Control Number: MICC 2022-79

Contractor: National Sourcing Inc.

Program: Casualty Administration Services Support

no. B-420927, was filed resulting in a stay of performance of the new contract. FAR clause 52.217-8 on contract W9124D-17-D-0057 was unable to be exercised because the period of performance ended on 1 August 2022. However, the current task order is still valid until 15 August 2022.

b. Alternatives. To date, National Sourcing has performed the required services with no performance issues. Though there are other contractors with the capabilities to perform the requested services, due to the short timeline and criticality, it is in the best interest of the government to secure this bridge contract with National Sourcing to ensure continuity of services while the protest is being resolved. Under this timeline, there are no other sources capable of providing the required services.

c. Impact if Justification is not approved. There will not be an expedited vehicle for Army Human Resources Command to increase support in CMAOD if needed. Without approval for the contract and following TO, CMAOD will not have the support needed to meet the mission of Past Conflict Repatriation Branch in accordance with 10 USC 1501

– 1513.

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: In accordance with FAR 19.702(b)(1), a Subcontracting Plan is not required because the anticipated awardee is considered a Small Business.

7. Actions to Increase Competition: The original contract was solicited and awarded competitively. This request is for a sole source action that will permit additional time to resolve the GAO post award protest.

8. Market Research: The urgency of this requirement does not allow for the consideration of another source except for the incumbent, National Sourcing, Inc.

However, previous market research for the follow-on requirement and the proposals received under the protested solicitation indicate adequate competition is available under a SDVOSB set-aside.

9. Interested Sources: An approved waiver to the Sources Sought Notice as required to the DFARS PGI 206.302-1(d), is in the PCF file. Notice of intent to sole source was published on SAM.gov on 8 Aug 2022. No other sources have indicated interest. The follow-on requirement W9124D22R0004, was solicited as an SDVOSB set-aside, and all interested sources were afforded an opportunity to submit an offer. The justification will be made publicly available after award within the applicable time limits prescribed in FAR 13.501(a)(iii).
