JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPRBL1-22-R-0013
DLA Land & Maritime Justification for Other Than Full & Open Competition
L3 Global Communications Solutions to provide CSS VSAT systems and sustainment services under Task Orders 0016 and 0127.
(2) W52P1J-14-C-0057 was solicited and awarded as a sole source FFP Undefinitized Contract Action to L3 Global Communications Solutions. The period of performance for this effort was a one base year of 12 months and one 12-month option year. The contract also included base year options for training and additional parts.
(3) The current spares, repairs and repair services IDIQ W56JSR-17-D-0006 was solicited and awarded as a sole source five-year FFP contract to L3 Global Communications Solutions.
The contract was awarded with a 1 contract ceiling. Modification P00005 was issued on January 24, 2019, to increase the ceiling to . The contract expiration date is September 26, 2022.
b. Previous Justification and Approval:
(1) The Justification and Approval for W56JSR-17-D-0006 (Attachment 2) stated, “the Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions to be competed….” This was accomplished via posting Sources Sought Announcements (SSAs) in an attempt to increase competition for any future acquisitions.
(2) The Justification and Approval also stated, “the Government will include the TDP as an optional CLIN on the solicitation in attempt to obtain its cost.” This was accomplished by including language in the solicitation that stated, “Manufacturing TDP: Option CLIN to be exercised at the government discretion. Contractor shall provide to the government a complete level three (3) manufacturing TDP. Contractor shall price this option at time of original proposal.” However, consistent with L3Harris.’s position, L3Harris will not sell the TDP to the Government.
12. Fair and Reasonable Cost Determination: As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable based on cost and price analysis in accordance with FAR 15.4 Contract Pricing. Certified cost or pricing data will be obtained in accordance with FAR 15.403.
