About this file

This is a Sole-Source Bidding Exemption document submitted by the Northwest Coastal Public Utility District (NWCPUD) in Oregon for the procurement of Crucial Accountability Training Licenses and Toolkits. The requestor, Kara Salazar from Department 16, seeks to purchase 100 learner licenses and toolkits through VitalSmarts dba Crucial Learning, the sole authorized provider of this proprietary training material. The purchase supports the district's staff training initiatives, leveraging a certified Crucial Accountability Coach on staff to deliver the material to employees. The exemption from competitive bidding is justified under ORS 279B.075, which permits sole-source procurement when goods or services are available from only one source. No specific response deadline, site visit, or bidder's meeting is referenced in the document.

The estimated cost of the procurement is $28,600, which falls within the $25,001 to $250,000 threshold requiring approval from the General Manager, Assistant General Manager, Chief Financial Officer, Director of Corporate Services, and Chief Operations Officer. The purchase qualifies for small procurement processing and requires documentation of the sole-source determination, submission for purchasing approval, posting of public notice for seven calendar days, and submission to the Chief Legal Officer for contract approval. Protests may be filed within seven calendar days after issuance of the public notice. The 100-unit order quantity was selected to serve all current and foreseeable future staff needs while securing significant volume pricing discounts from the vendor.

REQUESTOR Kara Salazar DEPT: 16

ESTIMATED COST: $28,600

TYPE OF PURCHASE: Crucial Accountability Training Licenses and Toolkits….

Sole Source Procurements are unusual and should be considered an exception, as they are the most likely procurement method to receive a protest. A protest may be issued in accordance with OAR 137047-0710.

In accordance with ORS 279B.075, NWCPUD may award a contract for goods or services without competition when the General Manager and/or his designees, after reviewing findings of fact, determines that the goods or services or class of goods or services, are allowable as sole-source and exempt from bidding. Determination must be based on written findings that may include:

(a) ☐That the efficient utilization of existing goods requires the acquisition of compatible goods or services;

(b) ☒That the goods or services required for the exchange of software or data with other public or private agencies are available from only one source;

(c) ☐That the goods or services are for use in a pilot or an experimental project;

or

(d) ☐Other findings that support the conclusion that the goods or services are available from only one source, or
