It is the sole responsibility of the contractor to identify in their quotation any exceptions to the terms and conditions of the solicitation. Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the proposed price.

(End of provision)
Provision 52.212-2, Evaluation-Commercial Products and Commercial Services applies to this procurement. The evaluation criteria included in paragraph (a) of the provision are as follows:
EVALUATION CRITERIA
Basis of Award:
The Government intends to award a single purchase order (PO) from this solicitation using simplified acquisitions procedures in accordance with FAR part 13.5. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotes. NIST reserves the right to request revised quotes from, or negotiate final contract terms with, one or more, but not all, Contractors if later determined by the Contracting Officer to be necessary.
Evaluation Factors:
The Government will award a firm fixed price and time and materials purchase order resulting from this solicitation once the Contractor is verified as responsible and the quotation is determined to best meet the needs of the Government after consideration of all factors-- i.e., provides the “best value.” Accordingly, the Government may award the PO to other than the lowest priced Quoter or other than the highest technically rated Quoter. All non-price factors, when combined, are significantly more important than price. The Government is more concerned with obtaining superior technical performance capability (represented by the non-price evaluation factors) than with making an award at the lowest overall evaluated price.
Technical Capability: Evaluation of technical capability shall be based on the information provided in the quotation Volume I. NIST will evaluate whether the offeror has demonstrated that its proposed services meet all minimum requirements. Quotations that do not demonstrate the proposed services meet all requirements will not be considered further for award. If an offeror does not indicate whether its proposed services meet a certain minimum requirement, NIST will determine that it does not.
Stronger consideration will be given to vendors that self-perform all of the requirements under the SOW.
Past Performance:
In assessing the offeror's past performance information, NIST will evaluate, as appropriate, (a) successful performance of contract requirements, (b) quality and timeliness of delivery of services, (c) communications between contracting parties, (d) proactive management and customer satisfaction.
Evaluation of this factor will be based on information contained in Volume II, CPARS, and information provided by references. The Government will evaluate past performance information by contacting appropriate references, including NIST references, if applicable. The Government may also consider other available information in evaluating the Offeror’s past performance. Offerors without relevant past performance information will not be rated as favorable or unfavorable.
Experience:
The Government will evaluate the degree to which an offeror has performed similar work in a safe manner based on the offeror’s responses to the posted questions in Volume III. NIST will give higher preference to offerors who can demonstrate how they will provide and maintain a safe work environment through objective measures.
Price: The Government will evaluate price for reasonableness. The evaluation will determine whether the proposed prices are reasonable in relation to the solicitation requirements. A price realism analysis will not be conducted. Prices must be proportionate with the technical portion of the quotation.
(End of provision)
