Authority Cited: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
5. Reason for Authority Cited: The alarm system serves the purpose of receiving fire alarm signals from 200 fire alarm and detection systems both within and outside the main containment area, with primary objective of safeguarding lives and property. In the year 2000, the West Point fire department initiated a process to standardize their fire alarm equipment and infrastructure due to increasing reliability issues with the previous systems. After extensive research, it was determined that Monaco Enterprise Inc., renowned for their reliable products and proven track record on defense installations worldwide, would supply all new systems. Maintenance of the entire system exceeds the technical capabilities of the West Point Fire Department and Directorate of Public Works (DPW) employees.
The Monaco D-21 panel is currently the most widely deployed panel across the installation, installed in over 75% of the buildings on post. The existing spare parts inventory also supports Monaco systems. Additionally, the Monaco D-21 systems already possess the capability to interact with the Department of Emergency Services (DES), and their continued use would ensure proper functionality and integration.
Choosing a different provider could introduce compatibility challenges and require additional work to ensure seamless integration with the existing infrastructure. This could lead to delays, increased cost, and potential disruptions in functionality.
Presently, Monaco Enterprise Inc. provides bi-annual Preventative Maintenance and Inspection (PMI) services for the Monaco D-21 Central Receiving Systems located on West Point. These systems are proprietary in nature, and preventative maintenance inspections are conducted solely by the manufacturer. It should be noted that replacing the fire alarm panel alone would incur a cost upwards and would require additional work and funding to replace existing systems to ensure proper function.
Overall, not awarding the contract to Monaco could potentially result in reliability issues, compatibility challenges, limited spare parts support, and increased burden on the technical capabilities of the West Point fire department and DPW.
6. Efforts to Obtain Competition:
A source sought notice (ID: PANMCC23P0000016799) was published to the Governmentwide Point of Entry (GPE), https://SAM.gov on 17 May 2023 through 22 May 2023. In addition, a Special notice for intent to award a sole source contract to Monaco Enterprises, Inc. (ID: W911SD23R0145) was publicized on 31 May 2023 to 09 June 2023, and there were no responses.
7. Actions to Increase Competition: Market research will be conducted for future requirements to determine if the market conditions have changed. Furthermore, a source sought notice will be published to increase visibility of the Government’s anticipated need.
8. Market Research: Small Business Administration (SBA), Dynamic Small Business Search (DSBS) database revealed a total of zero (0) small businesses under NAICS 561621 and keyword: Monaco D-21. All mandatory sources of supply and services were considered (FAR Part 8), and there are no mandatory schedules that applies to this requirement.
9. Interested Sources: To date, no other sources have written to express an interest.
The notices required by FAR 5.201 have been published, any bids or proposals received shall be considered.

A prior contract for this requirement was accomplished using full and open competition, however, Monaco Enterprises, Inc. confirmed this entity is the sole source for PMI services as the Monaco D-21 Central Receiving System equipment and software are proprietary and may not be altered by other service providers.
