About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) form for a federal contract opportunity. The Consumer Product Safety Commission (CPSC) intends to award a sole source contract to SEA Limited to provide evaluation of rollover characteristics of All-Terrain Vehicles (ATVs). The requirement is an expansion of previous testing done by SEA under task orders of an existing IDIQ contract. SEA has developed unique testing methods and equipment, including autonomous (remote-controlled) testing, to operate ATVs and evaluate electronic stability control and instability mitigation systems. Awarding to another contractor would require extensive validation and duplication of SEA's specialized facilities, equipment, and expertise, which would incur substantial cost to the government. The contract will be awarded under simplified acquisition procedures with an estimated value redacted. CPSC will consider any capability statements submitted within 10 business days, but the decision to compete the procurement is at the government's discretion.

Consumer Product Safety Commission Revised: 5/06/19 Office of Procurement Services Reviewed/Current 5/06/19

Form F1001A - Justification for Other than Full and Open Competition

1. Requisition number and title: REQ # CPS-2114-24-0005 All-Terrain Vehicle (ATV) Instability Mitigation System (IMS) Testing and Evaluation on Sloped Surfaces

2. Description of the Supplies and Services Required:

Testing services: Autonomous Testing of ATVs utilizing robotic control of the vehicle; Designing/ constructing an IMS system on four sample ATVs with and without antilock braking systems (ABS), measurements of accelerations, speeds, and yaw angles, high speed and normal speed video recordings of all dynamic tests.

Supplies: Data acquisition systems, high speed digital camera video recording technology, groomed dirt test surfaces, paved surface test surfaces, sample ATVs with and without antilock braking systems (ABS), all necessary hardware/software/sensors/radio transmitters/radio receivers to conduct the above services, and any other tools/resources necessary for accomplishing the above testing services.

Supporting Services: Report writing, Data Analysis/Reduction, Design of proof-of-concepts, Meetings with CPSC staff and Industry Representatives.

3. Period of Performance: September 30, 2024 to September 29, 2025

4. Estimated Value (to include options): [REDACTED]

5. Description of effort made to ensure that offers are solicited from as many potential sources as practical:

CPSC conducted market research and was unable to identify any sources that would be able to re-produce the existing facilities and test equipment to match those currently used by SEA Limited (SEA) to ensure compatibility and integration of existing data.

6. Reason for Other Than Full and Open Competition (check one):

___X__ a. Only one responsible source and no other supplies or services will satisfy agency requirements.

______ b. Only a particular Brand Name item can meet the Government’s need.

______ c. Unusual and compelling urgency.

______ d. Industrial mobilization; engineering, developmental, or research capability; or expert services.

______ e. International agreement.

______ f. Authorized or required by statute

______ g. National security.

______ h. Public interest (must be approved by Chairman).

7. Justification for sole source (not competing the requirements):

Previously, CPSC awarded task orders 61320621F1012 and 61320623F1010 of IDIQ contract 61320618D0003 for evaluating rollover characteristics of ATVs. SEA conducted autonomous ATV testing on groomed dirt and paved surfaces. The current requirement is an expansion of the testing done under the previous task orders and must be able to be combined for analytical purposes with the data provided under that contract. Awarding to any other contractor would require extensive validation of those facilities, test rigs, and hardware/software installed on the experimental demonstration ATVs to confirm that their data would be able to integrate with the existing testing data prior to being able to accept any data delivered.

SEA has developed test methods and equipment to operate ATVs autonomously, i.e., testing ATVs with robotics instead of human drivers. Since the nature of the dynamic testing can potentially injure test personnel, autonomous (remote controlled) testing would enable test personnel safety, accuracy, repeatability, and reduce the risk of human testing error/variability.

SEA developed a demonstration electronic stability control (ESC)/instability mitigation system (IMS) on two sample ATVs, one with an antilock brake system (ABS) and one without ABS.

The hardware and software installed on these ATVs are unique creations by the SEA engineering staff. Also, SEA’s maintenance of test surfaces and test equipment allows for consistent, repeatable test results. Selecting another contractor to produce comparable prototype IMS ATVs and comparable test results would require construction of those demonstration ATVs, facilities, and/or modification and validation/calibration of a similar existing facility. Duplication and establishing comparability of a laboratory facility and the equipment and expertise for laboratory testing and simulation of ATVs by another contractor would incur substantial cost to the government that will not be recovered through competition.

8. Insert contractor name, address and telephone number:
