Authority: FAR 13.501(a)(1)(ii), Prepare sole source (including brand name) justifications using the format at 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C.1901 or the authority of 41 U.S.C. 1903.

b. Justification: The use of Prosecure, LLC for this second three-month bridge contract is due to the fact that they are the incumbent contract currently performing the required security. As they are currently performing the contract they have on site the required patrol vehicles, the needed personnel with the current licenses and training needed, access to the needed firearms and the knowledge of the facilities to seamlessly continue maintaining site security. The new contract allows a minimum of 15 days for the new contractor to do all the planning needed to secure needed vehicle, personal and equipment needed to successfully start providing the needed services by 1 October 2025, when the current contract expires. Additional as this is only a three-month bridge contract to allow time for the government to complete the award of the new five-year contract, all the cost for procuring the vehicle and equipment needed to provide the needed security could to be charged to the government 100% thus drastically increasing the cost of the bridge contract. As Prosecure already has the needed vehicles and equipment on site the cost to the government can be negotiated to a minimum and they can continue services without needed transition time. The proposed three-month contract will only be for the security serviced needed at the three facilities, the surge capability on the current contract will not be requested on the new contract and the new contract will utilize the existing PWS currently being used vs the new PWS that was used in the solicitation for the new contract award. This is done to reduce the scope of the three-month contract and to ensure the level of services stay in line with the current contract.

c. Impact: Bonneville Dam, The Dalles Dam, and John Day Dam are federal facilities operated by the Northwest Division, Portland District (NWP) of USACE. These projects support missions within navigation, hydropower, water quality, fish & wildlife management, and recreation. The proximity of the Bonneville Project to a large population base requires that these Projects, their properties, and the personnel in, on, and around these facilities, be provided a reasonable assurance of security. As multipurpose civil works facilities operated by the U.S. Army Corps of Engineers, these three sites are required to provide security for personnel, property, and critical infrastructure. Contract security officers are used to fulfill these requirements because the staffing levels may change unexpectedly due to emergency situations, changing regulations, or other factors.

Without the Security Contract we will not have a security force to assist with the security of the 3 Lower Columbia River Dams (Bonneville, The Dalles, & John Day) which together consist of 4 powerhouses, 3 spillways, 3 navigation locks, a total of 62 generators, and generate an excess of 15.81 Gigawatts of electricity each year. The 3 LCR dams also providing myriad recreation and fishing opportunities to the general public in addition to over 1.5M visitors each year along with the commercial locks that allows over $2.5 billion a year in commodities to pass up and down the Columbia River.

d. Alternatives: The Districts past research has concluded that it would require 30+ highly trained professional security personnel at the three projects to provide the level of service specified in the statement of work. However, the District determined that it is necessary to contract out for these services rather than have them performed by government personnel because it is not considered feasible since the Corps does not have the manpower, available FTEs, or training facilities to provide its own guard force. Contractors provide non-law enforcement security to the site, to augment staff security procedures. There is no detention or confinement of persons. The need for a contractor is expected to be indefinite. The district has procured private security guards for more than 20 years. The contractors are considered experts in security and have advanced training and are authorized to carry weapons on site. In-sourcing has been considered but the number of personnel required, the amount of specialized training and oversite is prohibitive.

8. Market Research: As this is bridge contract additional market research was not done due to awarding to the incumbent contractor. The bridge contract is to allow more time to complete the negotiations on the new contract award that was done as a Service-Disabled Veteran Owned Small Business set aside.

9. Interested Sources: The current RFP, W917N25RA011, was posted on SAM.GOV with multiple proposals received, due to more proposals than anticipated the evaluation process has not been completed, thus the need for a second three-month bridge contract.

10. Other Facts: As the incumbent, Prosecure, LLC is able to continue services with minimal cost and effort as they already have the required patrol vehicles, protective equipment, licensed personal, and needed firearms to continue the required security services at the three facilities without a transition time.

11. Fair and Reasonable Cost Determination / Contracting Officer Certification I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. I certify that this justification is accurate and complete to the best of my knowledge and belief.

Based on the foregoing determination, I hereby approve the procurement of Lower Columbia River Armed Guard Services on an other than full and open competition basis pursuant to the authority FAR 13.501(a)1(ii) subject to the availability of funds, and provided the supplies and services herein described has otherwise been authorized for acquisition.
