1. Weather Conditions: Climatologically data determined from records of the U.S. Weather Bureau Station, U.S. Weather Bureau Station, Wrightstown, NJ;
Mean Annual Temperature: 54.4 degrees F Mean Annual Precipitation: 43.01 inches
1.32 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
A This provision specifies the procedure for determination of time extension for usually severe weather in accordance with the contract clause entitled "Default: (Fixed Price Construction)." In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
1 The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
2 The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
B The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON (5) DAY WORK
WEEK
JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC
(9) (7) (8) (8) (7) (7) (6) (7) (5) (7) (5) (7)
C Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CPR log, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph 2 above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the contract clause entitled "Default (Fixed Price Construction)". (ER 415-1-15) (31 Oct 89)
1.33 CRITICAL PATH SCHEDULE:
A. The contractor shall prepare and submit within 30 days of Notice to Proceed a construction schedule. The schedule’s major subsections shall be based on the sections listed on the initial AF Form 3065 to be furnished by the Government; however enough detail is to be included for the clearly recognizable identification of all unique work items. If the contract includes multiple buildings, one schedule per building shall be prepared.
B. The initial submission and monthly updates shall be made on paper as well as electronic file. The printed schedule shall clearly portray the project’s critical path.
C. All current actual completion percentages shown on the monthly schedule updates are the percentages to be shown on the contract progress report (AF Form 3065).
D. Monthly updates, showing actual progress to date are to be attached to all progress payment applications. No progress payments will be authorized for release to the contractor without this monthly update (among other required documents).
1.34 QUALITY ASSURANCE PLAN:
A. The contractor shall prepare and submit within 30 days after Notice to Proceed, a Quality Assurance (QA) Plan appropriate for the work intended.
B. The QA Plan shall identify the contractor’s QA Manager, the person responsible for implementing the contractor’s QA Plan. Any contractor person who has been given full authority by the contractor to accept and reject work quality may perform the duties of the QA manager. This includes his/her project manager or superintendent. A full time QA Manager is not necessary to satisfy this requirement, however should the contractor deem it necessary for the satisfactory performance of this work, the cost for a full time QA Manager must be included in the initial bid/price proposal.
C. The QA Plan shall specify types and quantities of inspections, photos (as required to document the quality of all items and especially that of those to be covered or hidden in the construction, such as underground utilities, cabling/piping within walls, etc.), acceptance and rejection criteria, and other items deemed necessary by the contractor to validate an acceptable level of quality materials and workmanship. “Close-in” inspections are to be performed by the contractor’s QA manager, documented with photographs and included in the monthly QA Report. The QA Plan shall include a sample monthly status/result report (Monthly QA Report).
D. The Monthly QA Report shall be submitted with all progress payment applications. No progress payments will be authorized for release to the contractor without this monthly update (among other required documents).
1.35 PROGRESS PAYMENTS & RETAINAGE:
A. In accordance with FAR 52.232-5 “Payments” and FAR 32.103 “Progress Payments Under Construction Contracts,” progress payments may only be made in full for satisfactory progress during the payment period.
The Government will evaluate the contractor’s work performance using the attached checklist, whenever a progress payment application is received. Should the checklist identify unacceptable performance, up to 10% retainage will be withheld against that application and all future progress payment applications until the work is brought back to a satisfactory level.
B. A checklist will be used by the Government to determine whether satisfactory progress was achieved and if not, what amount of retainage should be withheld until corrected.
C. Release of retainage will be automatic upon Government verification of re-attainment of fully satisfactory work or upon verification of punch list corrective action completion.
D. Compliance with the Specifications and Drawings is the basis for payment, not necessarily the final ACASS rating. The ACASS evaluation shall be based on the government’s documented satisfaction with the final product, and include such factors as quality control, completeness, timeliness, accuracy and professional integrity.
1.36 CONSTRUCTION PROGRESS MEETINGS:
A The contractor shall conduct bi-weekly. Construction Progress Meetings for the duration of the project or as determined necessary by the CO. These meetings shall be led by a contractor representative, who shall also publish meeting minutes. Five (5) copies of minutes shall be presented by the contractor at the next meeting (unless directed otherwise by the CO), and shall be the basis used to conduct the subsequent progress meeting.
Action items (along with their due dates, completion dates, party responsible for action, etc.) are to be documented, as well as field decisions, problem discussion and reviews of Request For Information (RFI) and Proposed Change (PC) logs, among other topics as necessary for the proper execution of the work. Meetings may be attended by the COTR, the CO, the CA, the government project manager, and any other government employees deemed necessary by the government. The contractor shall conduct the meeting using their representative and shall direct attendance of their subcontractors, vendors, suppliers or others under their authority, as necessary to resolve all field issues, or at the direction of the CO. The location of the meeting shall be in the contractor’s on-site project management trailer or at the direction of the CO.
1.37 REQUESTS FOR INFORMATION, SUBMITTAL AND PROPOSED CHANGE LOGS:
A The contractor shall prepare a RFI Log and update it on an ongoing basis, but no less than once a month. It is to be presented (5 copies) and reviewed at every Construction Progress Meeting.
B The contractor shall prepare a Submittal Log and update it on an ongoing basis, but no less than once a month.
It is to be presented (5 copies) and reviewed at every Construction Progress Meeting.
C The contractor shall prepare a Proposed Change Log and update it on an ongoing basis, but no less than once a month. It is to be presented (5 copies) and reviewed on a monthly basis at the Construction Progress Meeting.
1.38 BOND, OVERHEAD (OH) AND PROFIT CALCULATIONS ON MODIFICATIONS:
A In all contracts where performance bonds are required, the amount of the performance bond, unless determined otherwise by the CO, must equal 100% of the original contract price. The government requires additional performance bond protection whenever a contract price is increased, equal to 100% of the contract price increase.
1. The bond rate to be used for all contract modifications shall be that shown on a written quotation by the bond company, as furnished by the contractor to the CO. The quote shall show the bond rate to be charged the contractor for the basic contract bond and that to be charged on potential contract modifications. If a written quote is not furnished, then no bond costs will be reimbursed on contract modifications. In credit modifications, the government shall be reimbursed by the reimbursement amount granted to the contractor by the bonding company.
2. Profit increases (and reductions in the case of scope reductions) shall be included on all contract modifications except for delay expenses.
3. When calculating contract modifications, the profit and overhead rates shall be added together and then applied to the proposal subtotal. Profit is not to be taken on the overhead portion of the proposal. The bond rate shall then be applied to the subsequent total.
4. “Overhead” includes all costs over and above the direct cost of the changed work for both field overhead and home office overhead as well as supervision, except profit and bond.
5. Overhead and profit rates shall be applied by general contractors as well as subcontractors to all contract modifications that either increase or decrease the work scope (does not include changes where the intent of the modification does not change the scope, but merely reimburses authorized expense increases, which are to be calculated only with a bond price increase) in this fashion: 10% OH plus 10% profit on the first $20, 000 of the mod; then add 7% OH and 7% profit on the next $30,000 portion (i.e.$20,001 through $50,000); then add 5% OH plus 5% profit on all amounts over $50,000. If the work is to be performed by a subcontractor, then the above calculations shall apply only to the subcontractor’s quote while the general contractor shall be limited to a flat 5% markup fee on the subcontractor’s quotation.
1.39 CHANGE PROPOSAL SUPPORT DOCUMENTATION:
A The contractor shall furnish a detailed breakout quotation for all proposed changes, to include copies of necessary subcontractor proposals/quotes. Lump sum type proposals or subcontractor quotes will be rejected.
The proposals shall include enough detail to enable a thorough Government review. All materials to be used shall be listed individually or as assemblies, and will show unit prices, labor hours, labor rates, etc.
1.41 RADIOACTIVE MATERIALS:
A Radioactive materials (RAM) permitted by the Nuclear Regulatory Commission are not permitted on Air
Force installations without prior approval from the base Radiation Safety Officer (RSO). The contractor must contact the base RSO at (609) 754-9057 if they have any RAM they wish to bring on base.
