Limited Source Justification for Federal Supply Schedule
Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(C). This acquisition is conducted under the authority of the Multiple-Award Schedule Program (FAR 8.401).
1. Identification of the agency and the contracting activity.
Department of Justice, Office of Justice Programs, Office of Administration, Acquisition Management Division, contracting on behalf of the Office for Victims of Crime located at 810 7th St, NW, Washington, DC 20531.
2. Nature and/or description of the action being approved.
The Office of Justice Programs (OJP) awarded a multiple Blanket Purchase Agreement (BPA) DJO-OA-13- S-0685 with Educational Services, Inc. (“ESI”) to provide conference and logistical support services. These services include meeting support, planning, consultation, training, technical assistance, and evaluation designed to improve the criminal justice system and enhance public safety. The BPA period of performance is for sixty (60) months from August 12, 2013 through August 11, 2018.
GSA Contract Number GS-23F-0297K [with Educational Services, Inc. ("ESI")] expired on June 8, 2015.
Pursuant to a novation agreement and an asset purchase agreement, both dated June 30, 2015, ESI began operating under IMPAQ International LLC [GSA Contract Number GS-10F-0240U]. ESI wrote to NIH regarding the novation on December 7, 2015. NIH approved the novation, and subsequently on May 23, 2016, OJP Office of General Counsel gave no objection to OJP processing our BPA novation.
ESI’s GSA Contract allows cancellation per “552.238-73 CANCELLATION (SEP 1999): Either party may cancel this contract in whole or in part by providing written notice. The cancellation will take effect 30 calendar days after the other party receives the notice of cancellation. If the Contractor elects to cancel this contract, the Government will not reimburse the minimum guarantee.”
Modification M003 cancelled BPA DJO-OA-13-S-0685 as of June 30, 2016 and noted the transition within General Services Administration’s (GSA) Professional Services Schedule (PSS). ESI's BPA has migrated into a new BPA number DJO-OA-16-S-0129 with IMPAQ International LLC to reflect the new GSA Contract.
The new BPA is effective as of July 1, 2016. The new migrated Schedule contract number will ensure proper tracking in FPDS-NG. The new BPA number will ensure proper internal tracking for invoices and similar documents/work.
BPA Call DJO-OVC-13-C-0801 was awarded to ESI under BPA DJO-OA-13-S-0685, with OVC requiring services from ESI; and DJO-OVC-13-C-0801 expires on September 29, 2016.
OJP will award a logical follow-on BPA Call under IMPAQ’s new BPA number DJO-OA-16-S-0129 to continue services.
3. A complete description of the supplies and/or services required to meet the agency’s needs
This requirement provides Conference and Meeting Logistical Support for the Office of Victims of Crime (OVC) located at OJP. The estimated BPA Call Ceiling is
4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor’s unique qualifications to provide the required supply or service.
FAR 8.405-6(a)(1)(i)(C) – applies to this limited source justification.
Pursuant to the authority cited in FAR 8.405-6(a)(1)(i)(C), in the interest of economy and efficiency, the additional work is a logical follow on to an original Federal Supply Schedule (FSS) order. The original BPA was placed in accordance with the applicable FSS ordering procedures, and was competitively awarded.
This new BPA Call will be issued to IMPAQ under BPA # DJO-OA-16-S-0129 as a logical follow on. The original BPA Call’s primary function is to plan the annual National Crime Victims Service Award Ceremony.
This ceremony is sponsored by OVC on behalf of the US Attorney General. However, this meeting has not occurred yet and is scheduled for April 4, 2016. It is in the best interest of the government to have the same contractor who originally planned the meeting complete the task and render the service.
5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
It important that the work under this requirement is completed timely. Considering timing and costs, soliciting other sources would not prove to be of any benefit to the Government.
6. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS.
Market research was completed at the award level. Also no market research was conducted because identifying and pursuing new sources would not have been the most cost effective approach at this time.
7. Any other facts supporting the limited source justification.
OVC has deemed the performance of the existing contractor to be acceptable and therefore, the follow-on BPA Call represents an opportunity to obtain maximum benefit for the requirement.
8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
The decision to issue a logical follow on BPA Call was made following a decision to issue a new call rather than cancel the current BPA Call, reissue under the new GSA IMPAQ, and extend the period of performance. The rates are anticipated to be the same for this new one (1) year-long follow-on BPA Call.
