About this file

This document is a Limited Source Justification (J&A) for a modification to Blanket Purchase Agreement (BPA) contract HC101317A0005, known as CSS0069, for continued Inmarsat Broadband Global Area Network (BGAN), Fleet Broadband (FBB), and Swift Broadband (SBB) services utilizing BGAN Secure Terrestrial Access (BSTA).

The J&A approves a ceiling increase of to the BPA in order to extend services for approximately 700 end-users for an additional 3 months until the follow-on BPA, CSS0101 (HC101324A0002), is awarded on March 11, 2024. A subsequent modification extends the BPA an additional 5 months through November 30, 2024 to allow time to transition the remaining 499 active orders to the new BPA without service disruption. The incumbent contractor, Satcom Direct Government, Inc., is the sole source provider that can fulfill this requirement without risk of a break in service. Funding will be obligated at the order level using Defense Working Capital Funds.

2. NATURE/DESCRIPTION OF ACTION(S):

Swift Broadband (SBB) through BGAN Secure Terrestrial Access (BSTA) Blanket Purchase

Page 2 of 8 Pages

ORIGINAL: The nature of this action is to procure continued critical communications in support of the U.S. Army via the ceiling increase and three-month optional extension for both the BPA (HC101317A0005, tracked as CSS0069 and issued under GSA Multiple Award Schedule Contract GS-35F-0221R) and all active orders currently in place under the BSTA BPA. The current BPA bridge expires March 31, 2024, with the additional three-month optional extension available until June 30, 2024. The optional three-month extension will be exercised because the follow-on contract was awarded March 11, 2024, and all existing task orders must be transitioned or discontinued. This action will increase the ceiling value of this BPA by

. The ceiling value increase and exercise of the optional three-month extension will allow for time to transition services from the current contract HC101317A0005, tracked as CSS0069, to the follow-on BPA, without loss of end-user coverage. The estimated price of this extension is . Funding will be obligated at the order level utilizing the appropriate fiscal year Defense Working Capital Funds. This action will ensure continued service for approximately 700 end-users during the solicitation of the new Inmarsat BSTA BPA and transition of currently active orders.

MOD 01: The current BPA expires June 30, 2024, and there is an urgent need to continue services. An additional bridge modification will be issued to ensure continued service for BPA orders for five months. The estimated price of the original extension period (July 1, 2023 through June 30, 2024) was which increased the BPA ceiling amount from

Contract modification P00022 subsequently increased the BPA ceiling amount by . The estimated price of the MOD 01 extension period (July 1, 2024 through November 30, 2024) is which is within the existing contract ceiling amount (no additional ceiling is requested for the bridge action). Funding will continue to be obligated at the order level utilizing the appropriate fiscal year Defense Working Capital Funds. This bridge supports the remaining 499 individual BSTA BGAN, SBB & FBB orders and will ensure no service interruption while providing these mission partners sufficient time to transition services to the new BPA.

3. DESCRIPTION OF SUPPLIES/SERVICES:

ORIGINAL: This BPA ceiling increase will provide continued BGAN, FBB, and SBB services utilizing BSTA for existing orders in support of the U.S. Army and other designated end users.

The requirement allows continuation of critical, real-time communications in support of warfighter missions and deployed units in all regions of the globe until such time as the existing orders can be transitioned to the competitively solicited follow-on BPA. The ceiling increase will coincide with the three-month optional extension. The optional three-month extension will be exercised because the follow-on contract was awarded March 11, 2024, and all existing task orders must be transitioned or discontinued.

The estimated price of this ceiling increase is . Updates to the estimated lifecycle cost of are outlined below:

Base Period: April 1, 2017 – March 31, 2018

Option Period 1: April 1, 2018 – March 31, 2019

Page 4 of 8 Pages

MOD 01: The predecessor Inmarsat BSTA BPA, HC101317A0005, is scheduled to expire June 30, 2024. The follow-on BPA, HC101324A0002, has been competitively awarded to contractor Inmarsat Government, Inc. Since the award of HC101324A0002, 108 of the 607 then-active orders under HC101317A0005 have been discontinued or transitioned to the new BPA. SSC CSCO and U.S. Army PEO- C3T have continued to contact mission partners to request the services be discontinued or transitioned. To avoid a lapse in critical communications services and to allow time to transition or discontinue the 499 remaining orders, this modification will extend the BPA and 499 still active orders an additional five months, through November 30, 2024.

(c) Justification:

(1) Minimum Government requirements.

The combined services of Inmarsat BGAN, FBB, and SBB utilizing BSTA to provide the U.S. Army and other designated end users with critical, real-time information and services needed to support missions throughout the world.

The requiring agency currently relies on the BSTA BPA to support distributed Global Rapid Response Information Package (GRRIP) kits. GRRIP kits provide classified and unclassified communications to forces operating in austere and demanding environments where access to the network equipment and infrastructure of established forward operating bases is unavailable. The Government requires continued access and use of the BSTA BPA without loss of service to ensure their end-users have access to the required capabilities to operate in these environments. Failure to award this ceiling increase for existing orders could cause a lapse in service, risking severe mission degradation or failure.

The Government requires a ceiling increase for the active Inmarsat BSTA services (BGAN, FBB, and SBB) that are specifically routed through the BSTA Access Point Name (APN) to avoid a loss of service to approximately 700 end users on the current BPA, HC101317A0005. The Government’s existing need is to continue services to those end-users through the active orders against the current BPA. If the current active orders exceed the ceiling amount, end-users will not have their secure mobile communications available until all services (approximately 700 orders) can be transitioned to the new BPA (CSS0101 – HC101324A0002). The Inmarsat services under this BPA include dynamic internet-protocol (IP), voice, video, data, streaming, and messaging in all regions of the globe (e.g., Europe, Middle East/Africa, Americas, and Asia/Pacific), except for polar regions (75 degrees north latitude and 75 degrees south latitude), and the services are compatible with the existing BSTA network. This ceiling increase will allow time to transition orders to avoid a loss of critical communications to end users.

(2) Proposed sole source contractor.

Page 5 of 8 Pages

ORIGINAL: The proposed sole source contractor is Satcom Direct Government, Inc.

(previously Satcom Direct Communications, Inc.). Due to the requirement for critical communications to continue beyond the current March 31, 2024, expiration of HC101317A0005. Satcom Direct is the only source that can fulfill this requirement without risk of a break in service/support to end users.

MOD 01: Satcom Direct is the predecessor contractor and thus remains the only source that can meet the Government’s service requirements without service interruption during the BPA transition period. Due to the requirement for critical communications to continue beyond the June 30, 2024, expiration of HC101317A0005, the predecessor contractor, Satcom Direct, is the only source that can fulfill this requirement without risk of a break in service/support to end users.

(3) Discussion regarding cause of the limited source situation.

ORIGINAL: The Space Systems Command (SSC) Commercial Satellite Communications Office (CSCO) began working the follow-on acquisition for HC101317A0005 25 months prior to the current BPA expiration. Due to various unforeseen delays in the acquisition and evolving mission requirements, the award of the follow-on BPA was completed on March 11, 2024. As a result, the Government requires an extension of HC101317A0005 to bridge services between the predecessor BPA and the follow-on BPA to avoid loss of service to approximately 700 end users who rely on the current BPA for mission-critical communications.

MOD 01: Since the award of HC101324A0002, 108 (17.8%) of the 607 then-active orders have been discontinued or transitioned. The Government requires extension of HC101317A0005 to bridge services between the predecessor BPA and the follow-on BPA. The predecessor BPA is supported by Satcom Direct and the follow-on BPA was competitively awarded to Inmarsat Government.

(4) Demonstration of limited source.

ORIGINAL: Satcom Direct, the current Inmarsat BSTA BPA holder, is uniquely postured to support the DoD’s active satellite communications services without risk to critical communications. As indicated in 4(b) above, Satcom Direct understands the requirements and possesses the requisite expertise and relevant experience. Active services will be transitioned to the follow-on BPA (CSS0101), which was competitively solicited on September 30, 2022, and awarded on March 11, 2024.

Therefore, making provisioning of services by any contractor other than Satcom Direct a duplicative transition of services and would not meet the Government’s need for continuation of the approximately 700 active orders on the current BPA. Satcom Direct is the only vendor with the requisite expertise and relevant experience to continue performance of the approximately 700 active orders necessary to support users that require secure mobile communications without loss of service for the next three months.

Page 6 of 8 Pages

MOD 01: Satcom Direct, as the predecessor BPA contractor, remains uniquely postured to support the DoD’s active satellite communications services without risk to critical communications. Active services are slated to be discontinued or transitioned to HC101324A0002 during the extension period, but this is contingent on mission partner approval of requests to discontinue or transition services. SSC CSCO and U.S. Army PEO-C3T continue performing customer outreach to minimize required extensions of HC101317A0005.

(5) Procurement discussion.

This action will increase the ceiling amount for current services, originally placed against a competitively awarded BPA, until the services provided via all active orders can be transitioned to the new BPA (CSS0101 – HC101324A0002). Upon award and transition of all active orders to the follow-on BPA, HC101317A0005 will be allowed to expire.

(6) Impact.

Failure to maintain the existing/active communications services provided by Satcom Direct until transitioned to the new BPA would result in loss of mission-critical communications for hundreds of end users around the world. Should these services not be continued due to ceiling limitations, critical communications in support of warfighter missions and deployed units in all regions of the globe would be interrupted, resulting in unacceptable risk.

5. BEST VALUE DETERMINATION:

This requirement is for Commercial Satellite Communication (COMSATCOM) services for the DoD. COMSATCOM services must be acquired using one of the Future COMSATCOM Services Acquisition (FCSA) contract vehicles, IAW the Acquisition Strategy for FCSA and the subsequent approval by the Director, Defense Procurement and Acquisition Policy (approved Memo dated July 22, 2009). GSA has already determined that prices of supplies, fixed price services, and rates for services offered at hourly rates are fair and reasonable for the purpose of establishing the schedule contract. In addition, the pricing in place on the existing BPA (HC101317A0005) was evaluated and determined fair and reasonable prior to award of the BPA using the proposal analysis techniques in FAR 15.404-1. The proposed ceiling increase pricing will be analyzed via a comparison to the Independent Government Cost Estimate, to pricing currently in effect for HC101317A0005, and will ensure GSA Schedule rates have not been exceeded. By placing an order against a schedule contract using the procedures in FAR Part 8, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. A further determination will be made by the Contracting Officer that the ceiling increase represents the best value to the Government by conducting a price analysis as part of a fair and reasonable price determination.

6. MARKET RESEARCH:

The ceiling increase is to HC101317A0005 is to coincide with the three-month optional extension. The ceiling increase and exercise of the three-month optional extension will ensure end-users maintain necessary secure mobile communications and do not encounter a loss in service until services can be transitioned to the new BPA (CSS0101 – HC101324A0002). Market research was conducted from March 2021 through July 2022 in advance of the solicitation for CSS0101, and this research reflects three GSA MAS schedule contractors with sufficient offerings to meet the Government’s requirements for the follow-on BPA. CSS0101 was solicited among GSA MAS 517410 schedule holders on a competitive basis, with an approved limited source justification (JA22-064) due to the requirement that the awardee be an authorized seller of BSTA services. For this ceiling increase only the incumbent, Satcom Direct Government, Inc., a large business, can continue to provide the required services without a significant break in service for end users.

7. ANY OTHER SUPPORTING FACTS:

Not applicable.

8. ACTIONS THE AGENCY MAY TAKE TO REMOVE BARRIERS THAT LED TO THE

RESTRICTED CONSIDERATION:

Procurement history: HC101317A0005 was competed amongst GSA MAS holders under Special Item Number (SIN) 132-55, and this competition was open to all schedule contractors in this SIN. A Limited Source Justification applied, referencing the requirement for a “brand name” use of the proprietary BSTA APN and IP address. Quotations were received from four schedule contractors. Satcom Direct, a large business, was awarded the BPA on March 28, 2017, with a period of performance consisting of a 1-year base period, four 1-year option periods, and a 6-month option period IAW FAR 52.217-8 (expired September 30, 2022). An additional 6-month bridge with a 3-month option period was awarded to extend contract expiration to June 30, 2023.

An additional 9-month bridge with a 3-month optional period was awarded to extend contract expiration to June 30, 2024.

All services currently active under HC101317A0005 will be transitioned to the competitively awarded follow-on BPA (CSS0101 – HC101324A0002) awarded March 11, 2024, and no new orders will be issued under HC101317A0005. Upon completion of transition or the bridge extension, HC101317A0005 will expire. Future similar BPAs are anticipated to be awarded on a competitive basis.
