Contract Documents Summary

This is a sealed bid invitation and contract document package for the City of Kirbyville, Texas, for construction of the Herndon/MLK Ditch project under GLO Contract No. 22-085-075-D334, funded through CDBG Disaster Recovery. The project involves constructing approximately 1,240 linear feet of earthen ditch, installing reinforced concrete box culverts (approximately 253 linear feet of 8x3 RCB and 27 linear feet of 4x2 RCB), constructing concrete headwalls and wingwalls, installing concrete riprap, placing approximately 797.5 linear feet of metal beam guard fence, and performing surface restoration. Additional work includes relocating waterlines, casing sewer lines, providing traffic control, implementing stormwater pollution prevention (SWP3), and conducting materials testing. Sealed bids were due by 2:00 PM Central Time on September 24, 2026, with public opening and reading at City Hall in Kirbyville. No pre-bid conference was held; questions were to be submitted in writing through CIVCAST by 11:30 AM Central Time on September 18, 2026. The contract requires substantial completion within 120 calendar days and final completion within 150 calendar days from the Notice to Proceed. Bidders are required to visit the site and conduct thorough examination of existing conditions.

Bidding documents specify a 5% bid bond requirement (or acceptable alternatives such as certified check or U.S. Government Bonds) for contracts exceeding $100,000. Performance and payment bonds equal to 100% of the contract price are required before work commences. The contract utilizes unit pricing for earthen ditch construction (per linear foot) and lump sum pricing for structural installations and miscellaneous work. Progress payments are made at 95% of work completed with 5% retainage, with the retainage released upon final completion. Liquidated damages are assessed at $500 per calendar day for failure to achieve substantial completion or final completion dates. Davis-Bacon prevailing wage rates apply to the project. Section 3 of the Housing and Urban Development Act of 1968 requirements apply, mandating compliance with hiring and subcontracting objectives for Section 3 Residents and Business Concerns. The project is funded through CDBG Disaster Recovery administered by the Texas General Land Office. All contractors and subcontractors must maintain active SAM.gov registrations and cannot be debarred, suspended, or otherwise excluded from federal assistance programs.

Each interpretation made will be in the form of an Addendum to the contract documents and will be distributed to all parties holding contract documents no less than seven (7) days prior to the bid opening. All such addenda shall become part of the contract documents and all bidders shall be bound by such addenda, whether or not received by the bidders.

The addendum shall allow adequate time for consideration in bid preparation (usually at least one week). If adequate time is not available, the bid opening date must be extended and the Grant Recipient must republish the invitation for bids containing the place, time, and date for the new bid opening. Note that any change to the original bid opening date will require republication of the invitation for bids at least once in a locally published newspaper. State, a county, or a municipality; a department, board, or agency of the state, a county, or a municipality; and a school district or a subdivision thereof, to furnish to the governmental entity a payment bond in the amount of the contract. The payment bond must be filed within 30 days from the date of the Notice of Award:

o Municipalities: If the contract is in excess of $50,000, a payment bond is required.

o Counties: If the contract is in excess of $25,000, a payment bond is required.

c. The failure of the successful bidder to execute the agreement and supply the required bonds within thirty (30) days from the date of the notice of award-or within such extended period as the locality may grant, shall constitute a default and the locality may, at its option, either award the contract to the next lowest responsible bidder, or re-advertise for bids. In either case, the locality may charge against the bidder the difference between the amount of the bid, and the amount for which a contract is subsequently executed irrespective of whether this difference exceeds the amount of the bid bond. If a more favorable bid is received through re-advertisement, the defaulting bidder shall have no claim against the locality for a refund.

16. Wages and Salaries

Attention is particularly called to the requirement of paying not less than the prevailing Davis Bacon

Related Acts (DBRA) wage rates specified in the Contract Documents. These rates are minimums to be paid during the life of the contract. It is therefore the responsibility of the Bidder to inform themselves as to local labor conditions.

IB - 4 of 4

17. Section 3

Attention is called to the required Section 3 Contracting and hiring objectives specified in the Contract

Documents. These minimum objectives for hiring and contracting must be enforced. It is therefore the responsibility of the Bidder to inform themselves of these requirements.

18. Equal Employment Opportunity

Attention is called to the requirements for ensuring that employees and applicants for employment are not discriminated against because of race, color, religion, sex, sexual identity, gender identity, or national origin, and other civil rights requirements.

19. Certification Regarding Lobbying

Contractors who apply or bid for an award of $100,000 or more shall provide the required certification that it will not and has not used Federal appropriated funds to pay any person or organization for influencing or attempting to influence an officer of employee of any agency, a member of Congress, officer or employee of Congress, or an employee of a member of Congress in connection with obtaining and Federal contract, grant or any other award covered by 31 USC § 1352.

VENDOR COMPLIANCE TO STATE LAW

The 1985 Session of the Texas Legislature passed House Bill 620 relative to the award of contracts to non-resident bidders. This law provides that, in order to be awarded a contract as low bidder, non-resident bidders (out-of-state contractors whose corporate offices or principal place of business are outside of the state of Texas) bid projects for construction, improvements, supplies or services in

Texas at an amount lower than the lowest Texas resident bidder by the same amount that a Texas resident bidder would be required to underbid a non-resident bidder in order to obtain a comparable contract in the state in which the non-resident's principal place of business is located. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident bidders in order for your bid to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that bidder. Resident bidders must check the box in Section B.

A. Non-resident vendors in (give state), our principal place of business, are required to be percent lower than resident bidders by state law. A copy of the statute is attached.

Non-resident vendors in (give state), our principal place of business, are not required to underbid resident bidders.

B. Our principal place of business or corporate offices are in the State of Texas.
