DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

3. Description of Supplies/Services and Estimated Cost.

This is a recurring requirement for Facilities Access Service for a T1 Data Circuit for the Central Valley Operations Office (CVOO). TDS/ Happy Valley Telephone Company is the service provider for the T1 Circuit which is a dedicated circuit for the Supervisory Control and Data Acquisitions (SCADA) system. The SCADA system is used between Trinity Dam and Keswick Dam to control operations. The circuit itself is controlled by a computer to keep the circuit on or off and the monthly service fee allows that access. The requirement will be for five years (base + 4 option years), and the period of performance will be from 9/01/2026 – 8/31/2031. The total cost is anticipated to be per year or per month

4. Description of Circumstances, including why only one source is reasonably available.

TDS/Happy Valley Telephone Company has been the service provider for the T1 data line since 2009. Happy Valley is the Local Exchange Carrier (LEC) for the area which was established in 1984 with the breakup of the AT&T monopoly. Data access is regulated by tariffs and the California Public Utilities Commission. With the 1984 breakup of the AT&T monopoly, TDS/ Happy Valley became the LEC for certain areas in California, including Trinity County where Trinity Dam is located.
