CLASS JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Naval Sea Systems Command, Naval Surface Warfare Center, Indian Head Division (NSWC IHD), Contracts Office Code 026.

2. Description of the Action Being Approved.

Award of Firm Fixed Price (FFP) contracts, Indefinite Delivery Indefinite Quantity (IDIQ) and standalone, on a sole source basis for the installation of the Ceilcote 510 Coroline Conductive Flooring by Capital Finishes in applicable buildings on NSWC IHD. Additionally, inclusion of the flooring specifications and approved distributer/installer into other solicitations for larger building renovations.

3. Description of Supplies/Services.

NSWC IHD has a several current and ongoing requirements to install and repair Ceilcote 510 Coroline Conductive flooring in production, testing, storage, and RDT&E buildings at NSWC IHD. This flooring is an epoxy resin floor that is bonded to facility secondary grounding girdle system via electrical means to ensure that no static or sparks are created in areas where explosives are handled and manufactured. It is a safety requirement, per NAVSEA OP5 Revision 8, AMMUNITION AND

EXPLOSIVES SAFETY ASHORE, that is strictly adhered to and requires perfect installation and unique repair and install processes to be effective and pass rigorous testing. The following maximum quantities are estimated for the 5 year ordering period.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

This acquisition is conducted under the authority of 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Both the flooring and install together provide the acceptable product for NSWC IHD explosive facility work. Under 6.302- 1(b)(1)(ii)when there is a reasonable basis to conclude that the agency’s minimum needs can only be satisfied by unique supplies or services available from only one or limited sources or from only one or a limited number of suppliers with unique capabilities. To date, the only conductive flooring that meets the unique required safety specifications for the multiple explosive related buildings and magazines on base, has been the Ceilcote 510 Coroline conductive floor. Both market research and previously failed contracts through Naval Facilities Engineering Systems Command (NAVFAC)indicate that no other epoxy floor meets the required conductivity testing that is required for production, testing, storage, and RDT&E buildings at NSWC IHD. In addition, the installation process must follow specific steps, directions, and climate requirements to pass the testing set forth by NAVSEA OP5 Revision 8, AMMUNITION AND EXPLOSIVES SAFETY ASHORE. The rigorous testing performed on the flooring requires stringent resistance ranges be met. This minimal allowable threshold for failure/error is due to the nature of the explosives and munitions that are manufactured, tested and stored on station that support ongoing conflicts and the replenishment of the US munitions stock. The safety requirements for these activities are stringent to ensure the safety of those working in these areas and surrounding buildings. There is zero tolerance for error with this installation process. To date, the only local authorized distributor/installer who has been able to pass the testing is Capital Finishes, Inc. Many months of process trial and error were conducted to find the correct steps and climate to properly install the flooring to pass the testing.

Any building that does not have conductive flooring up to code cannot operate and delays the munition production for the fleet. Both the time and cost spent to find another flooring to meet the required NAVSEA OP5 Revision 8, AMMUNITION AND EXPLOSIVES SAFETY ASHORE, explosive safety inspections, and retesting of the install process would cause unacceptable delays to the mission of NSWC IHD.

Until another conductive flooring manufacturer and installer can provide a floor that meet the safety and quality standards required, Ceilcote 510 Coroline Conductive Epoxy Flooring and Capital Finishes, Inc. coupled with the specific installation process remain the only options for success.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

To further broaden market research and to satisfy the requirements of DFARS PGI 206.301-1(d), a Sources Sought notice was posted on SAM.gov websit sting capability statement.

04/03/24 and closed on 04/18/24, with 2 responses that were not capable.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government for the construction projects covered by the Class J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NSWC IHD has no intention of requalifying another installer unless a new conductive flooring that meets the safety specifications for explosive buildings and magazines enters the marketplace. NSWC IHD will continue to monitor the market for the addition of acceptable conductive flooring products.
