Justification Review Document – FAR Part 6 Non-Competitive Procurement

This is a Justification Review Document for a FAR Part 6 non-competitive procurement approval. The U.S. Army Mission and Installation Contracting Command (MICC) at Fort Benning, Georgia seeks to award a $48 million cost-plus-fixed-fee bridge contract to TIYA Support Services & Keta Group, LLC for Base Operations (BASOPS) and Maintenance Services. The contract period of performance spans six months from July 1, 2026 through December 31, 2026. The procurement is justified under 10 U.S.C. 3204(a)(1) and FAR 6.103-1(c)(2)(ii) as a sole-source award where only one responsible source can satisfy agency requirements without unacceptable delay. The Directorate of Public Works at Fort Benning requires these services to maintain facilities engineering, facilities maintenance, the Army Cemetery, and geographic information systems supporting an average daily population of 103,000 and over 2,300 buildings totaling approximately 19 million square feet.

The justification cites critical operational continuity requirements as the primary rationale for non-competitive award to the incumbent contractor. The current contract (W911SF19C0024), originally awarded in August 2019 with a $201 million ceiling, will reach its estimated cost limit by June 30, 2026. A follow-on competitive procurement by the MICC Installation Readiness Center at Fort Sam Houston is projected for award by October 31, 2026. Awarding the bridge contract to a new contractor would create two vendor transitions within a six-month period, resulting in unnecessary costs and service disruption risks including start-up costs, staffing challenges, and property accountability issues. A Sources Sought Notice was posted March 25, 2026, with responses received by April 2, 2026, though the government determined competitive procurement could not be completed before contract expiration. The follow-on BASOPS requirement will be set-aside as a competitive 100% small business set-aside. Fair and reasonable cost determination will be made through price analysis comparing historical prices and the independent government cost estimate.

Reviews: I have reviewed this justification and find it adequate to support other than full and open competition.

FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Requiring Activity: Directorate of Public Works (DPW) 6650 Meloy Drive, Building 6 Room 302A, Fort Benning, GA 31905

2. Contracting Activity: U.S. Army Mission and Installation Contracting Command (MICC)-Fort Benning, GA 6650 Meloy Drive, Building 6, Fort Benning, GA 31905.

3. Description of Action: Request approval to award a new non-competitive $48 million (M) cost-plus-fixed-fee bridge contract to TIYA Support Services & Keta Group, LLC, 52UV0, 345B Highlandia Dr., Baton Rouge, Louisiana 70810. The Government projects award for July 2026 and fiscal year 2026, Operations and Maintenance funds will be used.

4. Description of Supplies/Services: The BASOPS requirement is necessary to support Fort Benning’s mission with Facilities Engineering Services Management, Facilities Maintenance, Army Cemetery, Installation Geographic Information System, which services a total average daily population of 103,000 and maintains over 2300 buildings totaling nearly 19 million square feet, including 27 million square yards of paved areas (roads, parking), taxiways, aprons, runways, sidewalks, and bridges. The contract provides public works maintenance services which include routine, urgent and emergency repairs for the entire Fort Benning installation. If the contract is not extended, US Army Garrison - Fort Benning will be functionally ineffective and unable to support the training mission resulting in degraded national security.

Period Period of Performance (POP) Estimated Value Base 01 JUL 2026 — 31 DEC 2026 $48 M

5. Authority Cited: 10 U.S.C. 3204(a)(1), as implemented by FAR 6.103-1 (DFARS CD 2026-O0017) — Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

6. Reason for Authority Cited: As described at FAR 6.103-1, when the supplies or services required by the agency are available only from one responsible source, or for DoW, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. Furthermore, pursuant to the provisions of FAR 6.103-1(c)(2)(ii), awarding a new contract action to the incumbent for BASOPS Services will allow the incumbent to continue to provide BASOPS services without resulting in an unacceptable delay which would negatively impact Fort Benning’s obligations to its mission.

a. Background: Contract W911SF19C0024 was solicited in April 2019 via System for Award Management (SAM) and was a 100% Small Business (SB) set aside. A Cost-plus-fixed-fee contract consisting of a 12-month base year and four 12-month option years was awarded to TIYA Services, LLC on 31 August 2019, with a total contract ceiling of $201M. A contract modification review board was conducted and resulted in an analysis of funding issues and subsequently identified a mission need to increase the BASOPS funding. The additional funding was critical for the operation, maintenance and repair of real property facilities, including buildings and structures, roads, and grounds. Therefore, a modification was exercised to increase the estimated cost of contract W911SF19C0024 by $83,585,181.90 at the beginning of the last option year (01 September 2023 – 31 August 2024). Fort Benning and the Maneuver Center of Excellence (MCoE) provide Agile, Trained, Adaptive, and Ready Soldiers and Leaders for an Army at War, and develop Future requirements for the individual Soldiers and the Maneuver Force while providing a World Class Quality of Life for our Soldiers and Army Families. Fort Benning services a total average daily population of 103,000 people and maintains over 2300 buildings totaling nearly 19 million square feet, including 27 million square yards of paved areas (roads, parking), taxiways, aprons, runways, sidewalks, and bridges. If the proposed contract action is not approved, US Army Garrison – Fort Benning will be functionally ineffective and unable to support the training mission resulting in degraded national security.

The prospect of awarding a bridge contract to a new contractor would also raise the potential of two vendor transitions within a 6-month period; one for this bridge, and then likely another after the award of the follow-on contract. Although the award of the follow-on contract will likely require a vendor transition that is unavoidable, incurring a second vendor transition by awarding a bridge contract to other than TIYA Support Services and Keta Group, LLC, would be an avoidable expense if the interim bridge contract is awarded to the incumbent of the current contract. The benefits of competition will not offset the expense and efforts of multiple transitions within this short timeframe.

The Fort Benning DPW submitted the complete requirements documentation on 08 March 2023 for the new follow-on requirement; however, personnel turnover and continuous revisions to the original requirements documentation have delayed the follow-on award which is now projected for October 2026. The MICC - Installation Readiness Center (IRC) at Fort Sam Houston, will be leading the procurement effort for the follow-on BASOPS contract on behalf of the Fort Benning DPW. They are projecting to issue the solicitation no later than the end of May 2026.

FAR Clause 52.217-8 was executed on W911SF-25-C-A004 to continue performance for four months beginning 1 March 2026 and ending 30 June 2026 when the estimated cost of the CPFF contract is expected to be reached. The critical need to maintain uninterrupted BASOPS services is imperative and the only viable option at this time is to execute a new bridge contract for a 6-month period to allow for the new BASOPS contract to be awarded by the MICC-IRC. The MICC-IRC projects award of the new BASOPS contract by 31 October 2026. The incumbent is the only contractor currently onsite and performing this work under a binding contract. This justification accounts for the length of time the Government estimates that it will take to establish the new follow-on award with consideration given to the current contract terms.

b. Alternatives. Suspension of Operations. Suspension of operations is not a viable option. The maintenance service provided by the current contract directly impacts multiple agencies’ missions located on Fort Benning. Suspending maintenance service will result in life, health, and safety issues to include failure of buildings and their equipment; thus, jeopardizing missions of the occupants.

c. This immediate requirement is for an interim contract with the incumbent. It would be neither cost effective nor realistic to expect another contractor to perform to the full extent of the contract during the brief interim period without some sort of disruption of services due to the following: start-up costs; manning problems including recruitment and associated relocation fees; continuity of service, transfer and accountability of a large amount of Government Furnished Property; variety and complexity of requirements; and preparation of management plans.

d. Impact if Justification is not approved. Failure to approve this action will result in a break-of-services for base operations and maintenance across Fort Benning, GA thus creating mission failures across multiple agencies. Mission critical facilities like Lawson Army Airfield Communication Tower, McGinnis Wickham Hall (Building 4), and Ranger facilities may have building failures due to lack of maintenance services, thereby threatening national security.

7. Efforts to Obtain Competition: In accordance with FAR 5.101(a) (DFARS CD 2026-O0003), a pre-solicitation notice will be posted to the GPE.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: The incumbent contractor is a small business and a subcontracting plan is not required. For any part of the contract that is subcontracted, the contractor will be required to obtain as much competition as possible and give maximum opportunity to small businesses and adhere to the Limitation on Subcontracting IAW Class Deviation 2021-O0008 FAR 52.219-14.

8. Actions to Increase Competition: The follow-on requirement for the new BASOPS contract that will be procured by the MICC-IRC at Fort Sam Houston, TX, will be set-aside as a competitive 100% small business set-aside and is projected to be awarded by the end of October 2026.

9. Market Research: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 206.103-170(d), and DFARS Procedures, Guidance, and Information (PGI) 206.103-170(d) (DFAR CD 2026-O0017), a Sources Sought Notice and Notice of Intent to Sole Source was posted to SAM.gov on 25 March 2026 for 7 days with received by the closing date of 02 April 2026. While the responses show industry interest, they do not demonstrate that a competitive award is currently feasible. The requirement is complex and requires specialized knowledge and continuity that new vendors cannot assume without significant transition risk. Based on the technical demands and the time needed to conduct a full competitive procurement, it is unlikely that a competitive award could be completed before the current contract expires. A short-term bridge contract is therefore necessary to maintain uninterrupted mission-critical services while the Government completes a full and compliant competitive acquisition.

10. Interested Sources: The list below depicts the that responded to the Sources Sought Notice posted on 25 March 2026.

These vendors responded to the Sources Sought Notice on SAM.gov by submitting a capability statement and/or formal expression of interest demonstrating their ability to support the BASOPS and Maintenance Services Requirement. The Government has considered all responses received to the Sources Sought Notice posted on 25 March 2026. The benefits of competition, or a sole-source award to a vendor other than the incumbent, will not offset the expense and effects of multiple transitions within this timeframe if either of these courses of action are followed.
