather, Beaufort Sea State)

(ii) Data collection forms shall be submitted to EAD and Range Management on a monthly basis.

6. Daily Coordination

a. The flight crew is required to abide by all FAA and MCAS Cherry Point Range regulations and to possess appropriate ratings.

b. The flight crew shall conduct a review of weather from departure airport/aerodrome and review ASOS weather at Bombing Target - Eleven (BT-11) for the duration of the flight. Crew may cancel the survey based on weather and will not be required to make it up later in the day. Visual Flight Rule minimums (1,000' vertical, 3 mile-horizontal)ꞏ shall be used as a basis for weather related cancelation.

c. In the event of weather related cancellation, or other circumstance, the crew shall notify Range Control at

(252) 466-2936/4040. Contractor shall be compensated in accordance with the terms of the contract for services that have been prepared to be rendered.

GOVERNMENT FURNISHED MATERIAL

1. The Range Management Department and/or Range Control Office will provide a one-time range safety brief prior to the initiation of surveys. Flight within the restricted area will be authorized and a mission number provided by range control.

2. Orientation Map of MCAS Cherry Point properties.

3. Map of the defined flight paths for MCAS Cherry Point.

4. Initial format of Data collection forms (to be reproduced by the contractor).

CONTRACTOR PERFORMANCE STANDARDS

The Government shall monitor the Contractors performance under this contract in accordance with the performance standards below. The Government Representative for monitoring contractor’s performance is:

Performance Standard Three

a) STD: Images shall be stored on a 16-32 GB internal SD card and downloaded to a CD/DVD media (read-write capable) post mission. Each Cd/DVD shall be labelled as to date range of the imagery contained on the media. Each image shall have GPS coordinates noted for the location of the observation. An annotation shall be made to the Master Data Collection Form indicating the number of images captured for a specific observation/record.

SAFETY

Mishap Notification and Investigation: The contractor and its subcontractors (if applicable) shall promptly report pertinent facts regarding mishaps involving Government property damage or injury to Government personnel and to cooperate in any resulting safety investigation. The contractor shall notify (via telephone) the cognizant contracting officer, the contracting officer’s representative, and/or other applicable members within four (4) hours of all mishaps or incidents. The Government person notified by the contractor will in-turn notify the Safety office. Contractor notifications made after duty hours shall be reported to the appropriate installation Command Post. If requested by the cognizant contracting officer, the contracting officer’s representative, and/or the cognizant program manager, the contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records until released by the investigating safety office. If the Government investigates the mishap, the contractor and the subcontractors shall cooperate fully and assist the Government personnel until the investigation is completed.

UNAUTHORIZED WORK PERFORMANCE

The Contractor shall not perform work that deviates from the purchase order (PO) and the Performance Work Statement (PWS). If the Contractor deviates from the PO and the PWS without approval of the CONTRACT ADMINISTRATOR / CONTRACTING OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.

2.0 Communications

a) Except as specified in paragraph (b) below, no order, statement, or conduct of Government personnel who visit the contractor’s facilities or in any other manner communicate with contractor personnel during the performance of this contract shall constitute a change under the “Changes” clause of this contract.

b) The contractor shall not comply with any order, direction or request of Government personnel unless it is issued in writing and is signed by the Contracting Officer or is pursuant to specific authority otherwise included as a part of this contract.

c) A Contracting Officer for the Marine Corps Air Station, Cherry Point, NC, is the only person authorized to approve changes in any of the requirements of this contract and, notwithstanding, provisions contained elsewhere in this contract, the said authority remains solely the Contracting Officer’s. In the event the contractor effects any change at the direction of any person other than a designated Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made.

SALES TAX EXEMPTION

The Contractor is hereby advised that the United States Government and Agencies thereof are exempt from State and Local Government tax by virtue of Article 6 of the United States Constitution. No exemption certificate is required.

ADDENDUM TO FAR 52.212-1

1) Submission of Quote

a) The vendor is responsible for ensuring that quotes are received in the Contracting Office no later than 11:00 A.M. (EDT) on 02 September 2021 as indicated on page one (1) of this solicitation. Failure of vendor’s quote to be received prior to the hour and date specified may result in rejection of the quote.

b) Quotes shall be submitted electronically via email john.hounshell@usmc.mil.

c) RFQ Number M67001-21-Q-1323 must be clearly shown in the subject line.

2) Instruction for the Preparation of Quotes: The vendor shall submit the following as part of their quote:

INSTALLATION ACCESS

1.0 Contractor Access to Marine Corps Installation

1.1 Performance of this requirement requires access to Marine Corp Air Station (MCAS) Cherry Point. Contractor personnel shall follow all procedures for access to the Air Station in accordance with Air Station Order (ASO) 5560.6A, available at:

Access requests are required for base access. Please note, due to the Real ID Act, some state driver’s licenses will not be accepted without a second form of identification, like a passport.

1.2 Marine Corps Installations transition to new access control system

Marine Corps Installations across the region are transitioning to a new government-owned access control system called Defense Biometric Identification System (DBIDS). This new and enhanced system will replace RAPIDGate and MCESS for contractors and other non-DoD-affiliated personnel requiring installation access. DBIDS is already installed at more than 320 sites with over 5 million registered personnel and unlike previous systems, this one is a free service.

Current RAPIDGate or MCESS credentials can easily be switched out for a DBIDS credential and new contractors can apply for a DBIDS credential using the same vetting requirements as previously required. RAPIDGate/MCESS credentials will be honored until December 31, 2018. After this date, all contractors will be required to have a DBIDS credential in order to access MCAS Cherry Point. In order to reduce wait time when exchanging your RAPIDGate/MCESS credential, it is highly recommended each applicant pre-register at https://dbids-global.dmdc.mil/enroll#!/.

Here’s what you need to know:

Current DOD ID Card Holders

If you currently hold a valid Common Access Card (CAC), dependent ID card, reserve ID card, or retiree ID card, issued by the Defense Enrollment Eligibility Reporting System (DEERS), no further action is required.

You will be automatically enrolled in DBIDS when your ID card is initially scanned at the gate. Expect a one-time delay of 3-6 seconds as the DBIDS system initially registers your information.

Current Contractors

DBIDS credentials will be issued beginning September 24, 2018 DBIDS credentials will be valid for the duration of your contract, not to exceed five years; however, re-vetting of individuals’ information will occur each year.

Contractors can exchange their current RAPIDGate/MCESS credential for a DBIDS credential without re-vetting, however they will be required to bring the following items:

- Current RAPIDGate/MCESS credential

- Second form of government-issued identification (driver license, passport, etc.)

- Company Contract/Letter of Authorization

New DBIDS credentials will be valid for the remainder of the contract (not to exceed 5 years), but individuals will be re-vetted each year.

All contractors (MCAS Cherry Point) will be able to exchange their current RAPIDGate/MCESS credential at the MCAS Cherry Point Contractor Vetting Office, Building 251 (Pass and ID).

NOTE: Flight line access will still be granted at Physical Security using the procedures already in place.

New Contractors

DBIDS credentials will be issued beginning September 24, 2018 New contractors requiring access for over 60 days will receive a credential valid for up to one year.

New contractors requiring access for less than 60 days will receive a temporary paper pass.

REMINDER: Beginning October 1, 2018, all personnel in possession of a RAPIDGate/MCESS credential will also be required to provide a second valid U.S. government form of identification. Beginning September 24, 2018, DBIDS credentials will be issued or exchanged in place of a RAPIDGate/MCESS credential. The last day RAPIDGate/MCESS credentials will be authorized for entry onto the installation is December 31, 2018.

Note: There is no visit request form. A visit request may be in the form of an email or fax submitted on company letterhead and must contain the following information:

(a) Last name, first name, middle name, place of birth, last four digits of social security number, and citizenship.

(b) Name of the POC and their phone number.

(c) Purpose of visit, if classified/unclassified visit, dates of visit (one year maximum), company name, POC and phone number.

1.4 Additional information regarding access to the Air Station is available by phone at (252) 466-5921. Failure to submit the proper visit request information may result in denial of access to the facility.

1.5 The MCAS Cherry Point main gate is located off NC State Highway 101, Havelock, NC. Visitors without proper vehicle identification are required to check-in at the visitor’s center adjacent to the main gate.

1.6 Contractors are required to wear personal protective equipment (PPE) consisting of hearing protection, eye protection, and safety shoes. PPE will not be provided by the facility. Contractor representatives without the appropriate PPE will not be allowed access to the facility.

2.0 Identification of Contractor Personnel

Contractor personnel shall identify themselves as contractor personnel by introducing themselves or when being introduced. Contractor personnel shall display distinguishing badges or other visible identification for meeting with Government personnel. Contractor personnel shall appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

3.0 Work Performed on Marine Corps Installation

3.1 The worked described herein shall be performed (fill-in location/address) at mess halls located in Building 3451, on 4th Street, MCAS Cherry Point, and in Building 8052, MCALF Bogue Field, NC Monday through Friday 0700 to 1530, unless otherwise requested by the contractor and approved in advance by the Government.

3.2 During the course of contract performance the contractor, as a resident of the installation and facility, shall adhere to all rules and regulations in effect at Marine Corps Air Station Cherry Point. Contractors are required to comply with all Federal and North Carolina State Environmental, Security, and Safety Compliance requirements.

Failure to adhere to these requirements may result in suspension or debarment of the individual employees and/or the contractor.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [] will, [] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

It [] does, [] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

(a) Definitions. As used in this clause--

Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).

Covered foreign country means The People's Republic of China.

Covered telecommunications equipment or services means--

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means--

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

(c) Exceptions. This clause does not prohibit contractors from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement.

(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:

(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
