1. Notice
The County of Tuolumne through its Public Works Engineering Division (“County”) is seeking bids from qualified firms ("Consultant") to provide weed abatement services for the 1784 CSA
Roadside Spray 2025-2026 Project at multiple designated county locations (maps attached for reference). All work must comply with local, state, and federal regulations regarding pesticide use, vegetation management, and environmental protection. The contractor is responsible for ensuring no chemical runoff or environmental harm occurs. These services must be provided for a one (1) year term, with the option of a one (1) year extension. Said services must meet all applicable
Federal, State and/or Local regulations. The payment of prevailing wages is required.
All work specified in this contract shall be done in accordance with the Standard Specifications and Standard Plans published by the State of California Department of Transportation (“Caltrans”), dated 2018, as modified by this Invitation For Bids.
Prior to award of the contract, the Contractor must possess a valid Agricultural Pest Control
Advisor (PCA) license issued by the State of California. In cases where the Contractor is not a licensed PCA, they are required to submit written recommendations from a licensed Agricultural
Pest Control Advisor for all chemicals listed, specific to each area of application. Additionally, the Contractor must hold an Agricultural Pest Control license issued by the State of California.
Copies of these licenses must be included with the bid proposal form. Failure of the bidder to obtain and provide the required licenses before award of the contract constitutes a failure to execute the contract. The Contractor and any subcontractors shall be registered with the
Department of Industrial Relations. Please see https://www.dir.ca.gov/Public-Works/ for more information.
BACKGROUND
The Engineering Division of the Department of Public Works coordinates the maintenance of
County Service Area and public trust funded public roads and related facilities outside the
County’s maintained road system. The ownership of these roads and facilities is retained by property owners within the various developments throughout the County, and funding for maintaining these roads is provided by assessments and/or taxes levied against the parcels served.
Maintenance of these roads is generally performed by independent contractors. Current subdivisions particularly those in suburban or rural areas, often face challenges with overgrown weeds and vegetation along their edges. Regular weed abatement along subdivision roads is essential not only for maintaining aesthetics but, more importantly, for ensuring the safety of motorists, pedestrians, and cyclists, as well as reducing the risk of fire and environmental harm.
SELECTION PROCESS
Firms or individuals interested in providing these services should obtain an Invitation For Bids
(IFB) on Tuolumne County’s e-Procurement platform, https://procurement.opengov.com/portal/tuolumnecountyca. The bid proposal includes a description of the services to be provided, copies of the applicable agreement, and the bid form.
Bids must be submitted by the due date below to be considered.
https://www.dir.ca.gov/Public-Works/
Bids must be submitted by: 5:00 pm on Monday, March 10, 2025
2. Scope of Work
2.1. General
2.2. Weed Abatement
The Contractor shall provide weed abatement services throughout Tuolumne County, in accordance with the following provisions:
• Chemical Application: The contractor shall apply pre-emergent chemicals for weed control as needed at various locations. Appropriate techniques and equipment must be used to ensure that chemicals are applied precisely and safely, preventing overspray or runoff that could damage the road surface, drainage systems, or surrounding areas.
• Mowing: The contractor will assess whether mowing is the most effective method for controlling weeds in certain areas and proceed accordingly. Where chemical application is unsuitable or in a "No Spray" zone, mowing shall be performed using appropriate equipment to minimize damage to the surrounding environment. Vegetation must be cut to a height of four (4) inches. Mowing at a lower height risks scalping the ground which may encourage unwanted weeds, increase the chance of throwing rocks, cause fire starts, and could damage mowers.
• Weed Trimming/Edging: The contractor will assess whether weed trimming/mowing is the most effective method for controlling weeds in certain areas and proceed accordingly.
Where chemical application is unsuitable or in a "No Spray" zone, weed trimming/edging shall be performed using appropriate equipment to minimize damage to the surrounding environment. Weeds should be trimmed to a height of 4 inches to prevent regrowth.
Trimming at lower levels may cause unnecessary damage to soil and surrounding plants.
Unit costs shown in the Pricing Table of this (IFB) shall include full compensation for all labor, materials, tools, equipment, and incidentals required to perform the weed abatement services.
The County reserves the right to modify the scope of work, including the right to increase or decrease the quantity of any item or portion of the work, or to entirely delete any item or portion of any work, or to require extra work as deemed by the Engineer to be necessary or advisable.
Any such changes will be set forth in a Contract Change Order, which will not become effective until approved by the Engineer.
2.3. Equipment
The Contractor shall provide, through ownership, lease, rental or other arrangement, the equipment required to fulfill the scope of work. All equipment shall be subject to the approval of the County based upon the following specifications:
• All equipment used for weed abatement work shall be equipped with proper spark arresters, mufflers, etc.
• All equipment and supplies are to be new, and the model or material in current production year. No shopworn, irregular, demonstrator equipment or materials are to be offered.
• All equipment, supplies and services shall conform to local, state, and federal regulations regarding pesticide use, vegetation management, and environmental protection.
The County emphasizes the importance of proper handling and application of pesticides to prevent unintended movement and protect beneficial plants, animals, and the environment.
Responsible stewardship remains a top priority.
2.4. Chemical Application and Use
The Contractor shall adhere to the following requirements for chemical application and use:
• Herbicide Application: The Contractor shall apply the necessary amounts of pre-emergent herbicides to ensure the eradication of weeds and trees within the designated weed abatement areas.
• Chemical List: The Contractor is required to provide a list of the chemicals to be used, along with their respective application rates, to the County at the time of submitting the quote. Quotes that do not include this information will be disqualified from consideration.
• MSDS and Chemical Approval: The awarded Contractor must submit a label and
Material Safety Data Sheets (MSDS) for each chemical to the County, prior to chemical application at designated locations. All herbicides used must be approved for the intended use by the California Department of Fish and Game.
• Application Timing: The timing and number of subsequent applications during the term of the contract shall be determined by the Contractor.
• Weather Conditions: Herbicides must only be applied when there is no standing water in the treatment area and little to no wind activity, unless otherwise directed by the
County.
• Performance Guarantee: The Contractor shall guarantee that all designated areas will be kept "weed-free" throughout the contract period.
• Notification: The Department of Public Works will notify the Contractor if any area does not meet the required weed abatement standards.
The County aims to ensure the safe, effective, and compliant application of herbicides, which is why these requirements have been established for the Contractor’s adherence.
2.5. No Spray Agreement
The Contractor shall adhere to the following requirements for handling no-spray agreements and ensuring proper notification to homeowners:
• Roadside Vegetation Agreement: The County will mail the standard Roadside
Vegetation Agreement to all homeowners. The Engineer will forward any no-spray agreements received to the Contractor. The Contractor will make reasonable attempts to contact and notify persons requesting no spray two (2) weeks prior to application to ensure proper notice to install no spray signs are installed as required by the agreement. The
County will be alerted when and how contact was made or attempted. The Contractor shall observe limitations indicated by no spray signs and notify the Engineer if the area fails to meet the vegetation control requirements of the roadside vegetation agreement. Full compensation for conforming to the requirements of the No-Spray Agreement is included in the payment for the various bid items, and no additional compensation will be allowed.
The County is committed to notifying residents efficiently to ensure they are informed and their no-spray requests are properly addressed.
2.6. Representation and Communication
The Contractor shall designate a primary agent and alternate agents who are authorized and capable of overseeing, coordinating, and troubleshooting the application of pre-emergent chemicals for weed abatement. Full compensation for these agents shall be included in the hourly rates for chemical application services.
The Contractor shall provide the County with the names and contact phone numbers of the designated agents. The agents shall notify the County when routine chemical applications are scheduled and inform the County if any additional treatments or inspections are required following adverse weather conditions.
3. Compensation
Payment for services contemplated by this IFB shall be based on Pricing Table submitted with
Contractor’s bid. Bidders are reminded when preparing the Pricing Table that the payment of prevailing wages is required. The unit rates listed in the bid will represent full compensation for doing all work contemplated and embraced in this IFB, for all loss and damage arising out of the nature of the work or unforeseen difficulties or obstructions which may arise or be encountered in the prosecution of the requested services, for all risks of every description connected with the requested services, for all expenses incurred by or in consequence of the suspension or in continuance of requested services, and for faithfully completing the requested services, the whole thereof, in the manner and according to this IFB. These rates may be adjusted annually in direct proportion to the increase or decrease according to the Consumer Price Index (CPI) for the past year (June to June). The CPI shall be the San Francisco/Oakland/San Jose CPI for all urban wage earners. The Contractor shall submit to the Public Works Director a revised unit price schedule and supporting CPI information for any changes.
A. Payment for services will be made at monthly intervals and will be based upon a detailed invoice showing the services provided at the close of the billing period.
4. Construction
Work should only be completed when there is no standing water in the treatment area and little to no wind activity, unless directed otherwise by the County.
Use county specified equipment for efficient chemical application. Any excess chemicals, overspray, or residue must be contained and removed. Debris from the application should be cleared as necessary. All waste, including chemicals and debris, must be disposed of according to local regulations. All waste and clean up from the project including all disposal costs at the contractor’s sole expense.
Cooperate with local fire prevention authorities in eliminating hazardous fire conditions.
Immediately report to the nearest fire suppression agency fires occurring within the project limits.
Prevent the escape of and extinguish fires caused directly or indirectly by job site activities. Furnish the following fire tools:
• One (1) shovel and one (1) fully charged fire extinguisher UL rated at 4 B:C or more on each truck, personnel vehicle, tractor, grader, or other heavy equipment.
