About this file
This is a Sole Source Procurement Authorization form (SPO Form 103) completed by the Arizona Department of Environmental Quality (ADEQ) requesting sole source authorization for nationally recognized certification exams to certify water, wastewater treatment, and related water operators within Arizona. The procurement is with Water Professionals International (WPI) dba The Associated Boards of Certification, which develops operator examinations through a nationally recognized job task analysis survey adhering to industry psychometric standards. The service ensures that operators meet statutory requirements and recognized standards in environmental management. The authorization request was submitted on October 10, 2023, for a contract term extending through June 30, 2028, with an estimated cost of $234,953 for FY24 covering three agreements: Gateway Community College (Agreement #EV21-0001), City of Phoenix (Agreement #EV20-0040), and Central Arizona College (Agreement #tbd). ADEQ determined that WPI is the only nationally and internationally recognized not-for-profit 501(c)(3) organization developing operator examinations through nationally recognized job task analysis surveys adhering to industry psychometric standards, with registered copyrights on exam content and assistance in certifying more than 500,000 water and wastewater treatment professionals across 49 U.S. states/territories, 12 Canadian provinces/territories, and international entities. The request was authorized by the State Procurement Office Chief Procurement Officer on October 10, 2023, with approval expiration through June 30, 2028. Fees for operator testing are paid by individuals seeking certification to the exam proctors and WPI, with no state funds provided directly to individuals; proctoring organizations collect funds from test-takers to cover proctoring costs and exam fees. The determination to purchase exams directly from WPI was found to be fair and reasonable and advantageous to the State of Arizona.

ADEQ's Operator Certification Program establishes standards and guidelines for the certification of drinking water and wastewater system and facility operators.
Public water systems regulated by ADEQ and delegated partners are required to have certified operators manage their systems. Facility owner must ensure at all times there is a certified operator at or above the grade of the facility:
Grade 3 & 4 facilities require an on-site operator.
Grade 1 and 2 systems require a certified operator and an on-site representative.
Grade 1 distribution facilities, serving fewer than 100 people, require a certified operator but do not need an on-site representative.
WPI holds registered copyrights on its exams and has assisted in the certifcation of more than 500,000 water and wastewater treatment professionals. WPI is the only nationally and internationally recognized not-for profit 501(c)3 organization that is recognized for developing operator examinations through a nationally recognized job task analysis survey that adheres to industry psychometric standards.

In accordance with the Procurement Rules, the Arizona Uniform Terms and Conditions must be made a part of all Contracts. If you will be required to sign a software licensing agreement or sign any other agreement containing terms and conditions, these will need additional review to ensure that the terms and conditions do not invalidate the Arizona Uniform Terms and Conditions. Approval of this request does not allow for agencies to exceed their dollar acquisition amount of delegated authority.

Purchasing exams directly from WPI is fair and reasonable and advantageous to the State of Arizona.
