Court Services and Offender Supervision Agency requires the services of a contractor to provide personnel, supervision, labor, materials, and supplies necessary to provide in-patient Substance Abuse Detoxification Services, or "Clinically Managed & Medically Monitored Detoxification Services" (3-10 days). Rates include Facilities, Toiletries, Food (3 meals/day),Personnel, Materials, Linen, and Operating Costs. Each daily rate is for 24 hours.

The base period performance is 12 months, with 4 one-year options.

Base Period will be SEP 1, 2014 - AUG 31, 2015.

The contract type contemplated is Firm Fixed Price Daily Rate, Level of Effort.

A.3 PRICE/COST SCHEDULE DETAILS

1.1 The Contractor shall provide a unit (PER DAY) cost listing for each of the services covered. The total for all the units shall reflect the total daily cost for the following Substance Abuse Treatment Services:

Clinically Managed and Medically Monitored Detoxification Services – 3-10 Days (CLIN 0001) Treatment Plan

1.2 The Government will pay monthly for the amount of days that the contractor has provided services (and beds as appropriate) for offenders. The contractor’s fixed daily rate is as listed above in the price/cost schedule. If additional daily services are required, the Government will pay for the additional days it requires via contract modification.

1.3 The Contracting Officer’s Representative (COR) will issue a referral letter to the Contractor that provides the offender’s name, police department identification number, the admission and discharge dates; the length of stay and the confirmation of arrival. The letter will indicate the number of days required and contract CLIN. [Please see ATTACHMENT A PWS - PWS Attachment 1, Referral Package/Billing

1.4 Although the Contractor may receive a referral for a number of treatment days, if the offender does not complete the program, the Government will only pay for the days in which the services were delivered accounting for such situations as early terminations, abscondances or no-shows.

1.5 A summary of the placements made by the Government from fiscal years 2008 – 2013 is identified in ATTACHMENT A PWS – PWS Attachment 9 (Clinically Managed and Medically Monitored Detoxification Treatment).

1.6 PLEASE NOTE: The Government reserves the right to include other CLINs for other Treatment solicitation CLINs. Should a vendor fail, or otherwise become incapacitated as a vendor, their work may be added to other Treatment contracts. The CSOSA Treatment contracts are for: Halfway Back Residential, Dual Diagnosis Residential Treatment, Residential Treatment (Short Term, Long Term, and Long Term Women with Children), Supervised Transitional Housing, Medically Monitored Detoxification Services, and Outpatient and Outpatient Traffic Alcohol Program (6 overall).

ADDENDUM TO INSTRUCTIONS TO OFFERORS

IF the following provisions or instructions conflict with 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (JUL 2013), then the following provisions or instructions take precedence.

A.4 INTRODUCTORY TEXT

The resulting contract(s) will be for multiple years (a base plus 4 one-year options) and will be Firm-Fixed Price per Daily Rate, Level of Effort for these commercial services. All services and supplies shall be conducted in accordance with the PWS. The submitted Offer must follow all format and content requirements of this section to be considered for award. The successful Offeror will be determined on the Lowest Price Technically Acceptable (LPTA) basis.

1. This acquisition is subject to the requirement of the FAR 4.1102 (a)—System for Award Management.

Interested vendors must be registered in the System for Award Management (SAM www.sam.gov) to be considered as potential source, on the day of proposal submission.

2. The Offeror must also submit all the “Items Required in the Checklist for Responding to the Solicitation” (see below).

3. PLEASE NOTE: The Government reserves the right to include other CLINs for other Treatment solicitation CLINs. Should a vendor fail, or otherwise become incapacitated as a vendor, their work may be added to other Treatment contracts. The CSOSA Treatment contracts are for:

A.5 SUBMISSION OF QUOTES

1. The Offeror shall submit their proposal by the date and time indicated in the solicitation to Maile Parker, Contracting Officer. The Offeror’s proposal shall include one electronic copy (CD disk), the original and three copies of the proposal. Each proposal shall consist of three (3) sections. The sections are:

I -Technical, II - Past Performance, and III - Price. Each section should be separately bound.

2. Quote File. Offeror’s responses shall be submitted in accordance with the following instructions:

a. Format. The submission shall be clearly indexed and logically assembled, including a separate tab for each evaluation criteria subfactor. Each section shall be clearly identified. All pages of each volume shall be appropriately numbered. The Table below indicates the maximum page count (when applicable) for each section of the Offeror’s proposal. All electronic files on the CD will be submitted as a Microsoft Word (.doc/.docx), Microsoft Excel (.xls/.xlsx) file, or an Acrobat (.pdf) file. For the hard copies, font size shall be clear, readable, and business-appropriate (Times New Roman, Calibri, Arial, etc.). Tables and illustrations may use a reduced font size, but must be readable under 100% zoom view. Minimum font size is 11 points. Resumes may be no longer than 3 pages.

b. Content Requirements. All information shall be confined to the appropriate section. The Offeror shall confine submissions to essential matters, sufficient to define the proposal and provide an adequate basis for evaluation. Offerors are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of each proposal. Page limitations are not applicable to this procurement.

The titles and page limits requirements for each file are shown in the Table below:

(i) Section I – TECHNICAL FACTOR. Offerors shall propose a detailed approach that addresses the work required by the PWS. Please read carefully the technical criteria below.

Relocation/Contingency Plan - This relocation shall be at the Offeror’s expense. This would be necessary if the facilities fell below accepted standards or some other unsuitability issue.

(ii) Section II – PAST PERFORMANCE FACTOR. Offerors shall submit a list of at least three (3) contracts (prime contracts or task/delivery orders) in performance at any point during the three [3] years prior to the proposal submission date or ongoing contracts, which are relevant to the efforts required by this solicitation. In addition, Offerors may include in this section copies of CPRS (Contractor Performance Reporting System) reports from the Federal Government database that have been approved by a federal Contracting Officer. This volume shall be organized into the following subsections:

(2) Past Performance. Please submit at least 3 past performances using ATTACHMENT B – Past Performance Questionnaire, of this solicitation. Offerors shall provide a specific narrative explanation of each contract listed in Section II describing the objectives achieved and detailing how the effort is relevant to the requirements of this solicitation. For any contract(s)/task order(s) that did not/do not meet original schedule or technical performance requirements, provide a brief explanation of the reason(s) for the shortcoming(s) and any corrective action(s) taken to avoid recurrence. The Offerors shall indicate if any of the contracts listed were terminated and the type and reasons for termination.

(iii) Section III – PRICE FACTOR. The Offeror shall propose a price for all functional areas within the schedule. The Offeror shall also provide a total annual Firm Fixed Price that combines all requirements, as well as an overall Firm Fixed Price that includes all option years.

Offerors shall breakdown all cost factors and explain how the fixed price was arrived at for each line item.

(1) The Contracting Officer must be able to understand how the fixed daily rate was arrived at, including labor, materials, fringe benefits, indirect costs, equipment, facilities, etc., and including the overhead rates applied to each daily rate.

(2) Offerors must clearly list the percent rate of indirect rates and benefits used.

(3) Offerors must clearly state the number of hours proposed for a full time person.

(4) Work break down structure for all costs proposed must be provided.

(5) Any assumed supply costs or additional labor costs, where necessary, shall be stated.

(6) Any consultant or subcontracting costs must be provided to the Contracting Officer. Subcontracting costs may be submitted separately, before the solicitation due date, to the Contracting Officer stating the requisition number.

(7) Specifically, the breakdown shall include the formula(ae) used to burden the base daily rate (e.g., overhead, general & administrative (G&A) and profit).

(8) A one-page narrative of any applied presumptions in calculating the Contract Line Item pricing is required. If there are no additional presumptions than what is stated in the pricing data, an offeror must state that on the one-page narrative.

(9) The rate of escalation used to price the Option Periods must be included in the pricing data.

(10) The Government expects the number of hours to fluctuate from year to year.

Failure to provide the above information in a timely manner may be considered non-responsive of an Offeror and may negatively impact their ability to receive a contract award.

Cost and price information may be provided using Offeror’s choice of format OR the format provided in this solicitation document. However, the price proposal must contain essentially the same information as provided in Section A.2 Price/Cost Schedule and provide clear descriptions for all cost and price items listed.

A.6 BASIS OF AWARD

ADDENDUM TO 52.212-1 Instructions to Offerors—Commercial Items

A. BASIS FOR AWARD

The Government will make an award to the lowest price technically acceptable (LPTA) offeror IAW FAR 15.101-2. The evaluation criteria consist of three (3) evaluation factors: Technical Acceptability (with sub-factors), Past Performance, and Price. To receive consideration for award, a rating of “Acceptable” must be achieved for the Technical Acceptability factor and a rating of “Acceptable” for the Past Performance Factor.

A rating of “Unacceptable” for any of the required pass/fail sub-factors under the Technical Acceptability Factor will be cause for an overall “Unacceptable” rating of the Technical Acceptability factor. For each proposal found to be eligible for award, after being named “Acceptable” under both Past Performance and Technical Acceptability, Price will become the determining factor for making the award.

Price proposals will not be rated or scored, however Price Proposals will be evaluated to assess:

1) Completeness: Completeness is evaluated by assessing the level of detail the offeror provides in cost/price information.

2) Reasonableness: Reasonableness is evaluated by assessing the acceptability of the offeror’s methodology used in developing cost/price data. The existence of adequate price competition may support a determination of cost/price reasonableness.

3) Realism: Realism is evaluated by assessing whether the proposed cost/price is compatible with the scope of the requirement and the proposal, and if the proposal reflects a clear understanding of, and compliance, with the solicitation requirements.

The Government intends to award no more than one contract based on initial offers without discussions.

However, if discussions are held in accordance with FAR 15.306(d), written discussions with each Offeror may be held with each Offeror in the competitive range and in accordance with FAR 15.307(b).

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offerors within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Offers shall be considered acceptable by the Offeror for up to 60 days after submission to the Government.

B. EVALUATION CRITERIA - FACTORS AND SUB-FACTORS TO BE EVALUATED

The Government will award one contract resulting from this solicitation to the responsible offeror who is technically acceptable and offers the lowest price. The offeror shall also receive an “Acceptable” rating on past performance in order to be considered for award. The following factors shall be used to evaluate offers:

C. EVALUATION CRITERIA

Factor 1 – Technical Acceptability Offerors shall submit a proposal that demonstrates their business’s ability to meet the Technical Acceptability sub-factors listed below. The Government will evaluate the technical proposals on an “Acceptable (Pass)”/”Unacceptable (Fail)” basis to ensure the offeror’s ability to meet the requirements of the PWS and the solicitation. (See Technical Evaluation Criteria Matrix below)

The Offeror’s technical proposal shall contain narrative explaining or demonstrating the contractor’s approach to meeting the requirements of this solicitation. The narrative shall not be a simple restatement of the solicitation requirements but rather a methodical explanation of how the contractor will meet contract requirements.

2. Proposed Staffing and Personnel Capacity The Offeror shall provide information that will provide the Government with the ability to assess the Offeror’s proposed staffing’s qualifications, experience and suitability. Describes how each proposed person matches the duties and qualifications that are required, via position descriptions, resumes, certifications/licensures, degrees and the work performed. Explains how their experience, and/or qualifications make them a good match for what is required. The Offeror’s proposal shall identify any and all specific labor categories that it plans to use in the performance of each CLIN. Proposed personnel must match at least minimum requirements that are stated in the Statement of Work.

The Psychiatrist/Physician does have minimal acceptable qualifications per the PWS. Qualifications – Certification from the American Society of Addiction Medicine (ASAM) or a minimum of three years of experience treating individuals with substance abuse problems and must possess:

i. A Doctor of Medicine degree (MD) or Doctor of Osteopathy degree (DO) from a medical school accredited by the Association of American Medical Colleges (AAMC) or the American Association of Colleges of Osteopathic Medicine

(AACOM),

ii. At least five calendar years of verifiable experience as a board certified and licensed psychiatrist,

iii. A minimum of three years of verifiable work experience as a board certified and licensed psychiatrist that worked in either a detox residential treatment, public health clinic, or hospital setting and

iv. A current, full and unrestricted license to practice Medicine in the jurisdiction where the services are provided (i.e. place of performance).

OR

In the absence of a psychiatrist, the licensed physician shall possess:

The Clinical Supervisor has acceptable minimal qualifications per the PWS. Offeror must include the required combinations of minimum clinical experience and education degrees or certification. Acceptable only if the combinations listed have been achieved. Copies of certifications and degrees are included in technical proposal.

i. Masters of Arts or Science degree (behavior health discipline preferred); and

ii. Minimum of two (2) years of documented experience as a clinical supervisor in residential substance abuse treatment setting.

In the absence of a MA/MS degree, the clinical supervisor shall possess a:

i. Bachelor of Arts or Science degree (behavior health discipline preferred); and

ii. Minimum of three (3) years of documented experience as a clinical supervisor in a residential substance abuse treat

iii. A Doctor of Medicine degree (MD) or Doctor of Osteopathy degree (DO) from a medical school accredited by the Association of American Medical Colleges (AAMC) or the American Association of Colleges of Osteopathic Medicine (AACOM) and

iv. A current, full and unrestricted license to practice medicine in the jurisdiction where the services are provided (i.e. place of performance).

The Case Manager does have minimal acceptable qualifications per the PWS. Offeror must include the required combinations of minimum clinical experience and education degrees or certification. Acceptable only if the combinations listed have been achieved. Copies of certifications and degrees are included in technical proposal. The minimum qualifications are as follows:

i. Bachelor of Arts or Science degree (behavior health discipline preferred); and

ii. Minimum of two (2) years of documented clinical experience in a residential substance abuse treatment setting.

In the absence of a BA/BS degree, the case manager shall possess a/an:

i. Associate Degree (human services/behavior health discipline preferred); and

ii. Minimum of three (3) years of documented experience as a case manager in a

i. Level two certification as an Addictions Counselor (CAC- II) issued by NAADAC, ICRC or NCC; and ii. Four (4) years of documented experience as a case manager in a

F The Counselor(s) has/ve acceptable qualifications per the PWS. Offeror must include the required combinations of minimum clinical experience and education degrees or certification.

Factor 2 - Past Performance The Past Performance rating will be based on an “Acceptable” / “Unacceptable” basis. The following definitions will be used in evaluating the degree to which the Offeror will satisfactorily provide the required services based on past and current performance records. An Acceptable or Unacceptable rating will be determined as follows:

“Acceptable” - Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will be able to successfully perform the required effort, or the offeror’s performance record is unknown. (See note below).

“Unacceptable”- Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be degrees are included in technical proposal. The minimum qualifications are:

i. level two certification as an Addictions Counselor (CAC- II) or equivalent issued by NAADAC, ICRC or NCC; and

ii. three (3) years of documented experience as a counselor in a residential substance abuse treatment setting.

In the absence of a CAC-II, the counselor shall possess:

i. level one certification as an Addictions Counselor (CAC- I) or Equivalent issued by NAADAC, ICRC or NCC; and

ii. Four (4) years of documented experience as a counselor in a residential substance abuse treatment setting.

G The Offeror’s proposal clearly demonstrates the relationship between past staff experience and the proposed duties and qualifications in the PWS. The Offeror should propose staffs that, taken together, have all the required expertise.

H Plan for interpreter services for Spanish, other languages (if needed), and hearing impaired, as needed. If the awarding of a sub-contract is contingent upon this award, a letter of intent from the proposed subcontractor must be provided.

reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Past Performance Information: The information presented in the Past Performance Questionnaire (ATTACHMENT B – Past Performance) and information obtained from other available sources other than those identified by the Offeror (such as past performance information obtained from Federal, State and local Government agencies, better business bureaus, published media, and electronic data bases available to the Government) will be the basis for evaluation of this factor. It is highly recommended that Offerors use the Past Performance Questionnaire, as attached, and have the evaluators submit it to the Contracting Officer or to reference existing Past Performance Questionnaires already approved and entered in the federal Past Performance database. Reference information on the questionnaires must include the point-of-contact’s name, company name, address, phone number, description of contract or service performed, dollar value of the contract, and period of performance. To be considered “Acceptable” a CPARS past performance must have a score from 18 through 24, and have not received a 0, 1, or 2 score on the subfactors.

At a minimum, the Offerors should provide three relevant references for past performance.

Past Performance Evaluation: The Government will consider the offeror’s previous and current record of contractual performance. The Government assessment will focus on recent contracts that are relevant to the effort required by this solicitation. Recent is defined for this action to be contracts that were awarded and performed within the last three (3) calendar years, from the date of RFQ issuance back. Relevancy to this effort is defined in the following table:

The Government may reject a proposal if it is found that any information that has a negative impact on the offeror’s past performance record has been deleted, misrepresented, or withheld.

It is at the Government’s discretion to determine whether past performance information furnished is or is not considered similar to the size and scope of the present requirement. Should the offeror have no past performance information the Government will assign the neutral rating of “Unknown Confidence” to the offeror, which will be deemed as an “Acceptable” If the offeror has relevant past performance information, but for whatever reason neglects to submit it, the offeror has submitted an incomplete and therefore unacceptable proposal.

Offeror’s are cautioned that, in conducting the past performance assessment, the Government may use data provided in the offeror's proposal and data obtained from other sources. Since the Government may not necessarily interview all of the sources provided by the Offerors, it is incumbent upon the Offerors to explain the relevance of the data provided. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of proving an “acceptable” past performance rests with the offerors.

Offeror’s may provide information on problems encountered on the contracts identified in their past performance submissions and offerors’ corrective actions (FAR 15.305).

Factor 3 - Price The Price Proposal shall be clearly marked “PRICE PROPOSAL, SOLICITATION NO. CSOSA-14-R-0029.” It shall consist of the pricing chart in Section B of the solicitation and state the prices of each CLIN as described therein.

Lowest Price Technically Acceptable (LPTA): After determination of technical acceptability and past performance rating of acceptable, award will be based on the lowest price, technically acceptable proposal:

The lowest price shall be the total of all CLINs’ prices schedules for the base year, plus all option years.

Offer should provide other current contracts and/or grants that the offeror currently manages for the same or similar services.

Options: Offerors shall submit unit pricing for each CLIN in Section A for the base and option years.

Each offeror’s proposed price will be evaluated to determine whether it is fair and reasonable in accordance with FAR 13.106-2 Evaluation of quotations or offers.

If GSA or VA schedule rates are used, please include any discounts for CSOSA and please state what the discount is.

D. Per FAR 52.233-70 PROTEST CONTENT/ALTERNATIVE DISPUTE RESOLUTION (JAN 2008)

(a) Any protest filed by an interested party shall:

(1) Include the name, address, fax number, and telephone number of the protester;

(2) Identify the solicitation and/or contract number;

(3) Include an original signed by the protester or the protester's representative and at least one copy;

(4) Set forth a detailed statement of the legal and factual grounds of the protest, including a description of resulting prejudice to the protester, and provide copies of relevant documents;

(5) Specifically request a ruling of the individual upon whom the protest is served;

(6) State the form of relief requested; and

(7) Provide all information establishing the timeliness of the protest.

(b) Failure to comply with the above may result in dismissal of the protest without further consideration.

(c) Bidders/offerors and contracting officers are encouraged to use alternative dispute resolution (ADR) procedures to resolve protests at any stage in the protest process. If ADR is used, the Government will not furnish any documentation in an ADR proceeding beyond what is allowed by the Federal Acquisition Regulation.

E. CSOSA - AWARD WITHOUT EXCHANGES (SEP 2013)

The Government intends to evaluate proposals and award a contract without exchanges with offerors.

Therefore, each initial offer should contain the Offeror's best terms from a cost or price and technical standpoint. However, the Government reserves the right to conduct exchanges if later determined by the Contracting Officer to be necessary.

F. PROPOSAL SUBMISSION

1) This RFP does not commit the Government to pay any costs incurred in preparation and submission of initial, or any subsequent, proposals or for other costs incurred prior to award of a formal contract.

2) OFFERORS MUST SUBMIT : ONE electronic copy (CD DISK) as well as an original and three copies of each Technical, Past Performance and Price Proposal. Submission Formats are as follows:

H. RELEASE OF INFORMATION

After receipt of proposals and until contract award, source selection information will not be furnished to any offeror. After contract award, proprietary or sensitive source selection information shall not be disclosed in accordance with FAR 3.104-4.

1. BASELINE MANAGEMENT PLAN - Provides a clear description of how the integration of personnel, management model and support services demonstrate an efficient use of offeror’s resources in support of PWS requirements. Fully describes activities involved for each task enumerated in the Performance Work Statement. The plan should also present a clear description of the Offeror’s Security measures of PII, including the use of CSOSA’s secure email system, etc.

A Offeror’s supervision protocol (i.e., levels of accountability and responsibility)/ chain of command is clear and logical.

Accounting System – The funds tracking system proposed maintains current and total expenditures for each offender’s programs. Proposal includes internal controls needed to effectively track and manage funds.

Proposal lists reliable and safe transportation services/methods that the Offeror will use to transport Offenders during participation in the program. Offeror must include a list of authorized driver(s)(minimum of 1-2 people per shift), verification of proper state licensure, and insurance for driver(s), passengers and vehicle(s).

Relocation/Transition plan - Offeror clearly states a safe plan of how and where they would re-locate CSOSA’s offenders in the case of an unforeseen work stoppage or closure (such as infestations, security threats, physical plant system failures and/or any other condition that makes the place of performance uninhabitable). The proposed relocation site must conform to the facility requirements for the main scope of work (appropriate certifications, etc.).

Offeror states admission criteria for each of the population types identified in section 2.2 (i.e., males, females, young adults and sex offenders, and clarifies exclusion reasons, for example too close to a school, so cannot take a “sex offender”).

2 - ORGANIZATIONAL CAPACITY – provides information that will provide the Government with the ability to assess the suitability of the Offeror’s facilities and their response protocols.

A Medication Management Protocol/Policy demonstrates the proper administration/monitoring, medication dispensing is accurately documented, and medication is stored and properly secured in a dedicated space.

Proposed Place of Performance - Floor plans/diagrams and photos that depict the dimensions of the housing, dining areas, meeting room /program activity rooms, and photos of the building exterior and interior. All rooms should be consistent with the codes and the certificates of occupancy maximums for the number of offenders proposed to be housed.

Copies of all federal, state, and locally issued certificates and licenses/approvals that demonstrate the proposed place(s) of performance building(s), meets all code requirements needed to operate a residential treatment facility. Includes certificates of occupancy, zoning permits, fire inspections, and American Disabilities Act (ADA) compliance, etc. Clearly states maximum facility capacity, including maximum number of referred CSOSA offenders at any given time.

The Offeror shall also provide copies of the life/safety inspection reports conducted by a federal, state and/or local jurisdiction in the past 12 months. States they have emergency plan posted, necessary detectors, etc.

A complete listing of the place(s) of performance. Names of the Director, Program Manager and/or Point of Contact, email addresses, full address, phone number and fax number of each facility where services will be rendered under this contract. The Offeror must also provide the same information for its administrative office(s), if different.
