About this file

This document is a Limited Source Justification and Approval (J&A) for a federal contract opportunity under the Multiple Award Schedule (MAS) program. The justification is for extending a contract (CTC0369/HC1013-23-F-0034) held by Intelsat General Corporation to provide critical C-band satellite services to the Missile Defense Agency (MDA) at Camp Roberts, California.

The original contract was competed under GSA IT MAS 517410, but Intelsat General Corporation was the sole offeror. The services were initially intended to support the transition of equipment from commercial to military satellite communications, but the transition took longer than expected. Due to the criticality of the MDA mission, it is necessary to continue the C-band satellite services with Intelsat General Corporation until the transition is complete. The J&A extends the period of performance through November 1, 2024, with optional CLINs for further extensions through March 1, 2025. Pricing was determined to be fair and reasonable under the existing contract.

(b) Description of the Justification.

CTC0369/HC1013-23-F-0034 is a contract held by Intelsat General Corporation. The solicitation was competed amongst schedule holders on GSA IT MAS 517410.

Intelsat General Corporation was the only offeror to submit a proposal. The required Camp Roberts C-band satellite services were originally contracted to support the turnover and certification of equipment to MILSATCOM. Due to an unforeseen delay in equipment certification, the contract CLIN 1002 was added using available surge to fill their immediate need for C-band satellite services. The initial expectation was that the new equipment would be implemented and operational within 6 months.

However, the equipment installation and certification has taken much longer than expected. Due to the criticality of the MDA mission, it is necessary to continue service for Camp Roberts with Intelsat General Corporation, the only company that is currently known to supply this service to this region.

(c) Justification:

(1) Minimum Government requirements.

The Government requires C-band satellite services at Camp Roberts, California that can quickly be awarded to support MDA utilizing the existing terminals and connections that have been established.

(2) Proposed sole source contractor.

Intelsat General Corporation is the contractor on CTC0369/HC1013-23-F-0034.

(3) Discussion regarding cause of the limited source situation.

The required C-band satellite services were originally contracted to support the transition from the old equipment to the new equipment and transfer services to MILSATCOM. Due to unforeseen delays in equipment installation and certification, it is necessary to extend the period of performance of C-band satellite services.

Intelsat General Corporation is the only contractor that submitted a proposal to the original solicitation. If the C-band satellite services were to be procured outside of this order, there would be added cost and possible loss of service. Due to efficiency and economy, it is in the best interest of the Government to continue this service with Intelsat General Corporation on CTC0369.

(4) Procurement discussion.

This contract was awarded using Full and Open competition on GSA IT MAS 517410 with the expectation that the old equipment only needed a few months of service before transitioning. Due to unforeseen delays, there is an immediate need to extend services so that MDA can continue to provide critical services to warfighters.

Page 4 of 6 Pages

Offerors at the time of solicitation should have had a reasonable expectation for this change based on the needs outlined in the requirement.

(5) Impact.

MDA supports numerous Department of Defense critical missions. The C-band satellite services are vital to their command, control, and communications. Without the extension of C-band satellite services, the warfighters would be left vulnerable during attacks and attack responses.

5. BEST VALUE DETERMINATION:

GSA has already determined that prices of these fixed price services are fair and reasonable for the purpose of establishing the schedule contract under GSA IT MAS 517410. Pricing was also determined fair and reasonable by the contracting officer at the time of award for this task order and when additional surge was applied to the C-band service. The contracting officer will ensure pricing is fair and reasonable for the services being extended and added to this task order.

6. MARKET RESEARCH:

For this requirement, GSA IT MAS 517410 was utilized. This determination was made because the requirement consists of managed network subscription services. A review of the acquisition history revealed that Intelsat General Corporation was the only company that could supply the necessary services to the specific location immediately in a cost-efficient and time-efficient matter. In the past, small businesses were capable of providing the services by subcontracting satellite services from large businesses. However, due to the changes in the Limitations on Subcontracting clause, small business set asides are no longer authorized to resellers because they do not complete at least 50% of the work (as they are only reselling satellite bandwidth provided by a large business). Therefore, current contract requirements dictate that bandwidth is purchased directly from the satellite owners. It was confirmed that the satellite capacity is available through Intelsat General Corporation to keep mission critical services operational to support the warfighters.
