About this file

This is a Justification and Approval (J&A) document for a sole source purchase order issued by the Naval Surface Warfare Center Indian Head Division (NSWC IHD) to North Star Imaging (NSI) for maintenance services of Computed Tomography Cabinet X-Ray systems. The J&A number is N00174-26-RFPREQ-M62-0013, with a contracting code of 026.

The procurement covers preventive maintenance and inspection (PMI), emergency onsite service and repair, and telephone/electronic technical support for four NSI X-ray cabinets used for non-destructive testing of energetics manufactured at NSWC IHD. Government minimum needs include 10 preventive maintenance visits over the base period (2 annually), repair visits as needed, and spare parts on an as-needed basis with a not-to-exceed cap. The purchase order consists of one base period and four optional 12-month periods exercisable at the Government's discretion. The award is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 (Only One Responsible Source) because NSI is the original equipment manufacturer with proprietary software and controlled drawings; maintenance by unauthorized providers would void all OEM support and warranties. Replacement of a single degraded unit would cost approximately the amount shown in redacted sections and cause an estimated 16-20 month operational delay. Market research efforts included Sources Sought notices posted February 9 and March 4, 2026, which yielded two responses (BHPE, LLC and The Remi Group, LLC), both deemed technically incapable of meeting requirements. A pre-solicitation notice was published March 20, 2026 with no responses received. The Contracting Officer determined anticipated costs to be fair and reasonable. Navy Working Capital Fund will finance the procurement. The J&A received technical certification on April 23, 2026, legal sufficiency review on April 30, 2026, and contracting officer certification on May 1, 2026, with final approval by the Deputy Chief of the Contracting Office on May 1, 2026.

DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

INDIAN HEAD DIVISION

3767 STRAUSS AVENUE

J&A Number:N00174-26-RFPREQ-M62-0013 Code:026

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center Indian Head Division (NSWC IHD), Contracts Office Code 026.

2. Description of the Action Being Approved

Award of a sole source purchase order for the maintenance of four (4) Computed Tomography Cabinet X-Ray systems to:

North Star Imaging (NSI) 19875 S Diamond Lake Rd.

Rogers, MN 55374 Cage Code: 0KGB3

3. Description of Supplies/Services

NSWC IHD has a requirement for preventive maintenance and inspection (PMI), emergency onsite service/repair, and response to service calls via telephone and electronic methods for four (4) NSI X-ray cabinets, which support X-ray inspection of energetics manufactured at NSWC IHD.

This purchase order will consist of one base period and four

(4) 12-month options, to be exercised at the Government’s discretion.

Government Minimum Needs

Preventive Maintenance Visits 10 (2 Annually)

Repair Visits As Needed

Spare Parts As Needed, Not to Exceed

(NTE)

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The total estimated cost of the proposed contract action is anticipated to be Navy Working Capital Fund will be utilized for this procurement.

4. Statutory Authority Permitting Other Than Full and Open

Competition

This acquisition is being conducted under the authority of 10 U.S.C. 3204(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1 - Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority

This is a follow-on acquisition from a previously awarded sole source purchase order, N0017421P0126. Computed Topography x-ray systems are used for Non-Destructive testing for various Energetic programs across NSWC IHD.

Preventive maintenance is required for the system to remain in working order and to preclude any system failure that would result in a work stoppage.

The United States Navy Radiation Safety program requires maintenance on radiation-producing equipment to be conducted by the Original Equipment Manufacturer (OEM) or an authorized OEM representative. NSI is the OEM of the proprietary software and owns the data rights/controlled drawings to the NSI system. NSI does not authorize others to work on its equipment. Any work performed by other than the OEM would void all support and warranties from the OEM. As NSI is the OEM of the equipment, NSI is the only source that can meet the Government’s requirement without impacting operational readiness.

If one (1) of the Computed Tomography Cabinet X-Ray systems is degraded to the point of requiring a replacement, it would cost the government approximately to replace just a single (1) unit, and an expected loss of capabilities for an estimated period of 16 to 20 months, causing an unacceptable delay in fulfilling the Government’s requirements. In addition, the government’s investment in this equipment, valued at over , would be lost were the equipment to become inoperable. If system problems arose in the future and an unauthorized provider had been used to maintain these instruments, NSI could decline to honor warranties or refuse to service the equipment altogether.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

To further broaden market research and to satisfy the requirements of DFARS PGI 206.302-1(d), a Sources Sought notice was posted on SAM.gov website on 9 February 2026. One response was received from BHPE, LLC. The response did not provide capability statement information specific to the posting; therefore, the vendor was deemed not capable. Upon further review of the NAICS code, it was determined by the Contracting Officer that the sources sought notice required revision and an updated post with a revised NAICS code that was better suited for the requirement was issued. The sources sought notice was updated on SAM.gov website on 4 March 2026. One response was received by The Remi Group, LLC, which technical reviewers determined not technically capable of meeting the requirement, given that they are not the OEM and thus, are not authorized to work on the CT systems.

Further, as required by FAR 5.203, a pre-solicitation notice was publicized on the SAM.gov website on 20 March 2026; no responses were received in response to the synopsis.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the services and supplies as needed, covered by the J&A, will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For reasons set forth in Paragraph 5, Rationale Justifying Use of Cited Statutory Authority, NSWC IHD Contracts Department has no plans at this time to compete future contracts for the type of service covered by this document.

If another potential source emerges for this comprehensive requirement, NSWC IHD Contracts Department will assess whether competition for future requirements is feasible.

As this is a follow-on for services previously awarded on a non-competitive basis, in accordance with DFARS 206.104-71, the prior Sole Source Justification for Requirements (Form

45) was provided to the approval authority for review.

Approval of this J&A signifies the approval authority has made the determination required by DFARS 206.104-72.
