About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a 5-month contract extension for custodial services at Fort Bliss, Texas. The incumbent contractor, Nugate Group LLC, has been providing these services under an 8(a) Direct Award Firm-Fixed-Price Indefinite Delivery Indefinite Quantity (FFP IDIQ) contract since April 2019. The Government determined that awarding the extension to the incumbent is the lowest risk option to avoid a break in service, as the other respondents to the sources sought notice did not demonstrate the capability to meet the requirements within the limited timeframe. The follow-on contract will be competitively procured as a small business set-aside. The estimated value of the 5-month extension is $2,182,448.74, and it will be awarded to Nugate Group LLC.

e. None of the vendors provided information that would demonstrate to the Government that it has successful, or any experience and capability to reach full performance of this contract in the advised limited time: Full performance by 23 September 2024 – 22 February 2025 (19 days after the sources sought notice closed).
Given the time constraints with performance ending 22 September 2024, the Fort Bliss mission will be put at risk if a different vendor was awarded this 5-month extension.
7. Actions to Increase Competition: The Government intends to issue the follow-on contract as a competitive small business procurement as expeditiously as possible and fair competition is expected. As indicated above, this is a bridge contract to ensure uninterrupted performance of custodial services at Fort Biss, Texas until the competitive follow-on contract can be awarded in February 2025.
8. Market Research: Market Research for this requirement using NAICS code 561720 (Janitorial Services) including Custodial services, was completed for the recompete contract to determine the interest and capability of small business firms with the knowledge, experience and business acumen commensurate with the level of effort required. As per the sources sought posted, three contractors responded, and are all small disadvantaged, two women owned small business and one 8(a) businesses.
9. Interested Sources: In accordance with DFARS 205.205-71, DFARS 206.302-1(d), and PGI 206.302-1(d), MICC Fort Bliss posted a source sought notice (see paragraph 6 for the sources sought notice information). To date, no other sources have written to express interest in this 5-month extension. In response to the sources sought notice, technical information submitted by has been reviewed by the contracting office and does not meet the requirements requested in the sources sought notice. The sources sought notice asked respondents to provide proven experience in providing similar custodial services. None of the three respondents provided information that demonstrated any historical or current capability to meet this requirement. The contracting officer has determined that awarding the extension to the incumbent is the lowest risk to mission failure, and the only viable option to avoid a break in service.
