COMBINED SYNOPSIS/SOLICITATION

Military Sealift Command Combined Synopsis and Solicitation Notice Information

1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

2. Solicitation number is N3220522Q0091 and is being issued as a Request for Quotes (RFQ).

3. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) FAC 2022-02/ 14 January 2022 located on https://www.acquisition.gov.

Servicing HYSTER and BIG JOE forklifts in accordance with the statement of work below. The service is for Materials Handling Equipment (MHE) service and support to include repairs, services, and/or brand name OEM materials, and certification for USNS COMFORT. Service will include all labor travel and materials.

6. Statement of Work

1. Statement of Work (SOW): The following work items shall be accomplished by the selected service provider (contractor) in conjunction with this repair and maintenance requirement. The Government intends to award a Fixed Price Contract to the selected service provider:

a. Services to MHE identified in Table 1 below shall be performed ashore (or on board ships name) at the customer activity location. The Contractor’s quote shall specify the proposed location of the service and provide a summary of the proposed process for training, maintenance, repairs, and safety recertification.

b. Contractor shall perform all related pre – post inspections, of MHE identified in Table 1 in accordance with the requirements set forth in references (a) and (b), attachments 1 through 3 (CDRL’s), and appropriate vehicle technical manuals.

c. Scope of Diesel Forklift Repair work includes:

PERFORM DIAGNOSTICS

Perform diagnostic service utilizing dashboard display, and – when required - Hyster approved and authorized Off-Board Laptop Diagnostic Troubleshooting Software, hardware, and diagnostic procedures.

Make sure speed is set at 5MPH

PERFORM VISUAL INSPECTION

Perform a complete inspection of the vehicle to include, but not be limited to, the following:

-Fluid Leaks -Carriage, including Rollers and Slider Blocks -Forks and Locks -Mast Chains, Retainers, and Anchors -Tire Condition -Steering Components -Overhead Guard -Improper Modifications -Seat Condition and Belts -Attachments, including Towing Devices

d. Scope of Electric Forklift repair work includes:

-Re-Torque Drive and Steer Wheel Nuts -Evacuate Front and Rear Brake Systems; Replace Fluid with DOT 3 Brake Fluid, or per Tech Manual.

-Check and Adjust Rear Brake Master Cylinder, Actuator Cable, Pivot Mechanism, Brake Lines, and Associated Hardware; Repair as required.

-Adjust Parking Brake and Linkage; Repair as required.

-Check and Adjust Plugging Distances -Adjust Steering Linkage; Repair as required -Raise Rear of Vehicle and Manually Test Rear Brake Operation (with brake pedal pressed).

-Re-Adjust all Brakes, as required -Perform Basic Corrosion Control Utilizing Wire Brush and Spot Paint Techniques.

-Remove, and inspect the counterweight, mounting bolt, for rust, corrosion, worn threads and threaded base plate surface. Re-install the counterweight, and mounting bolts that are within SAE standards, and re-torque the counterweight bolts to 410 foot pounds, or replace the bolts, and re-thread the base plates that fail the visual inspection, as required.

e. Big Joe Pallet Stackers -Verify Stencils/Markings Per NAVSUP P-538 and Re-Stencil/Re-Mark as needed -All Hydraulic Lines, Hoses, and Fittings (change if needed) -Perform Basic Corrosion Control Utilizing Wire Brush and Spot Paint Techniques -Brakes and Brake Linkages -Lubricate / inspected all wheels (changed if needed) -Panel Power Connections -Check Wire Connections and Condition -Clean Battery Cable and Connections -Other Electrical Components, as Installed

e. SCOPE OF PERIODIC MAINTENANCE INSPECTION AND SERVICE AERIAL WORK PLATFORMS (AWP)

The Contractor shall inspect the platform's structural components for obvious physical damage, such as cracking, bending and deformation of members or welds. The Contractor shall also inspect the paint for cracking or flaking.

The Contractor shall inspect the entire platform for missing or loose bolts, nuts, brackets or supports.

The Contractor shall inspect the condition of the tires. The Contractor shall ensure proper inflation and verify tread is not damaged or cut.

The Contractor shall inspect all hydraulic lines for any possible loose connections and/or damaged fittings or hoses.

The Contractor shall inspect all hydraulic lines, reservoir, fuel tank, engine and gearbox for leaks.

The Contractor shall inspect the tank for any possible damage and verify the level of hydraulic fluid. Level should be midway between 3/4 and full with the boom in the fully lowered and retracted position.

The Contractor shall inspect for broken, missing, inoperable or non-calibrated gauges, indicators and warning lights.

The Contractor shall rotate basket to the left and to the right, in order to verify the freedom of movement of the Basket.

The Contractor shall rotate the steering wheel to the left and to the right. Move aerial platform forward and aft a few feet. Ensure movements are smooth and properly operational.

The Contractor shall at the ground control console, position selector switch to "Ground". Turn ignition switch and start engine. Test all functions and verify proper operation.

The Contractor shall after starting engine, listen and note any unusual noises, check for any fluid leaks, loss of power, or poor response to controls. Verify the proper operation and correct readings of all gauges and indicators. Verify that the battery is charging.

The Contractor shall after the initial warm-up (5 minutes), perform engine turn off at the ground control console.

The Contractor shall Reposition the Aerial/Ground selector switch to "Aerial". Place ignition switches to ON position and start engine from aerial platform. After Starting the engine the Contractor shall verify proper operation of the following controls: Boom Up/Down, Rotation CW/CCW, Platform Rotation, Boom Out/In, Drive FWD/ Reverse, Throttle High/Low and Platform Tilt.

The Contractor shall raise and lower boom checking for freedom of movement. Extend and retract boom, and check freedom of travel. Swing boom to left and right, and check for freedom of movement.

The Contractor shall shutdown the engine using each of the emergency stop switches. Verify entire system shuts down.

The Contractor shall after shutting engine off using one of the emergency stop switches, start emergency motor driven hydraulic pump and operate at least one function to verify emergency hydraulic pump is working.

The Contractor shall manually operate the off level warning device so the audible alarm can be heard, indicating the level system is functional.

The Contractor shall place the rated load on platform, lift the platform to full extension, hold for two minutes, and verify that no drifting or leaking occurs. Contractor shall then fully extend the boom to each side to test vehicle stability.

The Contractor shall perform period maintenance requirements identified in the applicable manufacturer Technical Manual.

The Contractor shall fill out and sign the attached Aerial Work Platform (AWP) Safety Inspection and Weight Test Certification. The original signed form shall be provided to the ship's Master or his designated representative. A copy of the signed form shall be provided to the MSC Norfolk MHE Program Management office.

f. SCOPE OF BATTERY CHARGER MAINTANANCE Validate battery chargers are configured correctly Clean, inspected and adjust as needed

g. WESLEY Manual Pallet Jacks Verify Stencils/Markings per NAVSUP P-538 and Re-Stencil/Re-Mark as needed All Hydraulic Lines, Hoses, and Fittings (change if needed) Perform Basic Corrosion Control Utilizing Wire Brush and Spot Paint Techniques Brakes and Brake Linkages Lubricate / inspected all wheels (changed if needed)

3. Deliverables:

The contractor shall provide:

a. Contractor shall complete and sign CDRL 0001 Final Inspection form for each unit listed in Table 1. Provide a copy to the MHE Program Support Office at MSC Norfolk upon completion of service.

b. Contractor shall complete and sign CDRL 0002 Fork Inspection form for each unit listed in Table 1. Provide a copy to the MHE Program Support Office at MSC Norfolk upon completion of service.

c. Contractor shall complete and sign CDRL 0003 MHE Safety Certification form for each asset (forklift, side loader, manual pallet jack) listed in Table 1 in accordance with NAVSEA Instruction SW023-AH-WHM-010 reference (a). Provide a copy to the MHE Program Support Office at MSC Norfolk upon completion of service.

d. Contractor shall provide a photo of the forklift data plate to the MHE Program Support Office at MSC Norfolk upon completion of service.

e. Contractor shall coordinate with the technical point of contact to arrange U.S. Government inspection of the MHE/forklifts prior to their return. The inspection will occur on a date mutually agreed upon by the service provider and technical point of contact.

f. Contract must be able to read and understand all items listed on this SOW (Ref 1 - 2 and attachments 1 - 3).

g. If additional repair action are needed, YOU MUST contact N10 contract specialist (MSC government representative) for approval prior to completing. Additional work must be submitted on condition found report within 10 days of receipt.

4. Qualifications: The selected service provider/contractor must meet the following qualifications.

a. All management and technical personnel performing above listed services must be able to demonstrate the following:

- Experience performing safety certifications on shipboard-approved MHE in accordance with the requirements set forth in the NAVSEA SW023-AH-WHM-010, NAVSUP PUB 538, and equipment technical manuals.
- Experience interpreting, trouble-shooting, and resetting HYSTER on-board dash displays.
- Access to HYSTER proprietary hardware and software required to reset onboard electronics.
- Able to read and understand the Technical Exhibits and meet all requirement.

b. Contractor shall staff and equip the service with the capability to perform all actions without assistance from MSC personnel.

c. Contractor must have access to technical and diagnostic manuals applicable to the equipment being serviced.

d. Contractor shall have the ability to change/press tires using existing location tire press (if available) and/or obtain alternate services relative to satisfying the MHE asset requirement. If contractor is performing fly in service – service provide is not responsible for changing / press tires due to time restraints.

e. Contractor must be able to perform the required services within the Period of Performance (POP) identified in this Statement of Work document. If additional work is identified, and approved by the Government, the Contractor must have the ability to complete the additional service work by close of the requested POP as well.

f. Contractor shall complete a security form for each employee that will be servicing MHE onboard government installations and submit the information (including, but not limited to name, social security number, and birth date) to Military Sealift Command (MSC)/MSC Security Officer, as requested. The Government will provide approval for personnel to access base installation locations for a pre-determined timeframe (up to one year), as appropriate.

g. Contractor personnel performing maintenance and repairs onboard MSC vessels or affiliated shore activities shall abide by all DOD, Navy, MSC security requirements and clearance procedures required to access U.S. Government facilities and/or MSC customer locations.

7. Services Contract Reporting (SCR):

Services Contract Reporting (SCR) requirements apply to this contract. The contractor shall report required SCR data fields using the SCR section of the System for Award Management (SAM) at following web address: https://sam.gov/SAM/

7. The provision at FAR 52.212-1, Instructions to Offerors – Commercial applies to this acquisition and is incorporated by reference. The provision is amended as follows:

52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS

a. Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.

b. After receipt of quotes the Government may, with or without notice, negotiate with and, if desired, seek quote revisions from as many or as few quoters as it, in its discretion, deems appropriate.

c. The term “offeror” or “offer” as used in FAR 52.212-1 shall be understood to mean “quoter” and “quote,” respectively. Further, the term “award” shall be understood to describe the Government’s issuance of an order.

d. The Government will consider all quotes that are timely received and may consider late quotes. Failure of a quote to address any items required in the submission package may make a quote unacceptable.

e. Paragraph (b) of FAR Provision 52.212-1, Submission of Offers, is amended as follows:

In addition to the quote submission requirements stated in FAR provision 52.212-1, quoters shall provide the following, as part of the quote submission package, no later than the required time and date for quote submission:
Responsible sources shall provide the following:

1. Price quote which identifies the requested item(s), unit price inclusive of shipping (if any), and extended price.

2. Total Firm Fixed price.

3. Price quotes shall be accompanied by the vendor’s published labor rates.

4. Any Discount Terms

5. Estimated time of delivery

6. Technical Submission Requirements

a. For Parts/Supply buy, the quote shall contain a description including part number and title for each item listed in the solicitation to allow the Government to verify that the quoted parts match the requirements listed in the requirements schedule. Brand Name/OEM parts shall be used for this service.

b. Quote shall contain ALL material, labor and travel to complete the entire service requirement without contract modification in as much as possible.

c. It is strongly encouraged that prospective offerors comply with FAR 52.237-1 Site Visit to determine what material is required prior to submitting a quote. Points of contact are in Paragraph 5 of the SOW.

d. Quote must contain proof that the vendors have the experience and capability as specified in paragraph 4 of the statement of work above. Failure to provide proof will be considered non-compliant and will be deemed non-responsive.

7. Responses to the solicitation are due 7 Feb 2022 @ 1200 noon, Norfolk, VA time. Quotes may be e-mailed to Lauren Farmer, lauren.a.farmer2.civ@us.navy.mil and James Van Natta, james.m.vannatta.civ@us.navy.mil. Please be sure to copy both parties with your quote. To be considered timely, an E-mail quote must be received in its entirety in the designated E-mail inbox by the due date and time for quote submission. Quotes received after that time will be considered at the Government’s sole discretion. Please reference the solicitation number on your quote.

8. Provision 52.212-2 Evaluation—Commercial Items (Oct 2014) applies to this acquisition.

(a) The Government may award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) technical capability of the item offered to meet the Government requirement;

(ii) price;

Award shall be made to the lowest priced technically acceptable offeror in LPTA solicitations.

To be considered a technically acceptable solution for a parts procurement, the quoted parts shall meet the solicitation requirements including required parts, delivery dates, and terms and conditions stated in the solicitation.

To be considered a technically acceptable solution for a service, the quoted service shall meet the solicitation requirements including terms and conditions stated in the solicitation. The quote shall state that all aspects of the technical requirement, including required delivery date and part numbers, can be met. The offeror’s quote shall not contain terms and conditions.

The Government will evaluate quoted pricing for reasonableness utilizing techniques described in FAR 13.106-3.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror by the Government within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision— “Covered telecommunications equipment or services”, “critical technology”, and “substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that it □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer—

(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number,…
