L.2 Communications with the Government
L-215-H007 SUBMISSION OF QUESTIONS BY OFFERORS — ALTERNATE I (NAVSEA) (NOV 2021) Pg. 80 of 109
Pg 101 of 109 L.2 states that "Offerors may submit questions requesting clarification of RFP requirements by electronic mail … using Attachment L-1."
Reference L-215-H007 Paragraph (a) states that "Each question should identify solicitation number, document, page number, paragraph number or other identifier relating to the question. Questions without this information may not be answered. Acknowledgment of questions received will not be made."
Paragraph (b) states that the deadline for receipt of questions is fourteen (14) days after the release date of the RFP.
NOTE: This Attachment L-1 form has been modified to add the required solicitation number.
| Question: Will the Government provide an extension for questions in response to L-215 –H007 SUBMISSION OF QUESTIONS BE OFFERORS – ALTERNATE 1 (NAVSEA) (NOV 2021) in the final solicitation? | Deadline extended to 15 November 2024 in Amendment N00024-25-R-4135 A0001. | ||||
| 26 | RFP N0002425R4135 | General Question | What equipment present onboard CVN 65 during ship checks will be removed prior to vessel transfer or returned following vessel transfer, e.g. generators, temporary power equipment, lighting, forklift, manlift, etc… | Specific leased generators will be returned following vessel arrival at vendors dismantlement site | |
| 27 | RFP | General | |||
| Question | The RFP uses "US Navy", "Navy", "Naval Sea Systems Command", "NAVSEA", "Government" and other iterations of each term, abbreviation, and acronym interchangeably throughout the narrative. |
Question: Please confirm that these terms are synonymous, or provide definitions and clarify use throughout RFP.
| Confirm terms are synonymous. | |||
| 28 | RFP, Attachment L-3 | Pg. 2 | Under the Instructions to Evaluator, the government indicates that evaluators are to "forward the completed questionnaire no later than 01 NOV 2024..." |
| Question: Considering the significance of Past Performance in the evaluation criteria, along with the specificity of the relevancy criteria cited for Factor 2 on page 107, the selection of specific past performance projects by Offerors is among the most important decisions in the proposal development process. The requirement in Attachment L-3 for Offerors to make such past performance determinations by November 1 does not allow Offerors adequate time to make these important decisions. Additionally, where a past performance questionnaire must be routed for completion, Offerors do not control the duration for a customer to complete the questionnaire. The 01 Nov 2024 deadline is unreasonably short, considering that the final RFP was released only four weeks before that date. Providing a longer time for Offerors to select past performance references and to subsequently complete the required questionnaire benefits the Government and ensures fairness in the evaluation. Please revise the requirement for submission of completed past performance questionnaires to be coincident with submission of the Offeror's proposal (i.e., 06 January 2025). | Past performance questionnaire submission date moved to 15 December 2024 | |||
| 29 | RFP Section B | Pg. 3, Note A, 1.b. | Note A, 1.b states: Should the NRC assess Contractor violation(s) during the period of performance carrying a recommendation of a financial penalty, the incentive fee will be reduced as recommended by the NRC. For example, if the NRC recommends a $50,000 financial penalty for an infraction, the incentive fee shall be reduced by $50,000. Each additional incidence of a violation carrying a recommendation of a financial penalty will result in further incentive fee reduction by the amount recommended by the NRC. |
| Question: Please confirm that the any potential NRC penalty is paid for through the reduction to Incentive Fee, and not assessed as a separate cost to the Contractor. | Confirm NRC penalty is paid through the reduction of the Incentive Fee. Contractor will not be fined additionally by the NRC. | ||||
| 30 | RFP N0002425R4135 | Pg. 6-7, 4.0/4.1.1 | The Contractor shall develop a comprehensive Operational Plan for accepting possession of the vessel from the Navy at a mutually agreeable waterborne location near the Contractor’s facility. Is inside a Navigation District Ship Channel directly in front of a potential contractor facility considered a mutually agreeable waterborne location or will NAVSEA require an "Open Ocean" transfer? | Yes, location requested by vendor will be the mutually agreed to transfer of possession. | |
| 31 | RFP, Section C | Pg. 8, 4.1.1.4 | Section 4.1.1.4 states "The Contractor shall provide the following full-time on-site key personnel in their management organization: Project Manager; Environmental, Safety & Health Manager(s); Radiological Controls/Radiation Health Manager; Production Superintendent and Facility/Information Security Officer (FSO)." |
| Question: What is meant by the "(s)" in the Environmental, Safety & Health Manager title? Does the Government expect Offerors to propose more than one ES&H manager? Or is the Government contemplating the separation of the ES&H role into multiple managers filling the overall ES&H function? Please clarify intention. | At least one is required, contractor may separate into multiple roles if desired. | |||
| 32 | RFP, Section C | Pg. 10, Section C 4.3.1.5 | Section 4.3.1.5: Paragraph specifies that "no decommissioning activities that would disturb contamination or radiologically impacted materials will be conducted until NRC review and Navy approval of the contractor’s DWP." |
| Question: Please confirm that this does not preclude performing characterization surveys (for RCRA, TSCA, ACM constituents), which could require paint or coating removal. | Work will be identified and approved on a case by case basis | |||
| 33 | RFP, Section C | Pg. 10, Section C 4.3.1.5 | Section 4.3.1.5: "The Contractor may recommend via formal submittal(s) to the NRC and Navy to conduct decommissioning activities within the vessel following transfer of possession of the ship to the contractor at its facility (Section 2.8) and prior to approval of the DWP. The Contractor’s proposed decommissioning activities prior to DWP approval will be reviewed by the NRC and approved by the Navy. However, no decommissioning activities that would disturb contamination or radiologically impacted materials will be conducted until NRC review and Navy approval of the contractor’s DWP." |
| Please verify that the reference to Section 2.8 should be revised to Section 4.1.1. | Confirm Section 2.8 should be revised to Section 4.1.1. | |||
| 34 | RFP, Section C | Pg. 11, C.4.3.2.2 Note | The Note to Section 4.3.2.2 states "Note: The Government does not intend to authorize the use of Federal waste disposal sites as part of this Contract. The Contractor is authorized to use the waste volume easement of other contractual radioactive waste disposal right for waste generated during Ex-Enterprise dismantlement (Section 4.1.4). |
| Question: Should the word "of" in the last sentence be the word "or" (i.e., The Contractor is authorized to use the waste volume easement or other contractual radioactive waste disposal right for waste generated during Ex-Enterprise dismantlement.)? | Correct. Sentence should read: "The Contractor is authorized to use the waste volume easement or other contractual radioactive waste disposal right for waste generated during EX-ENTERPRISE dismantlement (Section 4.1.3)." | |||
| 36 | RFP, Section C | Pg. 17, C.4.3.9.1 | Section 4.3.9.1 states "The Contractor shall deliver an Environmental Management Plan demonstrating established measures and procedures for ensuring compliance with all applicable Federal, State, and local Environmental laws and regulations in accordance with CDRL A011. Activities subject to the Interagency Agreement and Regulatory Framework (Attachment J-7) may be consolidated into the DWP (Section 4.3) and referenced in the Environmental Management Plan in accordance with CDRL A011." |
| Question: Should delivery of the Environmental Management Plan be delivered in accordance with CDRL A011 as stated or CDRL A014, DWP Submission and Report? | EMP delivered per CDRL A011 and as part of the DWP report in CDRL A014. | |||
| 37 | RFP, Section C | Pg. 20, C.4.4.1.6 | Section 4.4.1.6 states "The Contractor shall take all steps necessary to remove and dispose of all hazardous and regulated materials/wastes generated as part of the EX-ENTERPRISE dismantlement activities in compliance with all Federal, State, and local laws and regulations. | Please verify that the reference to CDRL A002 (Certification of Demilitarization and Dismantlement) should be CDRL A003 (Certification of Proper Disposal of Hazardous Material and Waste). | Both will be used. | |||

| Question: Please confirm that the cost report required by CDRL A007 is intended to be submitted in support of Milestone Billing. If so, will the Government modify the CDRL to reflect submission in conjunction with the Milestone Billing schedule? | CDRL A007 is a monthly cost report. A007 should support the Milestone Billing, however Milestone Billing is dependent on proposed/agreed upon schedule. | ||

| Question 1: Please clarify the requirement for small disadvantaged business concerns. Section 3.3.1 states the requirement is 20%, but L-219-H001 states the requirement is 5%. A goal of 20% for small disadvantaged business concerns is unusually high. Was this meant to require that 20% of 30% was intended to be set aside for small disadvantaged business concerns (i.e., 6% of total contract value)? We encourage the Government to consider using 5% of total contract value as the goal for small disadvantaged business concerns. | The Government's Small Business Participation objective is 30%. The goal for small disadvantaged business concerns shall be 5%. Corrected in Amendment N00024-25-R-4135 A0001. | |||
| 46 | RFP, Attachment J.3 | Pg. 95, L.3.D Volume III Price Proposal, Paragraph 5), Performance Based Milestones | "Proposed PBP milestones shall be tied to meaningful and essential events, be measurable in objective, quantifiable methods, and have clear completion criteria" |
| Question: Will the government provide direction as to where the offeror is to provide the basis for the milestones? Attachment J 3 has columns for only: Milestone Number, Payment Milestone, Percentage of Total price, and price. | Basis for the milestone shall be provided in the "Payment Milestone" column. | |||
| 47 | RFP, Section L.3.E | Pg. 95, para 1 | Regarding the statement, "Offerors shall provide in its proposal any information regarding its past performance, and that of its major subcontractors, (for purposes of the past performance evaluation, Major Subcontractor means the asbestos/hazardous waste removal Subcontractor and any Subcontractor that will accomplish 30% or more of the labor/direct/man-hours proposed for the work required by the solicitation) on THREE (3) recent and relevant contracts within the last FIVE (5) years...If applicable, one major subcontractor (Offeror's choice) past performance should be included in the submission." |
Question 1: Section L.3.E. states a requirement for three past performance projects, but separately calls out a requirement (if applicable) for one major subcontractor's past performance. Please confirm that the requirement is a total of three total past performance projects for the Offeror as a whole (e.g., the Offeror team may include multiple business group members, multiple major subcontractors, etc.), for which one such past performance project may be associated with a single major subcontractor.
| Question 2: Please clarify the statement regarding the inclusion of major subcontractor past performance. If an Offeror has one or more major subcontractors who meet the definition of Major Subcontractor per section L.3.E, is the Offeror limited to one past performance reference for a single major subcontractor, or may the Offeror provide (for example) a second past performance reference for a second major subcontractor? In this example, two of the Offeror's three past performance references would be associated with major subcontractors. | At least three past performance evaluations shall be submitted for each offeror, and one additional past performance evaluation per each major subcontractor. | |||
| 48 | RFP Section L | Pg. 95 Para. g) and Pg. 97 Clauses by Reference | The RFP states ““This proposal reflects our estimated proposed price and conforms to the instructions in FAR 15.403-5(b) (1) and Table 15-2.” |
Question 1: Will the Government please confirm that in addition to the Cost Volume a separate file will be required to provide the detail required in Table 15.2 or alternatively confirm that the detail required will only need to be made available at the Governments request?
| Question 2: Given the inclusion of 252-215-7009 Proposal Adequacy Checklist, can the Government clarify whether such checklist is required at the time of proposal submission, upon award, or on another date? | As indicated, estimated price proposals are included in the cost volume only. | |||
| 49 | RFP, Section L.3.E | Pg. 97, para 3 | All Offerors shall provide a list of contracts within the last three (3) years demonstrating that the Offeror has carried out the policy described in FAR 52.219-8, in awarding of subcontracts to small business concerns to the fullest extend consistent with efficient contract performance. This list of contracts will be used solely to determine historical compliance with the requirements of FAR 52.219-8 (Utilization of Small Concerns). |
Use L-2 form if necessary (CPARS – the final report if applicable – is the preferred official version).
| Question: Please confirm that the L-2 form is the appropriate reference. | Correct form is L-3 reference information sheet (RIS). Corrected in Amendment N00024-25-R-4135 A0001 | ||||
| 50 | RFP | P. 90, 3.2.2 Element 1.2: Management Capability and Approach | RFP Section 3.2.2 Element 1.2, item 2 states: "Provide the estimated total direct labor man-hours, by labor category for the prime contractor, each major subcontractor, and all other subcontractors, for dismantling EX-ENTERPRISE from the point of the vessel’s arrival at the Offeror’s facility to completion of radiological and non-radiological material dismantling, final disposal of hazardous wastes, and sale of scrap metals and re-useable equipment. Major Subcontractor means the asbestos/hazardous waste removal Subcontractor and any Subcontractor that will accomplish 30% or more of the labor/direct/man-hours proposed for the work required by the solicitation. Provide the rationale for determining the estimated total man-hour requirements that demonstrates an understanding of the scope of work involved. Describe the functions of any indirect labor that contributes to the performance of this contract." Please confirm this requirement only applies to the prime contractor (Offeror) and each major subcontractor (as defined). | Confirmed. | |
| 51 | RFP | 91/109, Section L, L.3.2 | Please consider defining the 'Total Contract Value' to include the scrap value. | The FFP/Total Contract Value shall represent the net cost of performance, which factors in anticipated proceeds from the sale of scrap and reusable equipment/material. | |
| 52 | RFP | P. 82 and 83, L.3 Additional Solicitation Response requirements; P. 85, | Page 82 of the RFP states that: "The solicitation response shall be provided with a Forwarding Letter and formatted in four (4) Volumes." Page 83 of the RFP states: “Said Certificate shall be provided in Volume III - Price Proposal immediately behind the required cover letter.” Does the Government want both a Forwarding Letter and a separate cover letter for Volume III? | Yes. | |
| 53 | RFP | P. 90, 3.2.2 Element 1.2: Management Capability and Approach | RFP Section 3.2.2 Element 1.2, item 2 states: “Provide the estimated total direct labor man-hours, by labor category for the prime contractor, each major subcontractor, and all other subcontractors, for dismantling EX-ENTERPRISE from the point of the vessel’s arrival at the Offeror’s facility to completion of radiological and non-radiological material dismantling, final disposal of hazardous wastes, and sale of scrap metals and re-useable equipment. Provide the rationale for determining the estimated total man-hour requirements that demonstrates an understanding of the scope of work involved. Describe the functions of any indirect labor that contributes to the performance of this contract." Please confirm that we do NOT need to provide this information for vendors/service contractors (e.g., portable toilet cleaning, truck drivers, equipment delivery/setup, maintenance, etc.) not performing day-to-day work. | Confirmed. | |

| 55 | RFP | 83/109, Section L.3 Additional Solicitation Response Requirements | Please confirm that the headers and footers of the proposal may follow the same font instructions as graphics. | Confirmed, same size as graphics. | |
| 56 | RFP | P. 81, L.3 Additional Solicitation Response Requirements | The RFP states: "Schedules shall be created and submitted using Microsoft Project compatible applications, in addition the Offeror shall submit schedule as a higher-level PDF." Please clarify what is meant by "higher-level PDF" (e.g., higher resolution PDF or a roll-up of the detailed schedule). | Higher resolution PDF is the correct terminology. | |
| 57 | RFP | P. 81, L.3 Additional Solicitation Response Requirements | Should the schedule be submitted as a separate PDF file or included within the Volume II Technical Proposal file? | Schedule shall be submitted as part of Volume II - Technical Proposal but is not counted as part of the 125 page limit. | |
| 58 | RFP | P. 81, L.3 Additional Solicitation Response Requirements | The RFP states: "Schedules shall be created and submitted using Microsoft Project compatible applications, in addition the Offeror shall submit schedule as a higher-level PDF." Please confirm that you are asking for two file submission; one submitted using Microsoft Project compatible applications and another in PDF. | Confirm two submissions are required. | |
| 59 | RFP | P. 83, L.3 Additional Solicitation Response Requirements | Please confirm that the required schedule is not included in the 125-page limit for Volume I—Technical Proposal. | Confirm the schedule is not included in the Volume II -Technical Proposal page limit. | |
| 60 | RFP | P.95, Section L.3.E | Please clarify that Offerors are permitted to submit Past Performance information for recent and relevant contracts within the past five calendar years (2019-Present) that pertain to the same or similar work in terms of both type and complexity. | Correct, refer to Section L.3.E Volume IV Past Performance Proposal of the RFP. | |
| 61 | RFP | P. 55, 52.228-16 (b) | Reference section states, "(b) The Contractor shall furnish a performance bond (Standard Form 1418), except that a seal is not required) for the protection of the Government in an amount equal to ___20____ percent of the original contract price and a payment bond Standard Form 1416, except that a seal is not required) in an amount equal to ___10___ percent of the original contract price when Contractor has removed, packaged, and shipped for disposal all components, equipment and piping from all eight reactor compartments and four reactor auxiliary rooms. Performance bond is no longer required when the NRC has accepted the Contractor Final Status Survey (FSS) and recommends that the dismantlement site be released for unrestricted use." We believe the reference to a "payment" bond should be "performance" bond and that the intent is a step down from 20 percent to 10 percent when the stated conditions are met. Please clarify. | Correct, "payment" should be "performance" in paragraph (b). | |
| 62 | RFP | P. 95, L.3.E Volume IV Past Performance Proposal | Please confirm that Offerors (Prime Contractor) should provide three recent and relevant contracts to demonstrate Past Performance and that one contract should be provided for an applicable Major Subcontractor for a total of four contracts. | Confirmed. | |

| 63 | RFP | 91/109, Section 3.3.1, 82/109 L.3 | The requirement for including the “Small Business Subcontracting Plan” (91/109, Section 3.3.1) in Volume II Technical Proposal is inconsistent with the requirement to include Price information in the Price Volume only (82/109 L.3). Please clarify. | Addressed in Amendment A0002. Small Business Subcontracting Plan and Small Business Participation Commitment Document (SBPCD) shall be submitted as part of Volume III - Price Proposal. No Price information shall be submitted in the Technical volume or in the forwarding letter for the proposal. All price information shall be submitted in the Price Volume only. | |
| 64 | RFP | 88/109, Section 3.2.1 | Please consider removing the SWPP from Section 3.2.1 requirement and adding it to 3.1, as the SWPP is typically 40 plus pages. If the government requires it as part of 3.2.1, than consider including only the approval page, cover page, and table of contents, ~5 pages with the submission. | As stated in section 3.2.1. This is a facility site diagram, not a copy of the pollution prevention plan. | |
| 65 | RFP | 50/109. Section H - Special Contract Requirements (full text) and 52/109 Section I Contract Clauses (by reference), 95/109 Section L.3.d g) | The RFP refers to the following section 15.403-5(b)(1) concerning the submission of Certified Cost and Pricing data with the following statement: “This proposal reflects our estimated proposed price and conforms to the instructions in FAR 15.403-5(b) (1) and Table 15-2. By submitting this proposal, we grant the Contracting Officer and authorized representative the right to examine, at any time before awards, those records, which include books, documents, accounting procedures and practices, and other data, regardless of type and form or whether such supporting information is specifically referenced or included in the proposal as the basis for pricing, that will permit an adequate evaluation of the proposed price.” |
The requirement for certified Cost and Pricing Data appears to contradict Federal Procurement law, where FAR 15.403-1(b) states, "The contracting officer shall not require certified cost or pricing data to support any action… (1) When the contracting officer determines that prices agreed upon are based on adequate price competition (see standards in paragraph (c)(1) of this subsection); Also reference15.403-1 (c) for adequate price competition factors, “(A) Two or more responsible offerors, competing independently, submit priced offers that satisfy the Government’s expressed requirement…” )."
| Please confirm that Certified Cost and Pricing Data is required and what is the basis for including the requirement. | Language clarified in Amendment A0002. FAR 15.403-5(b)(1) states that "when certification is required, the contracting officer may require submission of certified cost or pricing data". In the event the contracting officer determines that prices agreed upon are based on adequate price competition, certified cost and pricing data would not be required. | ||||

Does this delivery date include the Site Release or is the Site Release delivery date 54 mths ADC? | Ship dismantled; site remediated and certified vendor can request incentive fee as both ship is gone and site is released at 54 months. | |
| 67 | RFP | 83/109, Section L.3 Additional Solicitation Response Requirements | Please confirm if size 11x17 pages are permitted in the proposal response. | Should be 8 1/2 x 11 inches except for graphics, tables and diagrams. | |
| 68 | RFP | 63/109, Section J | Please confirm J-15 -Contractor Operational Plan for accepting custody of the vessel referenced on page 63 is the 'COMPLETED REQUEST FOR TRANSFER OF POSSESSION PER 10 CFR 30. 34(b)(2)(i)(i)' referenced on page 87/109 Section 3.1.7. | Confirm. | |
| 69 | RFP | P. 83, L.3 Additional Solicitation Response Requirements | Section L.3 of the RFP states: "A page is defined as a typed page of the proposal document, i.e., one sheet of paper with typing on one side." Please confirm that contractors can use 11x17 pages for graphics (e.g. Facility Diagram, Facility Map with Evacuation), pricing spreadsheets, tables, and schedules - and that a single-sided 11x17 page will only count as one page. | Concur. | |

| P. 94, Section L.3.D | Section M.I.5.5 states, "Any proposal that is materially unbalanced may be rejected as unacceptable. An unbalanced proposal is one that is based on prices, which are significantly less than cost for some work and prices which are significantly overstated for other work," and Section L.3.D. Volume III Price Proposal Instructions do not require detailed cost detail that would suggest a materially unbalanced proposal. How will the Navy evaluate or enforce the requirements? | Language is consistent with FAR 52.215-1 Instructions to Offerors-Competitive Acquisition. | |||

| 75 | RFP, Section L.3 | Pg. 81 and 1 | "Electronic Submissions of the proposal, as indicated below, shall be submitted to the CS, Robert Whitlow at robert.c.whitlow.civ@us.navy.mil and the PCO, James McGowan at james.f.mcgowan6.civ@us.navy.mil in accordance with due date listed in block 9 of the SF33. Responses not received at the time specified will be considered late and not considered for award. The Offeror is responsible for the condition of its delivered proposal. Timely submission to PIEE does not constitute complete submission. As such, Offerors are strongly encouraged to submit early to allow time to confirm receipt of the proposal materials with the PCO or CS. |
Note 1: Hand-carried and mail delivered proposals will not be accepted. Submission of e-mail offers is not authorized for this solicitation. The PIEE website is the only acceptable method of submission."
| Question: Since according to the note, the PIEE website is the only acceptable method for submitting the proposal, under what circumstance would the government expect Offeror's to submit via email to the CS and/or PCO? | Clarified in Amendment A0002. Offerors should also ensure that proposal submissions are submitted to the solicitation number, N00024-25-R-4135. | |||
| 76 | RFP, Section L.3. and SF-33 | Pg. 81 and 1 | SF33 Block 9 directs that offers be submitted via PIEE. Section L (page 81; “Formal Submission”) states that timely submission in PIEE does not constitute complete submission and that electronic submissions must also be provided to the CS (Robert Whitlow) and the PCO (James McGowan). |
| Question: Do offers need to be sent to the CS and PCO to comply with complete submission requirements? If so, do offers need to be e-mailed to the CS and PCO, or is it sufficient for complete submission to e-mail notification to the CS and PCO letting them know that the offer has been uploaded to PIEE? | Offers shall not be sent to the CS and PCO. Offerors are strongly encouraged to submit to PIEE early to allow time to confirm receipt of the proposal materials with the PCO or CS via separate correspondence. |
