Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items

25 May 2018 FOR OFFICIAL USE ONLY Page 2 of 4

I. Contracting Activity.

355 Contracting Squadron, Davis-Monthan AFB, AZ

II. Nature and/or description of the action being processed.

Sole-source acquisition in the amount of for the purchase of Raytheon/Solipsys MSCT support for the 612 Air Operations Center (AOC).

III. Description of supplies/services required to meet agency needs.

Services are required for a base plus 4 option years of MSCT support, to include; phone/email support, in-person training, software upgrades, and patch releases for the MSCT tool. The 612 AOC is currently utilizing the Raytheon-Solipsys MSCT system to receive tactical track information from multiple sources and produce a coherent, composite track database for display and dissemination.

IV. Statutory authority permitting other than full and open competition.

10 U.S. Code §2304(c)(1)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The MSCT software is proprietary to Raytheon-Solipsys and no other subcontractor has access to the source code.

Due to the unique characteristics and capabilities of the MSCT and MSCT Display software, no other contractor has access to the source code and Raytheon-Solipsys owns all of the associated intellectual property rights. There are no resellers of the software and Raytheon Solipsys is the only authorized selling agent of MSCT software. Further, no other contractor makes the software that can perform the functions needed by AFSOUTH/612 AOC.

The system has been tested and certified as suitable for use on systems connected to the Air Force Global Information Grid (AF-GIG). The system interoperates with a number of other systems already in place at the 612 AOC. Due to the complex nature of the system and associated software, replacing this system could result in interoperability issues with the other systems the 612 AOC uses to execute their mission. Further, the cost of acquiring a new system would be substantially higher than updating the current system. This software has been tested and certified as appropriate for DoD use IAW Military Standards 6016(MIL-STD-6016) and Tactical Data Link 16 (TDL-16) and was placed on the USAF Theater Air Control System (TACS) Control and Reporting Center (CRC) Engineering Baseline Equipment list and approved by the AOC WS CRB as a variance to the AOC

WS baseline.

There are no other systems that have met the same requirements that could replace the MSCT system. The MSCT system is the core system organic to USAF CRCs that performs similar functions. By using the MSCT it allows for standardization with the rest of the AF battlespace awareness suite of tools as well as capitalizing on efforts by CRCs.

Only the manufacturer (Raytheon-Solipsys) can perform the service because they do not have any authorized agents.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A search of the Internet and GSA was conducted to determine if other vendors offer the required service. Raytheon- Solipsys is the only provider of this tool. In addition, an intent to sole-source was posted on Beta.Sam on 1 June 2020, responses were requested by 6 June 2020. The notice remained active until 21 Jun 2020 and did not receive any responses.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The CO is confident that the costs will be fair and reasonable. Based on stable previous acquisition history of the MSCT software, a fair and reasonable determination can be made. In addition, Market Research has found acquisitions of similar software systems that can be used for a price fair and reasonable determination.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

The Internet was used to research the MSCT software via Raytheon-Solipsys Corporation website. Past similar contracts were researched using FPDS-NG and GSA. Market research concluded that only Raytheon-Solipsys can provide the required service.

The following contracts were awarded to Raytheon-Solipsys on a sole-source basis at this location;

FA487715FA013 on 21 September 2015, and FA487714FA042 on 26 September 2014.

IX. Any other facts supporting the use of Other Than Full and Open Competition.
